ערעור על פסק דינו של בית המשפט לעניינים מינהליים בתל אביב-יפו מיום 8.3.2012 (כב' השופטת ר' רונן) ב-עת"מ 1001/09.

1.המדינה מחזיקה במתחם המכונה "הקריה החקלאית" בשטחה של העירייה. בשנת 1995 נדרשה המדינה לשלם לעירייה היטלי פיתוח בגין המתחם. בין הצדדים היו אז חילוקי דעות שנסתיימו בהסכם פשרה לפיו המדינה תישא ב-60% מכלל היטלי הפיתוח. כן הושגו הסכמות ביחס לאופן החיוב של המדינה בגין שטחי המתחם. ביום 14.1.2008 דרשה העירייה מהמדינה לשלם היטלים בשיעור של כ-90 מיליון ש"ח בקשר עם המתחם. המחלוקת העיקרית בין הצדדים בנוגע לדרישה זו מתייחסת לחיוב המדינה בהיטלי פיתוח בגין רכיב הקרקע. מחלוקת זו היא הבסיס הערעור שלפנינו.

2.בית המשפט קמא קיבל את טענת המדינה וקבע כי בהסכם הפשרה חויבה המדינה לשלם עבור הקרקע שבתחום "חגורת המבנה" בלבד, קרי חגורת הקרקע שמסביב למבנים שהוקמו על-ידה, ולא עבור "תחום המחנה", קרי כל השטחים בהם מתבצעת פעילות הקריה החקלאית. עוד קיבל בית המשפט קמא את טענת המדינה לפיה הסכם הפשרה כלל ויתור מצד העירייה על כל טענה לגבי אגרות והיטלים בנוגע לשטחים הכלולים בהסכם. לפיכך, על מנת להטיל חיובים נוספים על העירייה להראות כי הבנייה נוספה למתחם לאחר ההסכם וכי לא שולמו בגינה היטלים עד כה.

3.בערעור שלפנינו חזרה העירייה על טענותיה כי הגדרת השטח בהסכם הפשרה התייחסה למכלול שטחי הקרקע הכלואים במתחם בו מתבצעת פעילות המדינה; וכי הסכם הפשרה הכיל את ויתור העירייה רק על הטלת היטלים בגין השטח ה בנוי ערב חתימת ההסכם ולא עבור מרכיב ה קרקע.

4.לאחר ששמענו את הצדדים ועיינו בחומר שהונח בפנינו, נחה דעתנו כי יש לאמץ את פסק דינו המפורט של בית המשפט המחוזי לפי תקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984.

הערעור נסב על ממצאי עובדה מובהקים ובכגון דא אין דרכה של ערכאת ערעור להתערב. נעמוד בקצרה על חלק מהקביעות העובדתיות של בית משפט קמא הצריכות לענייננו:

(-) נוסחו של סעיף 3 להסכם הפשרה, הקובע כי חיוב ההיטל בגין מרכיב הקרקע יעשה לפי "מבחן פונקציונאלי", מעיד על כך שכוונת הצדדים לא הייתה לכלול בהסכם את כלל השטחים במתחם אלא שטחים מסוימים בלבד.

(-) במהלך שמונה השנים הראשונות שלאחר הסכם הפשרה חייבה העירייה את המדינה בהיטלים בהתאם למדידה של הקרקעות שכללה רק את חגורת המבנים ולא את כל שטח תחום המחנה, בלא להעלות את הטענות אותן היא מעלה בערעור זה.

(-) העירייה ידעה על הכמות הכוללת של שטחי הקרקע במתחם ועל כך שהחיוב בגין שטחי הקרקע נוגע רק לשטחים ב"חגורת המבנים" ולא למכלול שטחי "תחום המחנה". ההפרש בין השטחים הוא ניכר ומשמעותי מאוד, ואינו מותיר אפשרות לטעות או ספק.

(-) התנהגות זו של העירייה מעידה על פרשנותה את ההסכם באופן ההולם את טענותיה של המדינה.

(-) אין הסבר מדוע במסגרת הסכם הפשרה יסכימו הצדדים על שיעור ההיטלים בקשר עם המתחם תוך הותרת מחלוקת בלתי פתורה ביחס לרכיב משמעותי אחד בהיטלים – רכיב הקרקע.

(-) אין מקום להניח – ודאי כאשר אין ראיות כלשהן כי זה היה המצב, כי במקרה דנן הסכימו הצדדים שחרף הסכם הפשרה יוותר תחום שלם שלגביו לא תהיה הסכמה. הסכם הפשרה נועד להביא להסכמה כוללת בין הצדדים ביחס לחיוב ההיטלים בו, ולא להותיר פתח לדרישות עתידיות שיולידו מחלוקות חדשות. כך נעשה ביחס למבנים ולא הובאה כל סיבה הגיונית שלא כך התכוונו הצדדים לפעול ביחס לרכיב הנוסף של החיוב, רכיב הקרקע.

5.נוכח קביעות עובדתיות מובהקות אלה, שאיננו רואים להתערב בהן, ממילא איננו נדרשים לסוגיות המשפטיות שהעלו הצדדים במסגרת הערעור.

6.סוף דבר: הערעור נדחה. העירייה תישא בהוצאות המדינה בסך של 10,000 ש"ח.
