Israeli President Isaac Herzog signed a decision on the evening of 19 September shortening the remaining period before the criminal record of Elor Azaria is erased, the former soldier who was convicted and imprisoned over the fatal shooting of a wounded Palestinian assailant who had already been subdued. Ynet reported that Defence Minister Israel Katz supported the request while Chief of Staff Eyal Zamir opposed it, and that Herzog decided in favour.

In a statement circulated by the president's office and published by the journalist Amit Segal, Herzog said he had examined the case as a whole and concluded that the circumstances, the passage of time and the remorse Azaria had expressed justified allowing him to open a new chapter. The statement tied the timing to the Jewish calendar, saying the decision was taken in the spirit of these days and out of a belief in the importance of repair, reconciliation and moving forward.

Who Elor Azaria is

Azaria was a conscript soldier serving as a combat medic when he shot a Palestinian attacker who had been wounded and neutralised. He was convicted of manslaughter in a military court and served a prison term. The Jerusalem Post described the presidential step as a pardon granted ahead of Yom Kippur that erases his record. The case divided Israeli public opinion at the time between those who saw a soldier abandoned by his commanders and those who saw a clear breach of the army's rules on opening fire.

What the president actually signed

The reports use different language for the same act, and the difference matters. Ynet, Segal and the Telegram channel Abu Ali Express describe the deletion, or the shortening of the deletion period, of the criminal record rather than a new pardon for the offence itself. The Jerusalem Post's headline calls it a pardon that erases the record. In Israeli law, a criminal conviction remains on record for a fixed number of years before it is deleted, and the president has the power to shorten that period. Azaria had already completed his sentence, so what was at stake was the record, not his liberty.

The role of the president in Israel

The Israeli presidency is largely ceremonial. The president does not set policy or control budgets, but holds the power of clemency, including pardons and the shortening of criminal record periods, usually exercised on recommendation from the justice ministry and relevant authorities. Barak Ravid, writing on X, argued that the office carries limited political power but significant normative weight, setting a public signal about what is considered acceptable.

The army's position, and a dispute over it

This is the point on which the accounts openly conflict. Abu Ali Express reported that Herzog accepted Katz's request to cancel the record against the position of the Israel Defense Forces. Ynet likewise framed the decision as running counter to the chief of staff.

Ravid posted on X that the president's residence briefed reporters that the decision had not contradicted the chief of staff, because in their account he had not expressed a position during the process at all. Ravid rejected that, citing what he described as an official document from the chief of staff's bureau dated two months earlier which stated that the position of the head of the Manpower Directorate and of the chief of staff was that the request should not be granted, on grounds including that the applicant had avoided expressing remorse or taking responsibility, roughly a decade after his conviction. The president's office has not, in the material available, responded to that document.

Reactions

Katz welcomed the outcome, calling it a humane and fitting decision, according to Ynet. Ravid, in a series of posts on X, called the move unfortunate, populist and harmful, arguing that Azaria breached the rules of engagement and the army's values and that upholding the rule of law is a necessity for a country at war. In another post he linked the decision to a wider pattern of lethal force, and in others he suggested it clears the way for Azaria to join the police and serves as a trial run for a possible pardon for Prime Minister Benjamin Netanyahu. Those are stated opinions, not reported facts.

What the reports do not say

The material does not give the legal instrument's full text, the original length of the deletion period or how much of it was cut. It does not say who else was consulted, whether the justice ministry or the military advocate general submitted an opinion, or what Azaria said in his request.
