כתב הערעור שבפנינו אינו ברור והתקשנו "לחלץ" ממנו את טיעוניו של המערער. לכך יש להוסיף את הסגנון הבוטה והמשתלח בו נקט המערער בכתב הערעור ובסיכומיו. די בכך כדי להצדיק את דחיית הערעור.

למעלה מן הצורך נציין, כי המערער לא התייחס כלל לנושא ההתיישנות, בגינו נמחקה תובענתו בבית משפט קמא על הסף. השתכנענו כי אכן היה מקום לדחיית התביעה מחמת התיישנות, ושמא גם מחמת מעשה בית דין, לאור ההליך הקודם שהתנהל בין המערער למשיב 1 בבית משפט השלום.

המערער ישא בהוצאות המשיב 1 בסך 6,000 ₪ ובהוצאות המשיבים 7-6 (רשות הפיתוח ועיריית אשקלון) בסך 3,000 ₪ כל אחד.
