1.ערעור על פסק הדין של בית המשפט המחוזי מרכז (סגן הנשיא אילן ש' שילה) בעת"מ 7486-09-10 מיום 8.11.2010, בגִדרו נדחתה עתירתם של המערערת ואחרים נגד אישור תוכנית מפורטת נת/מק/343/19/ה (להלן: התוכנית), שעניינה בביצוע פרוייקט בניה בסמוך לחוף סירונית בעיר נתניה.

2.התוכנית הופקדה ואושרה על-ידי הוועדה המקומית. המערערת ואחרים הגישו עתירה לבית המשפט המחוזי נגד אישור התוכנית, בטענות שונות. בין יתר טענותיהם טענו כי דבר הפקדת התוכנית לא פורסם כדין (סעיף 89 לחוק התכנון והבניה, התשכ"ה-1965), ולפיכך נמנעה מהם האפשרות להתנגד לתוכנית בטרם אישורה (סעיף 100 לחוק התכנון והבניה). עוד טענו כי התוכנית אושרה על אף שביצועה אינו עולה בקנה אחד עם הוראות תמ"א 13, לפיהן לא תאושר בניה בתחום של 100 מטר מ-"קו פני המים העליון" (סעיף 12(2)(א)), והפרוייקט מתוכנן להתבצע בתחום האסור. לשיטתם, הוראות חוק השמירה על הסביבה החופית, התשס"ד-2004 (להלן: חוק החופים) חלות גם על הוראות תמ"א 13, כך שמשמעות "קו המים העליון" בהוראות תמ"א 13 תיקבע לפי הגדרת "קו החוף" בסעיף 2 לחוק החופים. כפועל יוצא מכך, טענו המערערת ואחרים כי החישוב של המשיבים לעניין מרחק הבניה מ-"קו פני המים העליון" הוא מוטעה, שכן נעשה אך ורק על-פי הוראות תמ"א 13. בבית המשפט המחוזי כשלו המערערת ואחרים בהימנעותם מלצרף תצהיר לעתירתם.

3.בית המשפט המחוזי ציין בפסק דינו כי חרף העובדה שבתגובה מקדמית לעתירה ובתגובה לבקשה למתן צו ביניים הועלתה טענה כי יש למחוק את העתירה מחמת אי-צירוף תצהיר, הרי שעד לבוקר הדיון בבית המשפט המחוזי לא הוגשה כל בקשה לצירוף תצהיר, ובפועל תצהיר שכזה לא הוגש. הסבר שניתן על כוונה להחתים את המצהיר בבוקרו של אותו יום, לא היה בו כדי להועיל, כי גם בחלוף 50 דקות מן המועד שנקבע לדיון, לא התייצב המצהיר בבית המשפט. בית המשפט המחוזי לא ראה בנסיבות הללו מקום ליתן ארכה נוספת להגשת התצהיר. בפסק דינו ציין בית המשפט המחוזי כי איננו מורה על מחיקת העתירה רק מחמת אי-צירוף התצהיר, אלא מכיוון שסבר שגם לגוף העניין דינה של העתירה להידחות. בית המשפט המחוזי קבע כי הטענה לפיה המשיבה 11 לא פירסמה את דבר הפקדת התוכנית לשם קבלת התנגדויות בשטח שבו היא מתכוונת לבנות את הבניין נשוא העתירה, נסתרת בתצהיריה, והדעת נותנת שלנוכח האמור בתצהירים הללו צריכים היו המערערת והאחרים לדעת על הפירסום. אלו מצדם טענו כי מצילום של השלט כשהוא מוצב בשטח המיועד לבנייה נראה לכאורה שהוצב אך ורק לצורך התצלום, אך הדברים הללו, לדברי בית המשפט, לא היו ברורים בעיניו. כיוצא בזה פסק בית המשפט כי הוראות תמ"א 13 גוברות על הוראות חוק החופים, ולפיכך השטח המיועד לבניה אינו נמצא בתחום של עד 100 מטרים מ-"קו המים העליון" ואינו אסור בבניה.

4.המערערת הגישה ערעור. האחרים, תושבי האזור, נמנעו מלערער, וזאת, לפי הנטען, מחמת חסרון כיס. כמה וכמה טענות טענה המערערת, ובעיקר על הפגם שבאי-פירסום דבר הפקדת התוכנית, ולעניין תחולת חוק החופים, ועליונותו על הוראות תמ"א 13. מנגד, בתשובה לערעור נטען כי בדין מחק בית המשפט המחוזי את העתירה, משום שהמערערת לא הגישה תצהיר כדין, דבר הפירסום הוכח, וממילא לא נמנעה אפשרות להתנגד לתוכנית. באשר לטענת המערערת על ביצוע הפרוייקט בקרבה יתרה לחוף, נאותה המשיבה 11 לבנות בתחום המותר על-פי פרשנות המערערת, ולו לצרכי פשרה, על מנת לא לעכב עוד את ביצוע העבודות, אולם המערערת המשיכה להחזיק בגרסתה, לפיה דבר ההפקדה לא פורסם כדין, ועמדה על ערעורה בעניין זה.

5.בשלב ראשון ראינו שלא להידרש לגופן של הטענות, כבדות משקל כשלעצמן. קראנו אותן בכתובים, אך במהלך הדיון התמקדנו תחילה בטענות על מניעת האפשרות להתנגד לתוכנית, מחמת אי-פירסומה כדין. אין להקל ראש במחדלה של המערערת בבית המשפט קמא בכך שלא צירפה תצהיר כדין לעתירה, ובהחלט מובנת תרעומתו של בית המשפט בהקשר זה. זמן שיפוטי הוא נכס ציבורי ואיננו הפקר. יחד עם זאת, בהתחשב עם הטענות שעל הפרק ועם נושא הדיון, דומה כי מוטב היה לנקוט בסנקציה מתונה יותר של השתת הוצאות. אמנם, כאמור, בית המשפט המחוזי לא ראה למחוק את העתירה רק על סמך הפגם שבאי-הגשת התצהיר, אך לטעמנו לא בוררו עד תום העניינים שקדמו לגוף העניין, והריהם חשובים מאד: אם אכן נמנעה שלא כדין אפשרות להתנגד לתוכנית, אם לאו. בעניין זה לא ניתנה הנמקה מדוע ראה בית המשפט להעדיף את גרסת המשיבה 11 על פני מה שטענו רבים מקרב האחרים על אי-הפירסום. המשיב 10 כלל וכלל לא ידע על ההליך בבית משפט קמא, עניינו לא נשמע, אביו נפטר לבית עולמו, והודעה על ההליך כלל לא הובאה לידיעתו. ממילא, לטענתו, נסתתמו טענותיו מבלי ליתן לו פתחון פה. לבד מנושא זה, הרי שלגופו של עניין נטענו טענות רציניות שמחייבות בחינה מעמיקה. מצדנו, איננו נוקטים עמדה כלל וכלל בנושא שלגוף העניין, לבד מאמירתנו כי הוא מחייב עיון ודיון, לאחר מיצוי הדיון בנושא המקדמי.

6.אשר על כן החלטנו לקבל את הערעור ולהורות על ביטול פסק הדין שהורה על מחיקת העתירה. חרף קבלת הערעור, מחמת מחדלה, תישא המערערת בהוצאות המשפט ותשלם שכר טרחת עורך דין בסך של 40,000 ₪: מחציתם למשיבות 1 ו-2 ומחציתם למשיבה 11.
