המשנה לנשיאה א' ריבלין:

1.המערער, יליד שנת 1976, נפגע ביום 30.7.2001 בתאונת-דרכים. הוא הגיש תביעה לפי חוק פיצויים לנפגעי תאונות דרכים, התשל"ה-1975, ובית-המשפט מינה מומחים רפואיים – תחילה בתחום הנוירולוגי (שבו לא נקבעה נכות), ולאחר מכן בתחום האורולוגי ובתחום הפסיכיאטרי. המומחה בתחום האורולוגי קבע למערער נכות רפואית (5% בגין הפרעות בהטלת שתן, ו-20% בגין פגיעה חלקית באונות). המומחה בתחום הפסיכיאטרי קבע נכות רפואית בשיעור של 30%, ועל קביעה זו האחרונה נסבה עיקר המחלוקת. בית-המשפט המחוזי הסתייג מקביעתו של המומחה בתחום הפסיכיאטרי כי המערער לוקה בהפרעה בתר-חבלתית, וזאת משהתברר כי המומחה בא לכלל מסקנתו מבלי שהובאו לידיעתו עובדות בעלות חשיבות. בפרט, בית-המשפט התרשם כי טענותיו של המערער לפני במומחה לא עלו בקנה אחד עם אופן תפקודו במציאות, וכי בעדותו בבית-המשפט הקצין המערער והגזים בתיאור מצבו. בית-המשפט הוסיף כי גם בהנחה שמ דובר בהפרעה קונברסיבית, שיש בה עליות ומורדות, לא ניתן להתעלם מן הראיות לגבי תפקודו ומן הרושם שהמערער "מנסה לקצין ככול האפשר את מצבו הנפשי והחברתי הקשה ולהאדיר את נזקיו כתוצאה מכך". בהתחשב בכל הנסיבות, ומבלי לקבוע קביעה נחרצת לגבי שיעור הנכות הפסיכיאטרית, בא בית-המשפט לכלל מסקנה כי נכותו התפקודית של המערער עומדת על 20%.

על רקע הקביעות הנזכרות, אמד בית-המשפט המחוזי את הפיצויים המגיעים למערער בראשי הנזק השונים. בגין הפסד השתכרות נפסק למערער, בנוסף לפיצוי עבור תקופת אי-הכושר, פיצוי גלובלי של 100,000 ש"ח לעבר וסכום של 600,000 ש"ח לעתיד. בגין עזרת הזולת, נפסק סכום גלובלי של 50,000 ש"ח. כמו כן נפסקו פיצויים עבור נסיעות (50,000 ש"ח), תרופות (50,000 ש"ח) וכאב וסבל (135,651 ש"ח). מן הפיצויים נוכו תגמולי המל"ל לפי חוות-הדעת האקטוארית שהוגשה לבית-המשפט, והתוצאה היתה שהתגמולים "בלעו" את הפיצוי. משכך, נדחתה התביעה.

בחנו בעיון רב את השגותיו של המערער על פסק-הדין של בית-המשפט המחוזי, ולא מצאנו עילה להתערבותנו. במקרה זה, כמו במקרים אחרים, התעוררה השאלה האם הקשיים שהציג המערער מבטאים פגיעה נפשית אמיתית – הפרעה קונברסיבית בעלת השלכות משמעותיות על חייו ותפקודו, או שמא מ דובר בהעצמה משמעותית שביסודה רצון לרווח משני. למותר לציין, כי יש משקל רב לחוות-הדעת של המומחה בתחום הנפשי באשר לאבחון מצבו של תובע כמתחזה או כמי שסובל מהפרעה קונברסיבית ומתסמינים פוסט טראומטיים אמיתיים. עם זאת, ההכרעה נתונה בידיו של בית-המשפט, ואין מניעה להביא בחשבון, בנוסף לחוות-הדעת, גם נתונים נוספים העולים מן הראיות. במקרה זה, מצא בית-המשפט המחוזי אי-התאמה ניכרת בין מצגים עובדתיים שהובאו לפני המומחה לבין המציאות לאשורה, וכן התרשם בית-המשפט כי המערער בחר בעדותו בדרך ההפרזה. בנסיבות אלה רשאי היה בית-המשפט המחוזי שלא לאמץ במלואה את חוות-הדעת של המומחה.

יודגש, כי בית-המשפט לא שלל את קיומה של נכות פסיכיאטרית (יצויין כי בחישוב הפיצוי בגין כאב וסבל בית-המשפט אף הלך לקראת המערער והניח קיומה של נכות בשיעור של 30% בתחום הפסיכיאטרי), עם זאת בכל הנוגע ליכולת התפקוד של המערער לא היה בית-המשפט מוכן לעצום עין למכלול הראיות שבאו בפניו והתמיהות שעלו מהן, אשר במידה רבה טפחו על פני ההנחות והממצאים שקבע המומחה. בכך לא ראינו עילה להתערב.

בחנו את טענות המערער גם לגבי יתר הקביעות בפסק-הדין, אך לא מצאנו עילה להתערבות בשומת הפיצוי שערכה הערכאה המבררת.

התוצאה היא שהערעור נדחה.

בנסיבות העניין, יישא המערער בשכר טרחת עורך-הדין של המשיבות בסכום של 2,500 ש"ח.
