ערעור על פסק דינו של בית המשפט העניינים מינהליים בנצרת (השופט הווארי) מיום 18.8.11 בעת"מ 833-01-11

פסק-דין

א. עסקינן בערעור על פסק דינו של בית המשפט לעניינים מינהליים בנצרת שבו נדחתה עתירת המערערים, בגדרה ביקשו להורות על ביטול תכנית רישום שיכון ציבורי (תרש"צ) 1/67/2 בכפר תבור, משנת 2009 (התרש"צ המתקנת), אשר תיקנה את התכנית הקודמת 1/67/1, משנת 2008 (התרש"צ הראשונה). ביסוד הסכסוך במקורו גודל שתי חלקות בכפר תבור, אך כפי שיובא להלן, מהותו "איזור הגבול" שבין שתי החלקות במקום מסוים. על פי התרש"צ המתקנת הוקטן שטח חלקתם של המערערים לעומת התרש"צ הראשונה מ-711 מ"ר ל-570 מ"ר, והוגדל שטח חלקתם של משיבים 5-4 מ-461 מ"ר ל-600 מ"ר. בית המשפט קמא דחה את העתירה, בקבעו – בין השאר – כי התרש"צ השניה תיקנה פגם בתום לב שנעשה בתרש"צ הראשונה. קביעתו באה על פי תשריט מקורי של הקצאת שטח המגרשים, חוזי חכירה ופיתוח, היתרי הבניה והמצב בשטח.

ב. בערעור נטען, בין השאר, כי הגבול בין החלקות הוסג על-ידי המשיבים 5-4 לעבר חלקתם של המערערים, כך שכיום רוחב המעבר לקליניקה הרפואית של המערערים הוא 1.8 מטרים בלבד במקום 4 מטרים. בתשובת משיבי המדינה נטען כי התכנית המתוקנת אושרה ללא התנגדות מצד המערערים, והיא באה לתקן טעות מוכחת. מטעם המשיבים 5-4 נטען, בנוסף לטענות של שיהוי וחוסר נקיון כפיים, כי גודל החלקות שבתכנית המתקנת וכן קו הגבול הקיים בין החלקות תואמים את הסכמי החכירה ומפת המגרשים מ-1978. בתשובת המערערים נטען כי יש לבטל את התרש"צ, במיוחד כיון שעתה אין אפשרות לשימוש בביתם כפי שתוכנן, שכן המעבר לקליניקה של המערערים אינו אפשרי ברוחב של פחות משני מטר מקו הגבול.

ג. בפנינו זנחו – כך נראה – המערערים (שהיו מיוצגים בדיון בעל פה, אך לפני כן טענו לעצמם) את הטענה באשר לגודל המגרש, וכרגע אין לפנינו מחלוקת כי על מגרשם להיות בן 570 מ"ר. הם התמקדו בקו הגבול באיזור המעבר בין חלקתם לזו של משיבים 5-4, ובטענה האמורה בעניין המעבר, שאין בו די ויש איפוא לבטל את התרש"צ ולעבור לתכנית מפורטת.

ד. לאחר העיון לא ראינו מקום להיעתר לערעור. כיום אין חולק באמת כי התרש"צ תיקנה טעות שנפלה בתרש"צ הראשונה באשר לגודל החלקות. על פי סעיף 5(ד) לחוק רישום שיכונים ציבוריים (הוראת שעה) תשכ"ד-1964 בנוסחו לעת הרלבנטית "תכנית שיכון ציבורי מאושרת יראו אותה לעניין פעולת רישום וקביעת גבולות החלקות ושטחיהן כתכנית מפורטת שאושרה לפי חוק התכנון...". לא נמצאה לנו עילה לביטול התרש"צ, אם נוכח השיהוי ואם לגופה. לא ראינו מקום להתערב גם בהנמקת בית המשפט קמא באשר לאפשרות שהיתה בידי המערערים להידרש לתכנית המתקנת במועד, ומכל מקום ככל שהיה קושי בעניין זה - רופא בעצם ההליך בבית המשפט קמא.

ה. השאלה האמיתית המטרידה את המערערים לטענתם כעת היא כאמור, רוחב המעבר עד קו הגבול; אך לא מצאנו עילה משפטית להתערב בתרש"צ, שנתבססה על ראיות מינהליות – גם לא בנושא זה. נציין כי על פניו, 1.8 מ' (כטענת המערערים) הוא רוחב המאפשר מעבר סביר לקליניקה (אף למי שנזקק לכסא גלגלים). אין כמובן בכך כדי למנוע השגת הבנה בין הצדדים באשר – למשל – לחילופי שטח קטנים שיאפשרו הרחבה, וכמובן איננו מביעים דעה על כך. קראנו גם את סיפת סיכומי המשיבים 3-1, שלפיה הגיש מינהל מקרקעי ישראל לועדה המקומית תכנית תיקונים מסוימת, ואנו מציינים זאת בלא הבעת דעה, שכן התכנית אינה בפנינו.

ו. איננו נעתרים איפוא לערעור. המערערים יחויבו בהוצאות המשיבים בסך 7,500 ₪ לכל קבוצת משיבים.
