פסק-דין

במספר פסקי דין חלקיים דחה בית המשפט המחוזי בחיפה הודעות צד ג' והודעות צד ד' בהליכים המתנהלים בפניו. כמו כן דחה בית המשפט בקשה לביטולו של פסק דין חלקי באותה פרשה. הטעם לדחייתן של ההודעות היה השיהוי בהגשתן. בית המשפט אף הסביר מדוע הודעות מסוימות אחרות לא נמחקו. הטעם שניתן על ידי בית המשפט המחוזי מקובל עלינו וכן ההסברים לאבחנות בין בעלי הדין השונים. בשל ריבוי בעלי הדין העניין מורכב ולא ראינו צורך לפרטו. נסתפק בציון העובדה, כי האירוע שהביא להגשתה של התביעה העיקרית התרחש לפני כשמונה עשרה שנים. במאמר מוסגר נעיר, כי לא ראינו צורך להתייחס לשאלה האם על המערערת בע"א 6211/08 הייתה חובה להגיש בקשת רשות ערעור ולא ערעור.

כל חמשת הערעורים נדחים. המערער בע"א 1617/07, ע"א 5928/07 ו-ע"א 4535/08 יישא בשכר טרחה בסכום של 5,000 ש"ח לזכות כל אחד מן המשיבים באותם ערעורים (אלא שבע"א 1617/08 הסכום האמור יהא לגבי המשיבים 1 ו-2 יחדיו, שכן הם מיוצגים יחד). המערערת בע"א 5552/07 וע"א 6211/08 תישא בשכר טרחה בסכום 5,000 ש"ח לזכות כל אחד מן המשיבים בערעורים אלה.

ניתן היום, כ' בשבט התש"ע (4.2.2010).
