1.המשיבות מפעילות בתי עסק ברחוב מחנה יהודה שבשוק מחנה יהודה בירושלים. לגבי המשיבה 1 מדובר בבית קפה ואילו עסקה של המשיבה 2 הוא עסק של דברי מאפה. העסקים פועלים זה מספר שנים. המערערת נתנה רישיונות למשיבות להציב שולחנות וכסאות ברחוב, בגזרה שרוחבה 1.5 מטר, מעבר למדרכה (או הפודסט). הרחוב בו מדובר משמש למעשה כמדרחוב במרבית שעות היממה. בשלב מסוים, בשנת 2008 ובשנת 2009, שינתה המערערת את דעתה והחליטה שאין להתיר עוד הצבה של שולחנות וכסאות ברחוב. יצוין, כי לפי חוק עזר עירוני תוקפו של רישיון להצבה של כסאות ושולחנות הוא עד לסופה של השנה הקלנדרית. המשיבות עתרו לבית המשפט לעניינים מינהליים בירושלים נגד ההחלטה. בית המשפט (כבוד סגן הנשיאה ד' חשין) קיבל את העתירה. מכאן הערעור שבפנינו.

2.ההליך בערכאה הדיונית התייחס לגבי הרישיונות לשנת 2009, שהרי מדובר ברישיונות שתוקפם לתקופה מירבית של שנה. פסק הדין ניתן ביום 27.4.09 ונכללה בו הוראה לחדש את הרישיונות לשנת 2009. המערערת פעלה בדרך המתבקשת והמתחייבת שעה שנתנה רישיונות למשיבות אף לשנת 2010, בעוד הערעור תלוי בבית משפט זה. קרובים אנו כיום לסופה של השנה ולתחילתה של שנת 2011. ברי, כי על המערערת יהא לשקול שוב את חידוש הרישיונות בתקופה הקרובה. הגענו לכלל מסקנה כי אין מקום להתערב בפסק הדין, שכאמור התייחס לשנת 2009, בלא שיהא בכך כדי להשליך ישירות לגבי העתיד, הכל כמוסבר בהמשך. לא מצאנו שנפלה שגגה בפסק הדין שקיבל את העתירה לגבי שנת 2009.

3.נראה מן החומר, כי המערערת לא פעלה באופן עיקבי בכל הנוגע למתן הרישיונות למשיבות. אפשר שהדבר נובע מחילופי גברי אצל המערערת וייתכן שהדבר קשור בהליך דומה שניהלו רוכלים שביקשו להציב דוכנים באותו רחוב ממש. יוער, כי ההליכים בעניינם של הרוכלים הגיעו לסיום משניתן בבית משפט זה ביום 5.7.2010 פסק דין שקיבל את ערעורה של המערערת דכאן (עע"ם 3416/09). מכל מקום, ברור שעל המערערת לפעול על פי העקרונות הנוהגים במשפט המינהלי בכל הנוגע לחידושם של רישיונות. מכאן, שהמערערת רשאית להתחשב, בין היתר, בנסיבות חדשות. כך לדוגמה עלתה בפנינו השאלה מה יקרה אם בתי עסק נוספים ברחוב מחנה יהודה (או במקומות אחרים בשוק) יבקשו להציב שולחנות וכסאות בכביש המשמש למעשה כמדרחוב. הגם שמדובר במדרחוב, ברור שיש למנוע מצב של חסימת הכביש. יש לאפשר אף תנועה של כלי רכב ולוּ בשעות מסוימות, כך שניתן יהיה להביא אספקה לבתי העסק השונים הפועלים ברחוב בפרט ובשוק בכלל. כמו כן יש ליתן את הדעת לכך שבמצבי חירום ייתכן ויהא צורך לאפשר מעבר של כלי רכב. ניתן להניח שהרשות המוסמכת תיתן דעתה לשיקולים הרלוונטיים השונים משתבוא לשקול את בקשותיהן של המשיבות לחידוש הרישיונות לקראת השנה הקרובה ובשנים שלאחר מכן.

3.מסקנתנו היא איפוא שאין להתערב בפסק דינו של בית המשפט לעניינים מינהליים. עם זאת, בעת בחינה של בקשה לחידוש הרישיון רשאית המערערת לשקול את הנתונים העדכניים ולקבל החלטה בהתאם. הערעור נדחה איפוא בכפוף לאמור לעיל. לא ייעשה צו להוצאות.
