השופט א' רובינשטיין:

עניינו של הערעור נסב על ההליך שלפיו ייקבע הרכב הרפואי לו זכאי המערער, נכה צה"ל (בשיעור 68%) החי בארה"ב. המערער, כנמסר, הוא בעל ממדי גוף גדולים וזקוק לרכב מיוחד. השאלה היא היכן ייערכו הליכי האישור, ובהקשר לכך – מהם ההליכים הללו. עובדתית מבקר המערער בישראל מדי שנה. אין חולק לגבי עצם הזכאות למימון רכב, בעקבות עע"מ 4515/08 מדינת ישראל נ' נאמן. ההליך הנדרש כיום כולל עמידה בפני ועדה להתאמת רכב (שעל תקפותה חולק המערער, אך נושא זה חורג מערעור זה), שבה ישנו גם גורם רפואי; ולאחר אישורה בדיקת מהנדס רכב, ולבסוף – אישור ועדת חריגים (בראשות רופא). אילו נתקבלה משאלת המערער, היה נבדק רק בידי מהנדס רכב וזאת בארה"ב, ולאחר מכן (בלא הופעה) בידי ועדת החריגים. לשיטת המשיבים, יש מקום לכל שלבי ההליך כאמור, וכיון שהמערער מבקר בארץ, אין סיבה שלא ייבדק בארץ בהליך כולו. בעקבות שיג ושיח עמנו מקובל על המערער שבנסיבותיו, הואיל והוא אכן מבקר בארץ, ייבדק כנדרש בארץ, ואולם משיג הוא לעניין הועדה להתאמת רכב.

נראה לנו ככלל כי ככל שניתן לפשט הליכים ולחסוך בהם כך שהמטרות החשובות של בדיקה מקצועית וחסכון כספי הציבור יושגו, אך בלא להכביד מינהלית על ציבור הנכים, כך ראוי וטוב, וגם השכל הישר יורנו דרכו. לשולחו באשר למקרה אפשרי של נכה הגר בחו"ל ואינו יכול להגיע ארצה בשל מצבו הרפואי, נמסר לנו כי העניין יישקל לנסיבותיו.

ככלל אכן נדרשת בדיקת הועדה להתאמת רכב, לשם קביעה פרטנית, אך בא כוח המשיבים מוסר לנו כי ככל שברי לועדה שלא חל שינוי לגבי הנכה מן הדברים כפי שהיו בבדיקה קודמת, מוותרת היא על הופעת הנכה בפניה. נמסר לנו כי נוכח השינוי בסוג הרכב שמבקש המערער יידרש הפעם להופיע בפני הועדה, אך לעתיד, ובלא שניטע מסמרות, יישקל באורח פתוח אם נחוצה ההופעה, והועדה תחליט ככל שתמצא לנכון; המערער יודיע מראש על בואו ארצה ותיקבע לו בדיקה הן (הפעם למצער) אצל הועדה להתאמת רכב – בלא שנביע מטעמנו דעה על סמכותה שהמערער משיג עליה – והן אצל מהנדס הרכב; ייעשה מאמץ לתאם את המועדים בזיקה לביקורי המערער. בנתון לכך נמחק הערעור בלא צו להוצאות.
