השופט א' רובינשטיין:

לאחר שמיעת הצדדים, החלטנו להשיב את התיק לבית המשפט קמא להכרזת פשיטת רגל של מר לרנר וגב' מיאלי, בכפוף לתשלום הפער בתשלומים שלא שולם עד הנה בתוך 60 יום.

לדעתנו בנסיבות שנוצרו מחד גיסא, ישנם סימני שאלה – אף אם לא נחרצים – שמא החובות לא נוצרו בתום לב; ומאידך גיסא, יש לזכור כי גם המערערים סובכו ככל הנראה על ידי קרובם אייל ברקוביץ המואשם כיום בפלילים, וגם מכרו את דירתם, ועל פני הדברים ישנה כיום חדלות פרעון לשניהם המביאה לפער אדיר בין מסת החובות ליכולת ההחזר.

בשקלול, מקובלות עלינו לעת הזאת עמדתו העדכנית של הכנ"ר ועמדת המנהל המיוחד, כי דרך זו של החזרה להכרזת פשיטת רגל עדיפה על הפניה לבקשה חדשה לפשיטת רגל, שכן המנהל המיוחד (שלגבי מר לרנר מונה לא מכבר) יוכל להתחיל לפעול במרץ לאיתור אפשרויות. פשיטא כי בית המשפט לפשיטת רגל מתבקש לנהל את ההליך באופן שעינו, באמצעות המנהל המיוחד והכנ"ר, תהא פקוחה על כל האפשרויות לאיתור מקורות תשלום, לרבות בדיקת הפרשה של גירושי לרנר מאשתו אך המשך מגוריהם יחדיו (דבר שלפי הנטען מפי בא כוחו אמנם נובע מחסרון כיס), וזאת בלא שניטע מסמרות.

החזרת התיק להכרזת פשיטת רגל אינה, מבחינת הנושים, סופה של דרך כל עיקר, וימים יגידו מה העלו מאמצי המנהל המיוחד והכנ"ר.

הערעור מתקבל לפי האמור. אין צו להוצאות.
