המשנה לנשיאה א' ריבלין:

מוסכם על הצדדים כי הקביעה הכלולה בפסק הדין של בית המשפט המחוזי, לענין חברותה של המערערת בקיבוץ כפר המכבי מבוטלת.

לפיכך, אנו קובעים כי במובן זה מתקבל הערעור, וייקבע כי המערערת היא חברת קיבוץ כפר המכבי. אין בקביעה זו כדי למנוע מן הקיבוץ לפעול על פי התקנות ועל פי ההסכמים, ובלבד שהפעולה כאמור לא תתבצע טרם חלוף שנה מהיום, או שייושם תהליך שיוך הדירות בקיבוץ בפועל, על פי המוקדם, וזאת על מנת שבתקופת הביניים ינהלו הצדדים משא ומתן ליישוב כל המחלוקות שביניהם.

יתר חלקי הערעור נדחים.
