א.

1.בין המערערים למשיבים ניטש סכסוך שכנים רב שנים, שמצא דרכו לבתי המשפט ולגופים מינהליים שונים, ולמרבה הצער טרם נסתיים. ההליך הנוכחי עניינו ערעור על פסק דינו של בית המשפט המחוזי בחיפה (השופט – כתארו אז – נאמן) בת"א 339/03 מיום 21.3.06. המדובר בתביעה בגדר דיני הנזיקין שעניינה נזק נטען בעקבות בניית קיר תומך על ידי המשיבים במגרשם הגובל במגרש המערערים, ללא היתר. נטענו טענות בגין הפרת חובה חקוקה ומטרד ליחיד, ונתבקשה כסעד הסרתו של הקיר התומך וזאת עד לגובה שלא יעלה על 1.80 מטר מפני הקרקע הטבעיים, גובה שאותו קבעה (בעיצומם של ההליכים) ועדת הערר לתכנון ובניה במחוז חיפה. אין חולק כי המדובר בקיר הטעון היתר בניה, וכזה לא ניתן למשיבים. נטען לנזקי אי נוחות, חסימת אור ואויר, וירידת ערך.

2.בית המשפט קמא ערך ביקור במקום ועיין בחוות דעת של מודדים ושמאים משני הצדדים. בסופו של יום, לאחר שמיעת ראיות, דחה את תביעת המערערים כיוון ששוכנע כי לא נגרמו להם נזק או אי נוחות. בית המשפט ראה את התביעה כנובעת מן הרקע הטעון ביחסי הצדדים, וסבר כי המערערים לא נהגו בניקיון כפיים משהמתינו בתביעתם עד להשלמת העבודות של הקיר התומך, ולעומת זאת שוכנע כי המשיבים פעלו בתום לב וסברו כי אין צורך בהיתר בנייה. עוד נאמר, כי קיימת אפשרות לליגליזציה של הקיר התומך על ידי בקשה לבניית קיר נוסף מצופה אבן טבעית בצירוף צמחייה. עם זאת לא הטיל בית המשפט הוצאות, שכן המשיבים בנו את הקיר התומך ללא היתר, ולא ניתן לו היתר גם לאחר מכן.

ב.

1.בערעור נטען, כי המשיבים מוסיפים לחטוא בנזק למערערים, וכי כל מבוקשם הוא כי הקיר התומך יונמך לגובה 1.80 מטר. לענין זה מטעימים הם את החלטתה של ועדת הערר שהגבילה את הקיר לגובה האמור. לשיטת המערערים גם אין דרך לפתרון הבעיה בבניית קיר נוסף, כאמור בפסק הדין קמא גם בפנינו חזר המערער על הבקשה להורות למשיבים לסלק את הקירות, תוך הטעמת תולדותיהם של היחסים בין הצדדים, כפי שצוינו בערעור.

2.המשיבים אף הם נדרשו לתולדות הסכסוך בין הצדדים ותמכו יתדותיהם בקביעותיו של בית המשפט קמא. ולשאלותינו ציין בא כוח המשיבים כי בראשית הדברים לא ידעו המשיבים שהם עושים דבר שלא כדין; עם זאת הודה, כי גם עד כה לא פנו לבקשת היתר.

ג.

1.עיינו בטענות המערערים. יש לזכור, כי הערעור נסב על פסק דין שעניינו בתביעת נזיקין, ולא על מכלול נושאים שהיו במחלוקת בין הצדדים לאורך שנים רבות. לא מצאנו מקום להתערבות בממצאי העובדה והמשפט שקבע בית המשפט קמא, שעל פיהם לא נמצא שנגרם למערערים נזק. על כן אין מקום להיעתר לערעור שעניינו תביעה על פי דיני הנזיקין, ולסעד המבוקש.

2.עם זאת אנו רואים להידרש לנושא אחד שבערעור, והוא העובדה שהקיר התומך הגבוה שבמוקד הסכסוך בנוי שלא כדין. החלטת ועדת הערר מיום 18.9.05 קבעה, כי הקמת קיר תומך בגובה כ- 4.5 מטר "מהווה פגיעה בשכנים גובלים, כאשר בגבולות חלקותיהם מתנשא קיר כה גבוה. סבורים אנו כי יש מקום לקבוע שהקירות התומכים יונמכו כך שגובהם לא יעלה על 1.80 מטר מקו קרקע טבעית, בהתאם להוראות תכנית פ/1400 יב, המסדירה בניית קירות תומכים במרווחים צדדיים...". והנה הקיר עודו על מכונו, וגם הערת בית המשפט קמא בסיפא של פסק דינו שלפיו תיתכן אפשרות של ליגליזציה בתנאים מסוימים לא הביאה את המשיבים לפעול בענין זה. יש להצטער על כך, שכן קיום הקיר במתכונתו כיום מהווה פצע מדמם ביחסים בין הצדדים ומקור לטרוניה מיותרת, לכך גם השלכה על החלטתנו להלן בענין ההוצאות.

3.כאמור, אין בידינו להיעתר לערעור. דיני הנזיקין שמכוחם תבעו המערערים מבוססים על קרות נזק, מה שלא אירע על פי קביעותיו העובדתיות של בית המשפט קמא, שנתבססו גם על ביקור במקום. תפקיד האכיפה לענין דיני התכנון והבניה נתון בידי הרשויות, וכיוון שלא בהליך מינהלי עסקינן ועמדת הרשויות אינה לפנינו, איננו יודעים מדוע לא פעלו הרשויות לעניין אכיפת דיני התכנון והבניה בעקבות החלטתה של ועדת הערר, ומדוע לא פעלו המשיבים להסדרת המצב אם בידם להסדירו. אשר לערעור עצמו, לא ראינו כאמור עילה משפטית לקבלו.

4.בנסיבות החלטנו להטיל על המערערים הוצאות על הצד הנמוך, בסך 3,000 ₪.
