פסק-דין

1.בית המשפט לענינים מינהליים בירושלים (כבוד השופט ד"ר י' מרזל) דחה עתירה שהגישה המערערת. העתירה תקפה החלטה של משרד האוצר לחשוף מסמכים מסוימים שהוגשו או נערכו במסגרת הליכי בוררות המתנהלים בין המערערת למדינה. הבקשה לגילוי המידע הוגשה על ידי המשיבות 2 ו-3. בבוררות טוענת המדינה כי מגיעים לה מן המערערת סכומי כסף נכבדים ביותר כתמלוגים בגין ניצול המשאבים שבים המלח על ידי המערערת.

2.בית משפט קמא דן באופן ממצה ומקיף בטענות של בעלי הדין ובסופו של יום דחה, כאמור, את העתירה. עם זאת, איפשר בית המשפט למערערת להגיש התנגדות פרטנית ומצומצמת למסירה של חלקים קונקרטיים במידע שנתבקש, הכל כאמור בפסק- הדין. טיעוניה של המערערת, הן בכתב הן בעל-פה, לא שכנעונו כי קיימת עילה להתערב בפסק-דינו של בית משפט קמא. יודגש כי עסקינן בבוררות שהמדינה צד לה. לא זו אף זו, הבוררות נוגעת למשאב לאומי, שהינו אחד החשובים במדינה. כמו כן יש לזכור כי זכויותיה של המערערת נתונות לה, בין היתר מכוח זיכיון שניתן לה (חוק זיכיון ים המלח, התשכ"א-1961). כלומר, הנתונים הנזכרים ונתונים נוספים מצביעים על כך שמ דובר בעניין בעל חשיבות ציבורית רבה. על רקע כל אלה לא נמצא לנו שיש בסיס למנוע חשיפה של המסמכים לגביהם התייחסה הבקשה לחשיפת המידע, הכל בהתאם לפסק-הדין.

3.אשר על כן, הערעור נדחה. המערערת תישא בשכר טרחה בסך 30,000 ש"ח לזכות כל אחת מן המשיבות.

ניתן היום, י"ט באדר א' התשע"ד (19.2.2014), בנוכחות באי כוח בעלי הדין.
