פסק-דין

1.ביום 7.1.2014 הוגשה הודעה מוסכמת בה הובהר כי אגד תיור ונופש בע"מ הינה נושה של המערערת 2 ושל אביה מנחם לרנר (הוא המערער בע"א 7429/13), אך אינה נושה של המערער 1 (אודי מיאלי). לאור זאת הוסכם בין בעלי הדין כי –

א) לפנים משורת הדין יתקבל הערעור, התיק יוחזר לבית המשפט המחוזי על מנת שהמערער 1 יוכרז פושט רגל והמשיב 1 ימונה כנאמן לנכסיו.

ב) המערער 1 ימשיך לשלם את התשלומים החודשיים שנפסקו לו וכי התשלומים ישולמו גם עבור התקופה שלאחר מתן פסק-הדין ועד למועד אישור ההסכמות נשוא ההודעה מיום 7.1.2014, וכי המערער 1 ישלם את הפיגורים שצבר בתשלומים החודשיים עד כה.

ג) למען הסר ספק, המערער 1 מצהיר כי סך התשלום שעליו לשלם בגין האמור בסעיף ב' לעיל עולה כדי 5,000 ש"ח, נכון לחודש ינואר 2014, ומוסכם כי התשלום הנ"ל ישולם בארבעה תשלומים חודשיים שווים החל מחודש ינואר 2014 ויהווה תנאי לביטול פסק-הדין של בית משפט קמא.

2.ניתן תוקף של פסק-דין לאמור בסעיפים א' -ג' של פיסקה 1 לעיל. האמור בפסק-דין זה יבוא תחת האמור בהחלטת הנשיא מיום 24.12.2013, ככל שמ דובר במערער 1 בע"א 7512/13. במלים אחרות, האמור בהחלטה הנזכרת יחול אך לגבי המערערת 2 בע"א 7512/13 ועל המערער בע"א 7429/13.

לא ייעשה צו להוצאות.
