פסק-דין

1.במהלך שיג ושיח ובעידודנו הושגה בין בעלי הדין הסכמה כדלקמן:

א) הבנק זכאי למחצית מן הנכס בחלקה 61, גוש 6325 (הוא בית המגורים ברחוב נצח ישראל 3, פתח-תקווה). זכותו של הבנק, שתעוגן בהערת אזהרה, היא לאחר 120 של גב' סיגל ריבוא. כיום רשום הנכס על שם המנוח ישי ריבוא וסיגל ריבוא.

ב) לאחר רישום הערת אזהרה לזכות הבנק יבוטלו כל הליכי ההוצאה לפועל שפתח בהם הבנק (תיק הוצל"פ 01-72657-12-1).

ג) זכותו של הבנק למחצית היא לעניין הנכס כפנוי. מובהר, כי שלושת יורשיו של המנוח ישי ריבוא ז"ל, המיוצגים על ידי עו"ד אלשיך, לא יעלו כל טענה כנגד זכותו האמורה של הבנק לגבי מחצית הנכס. היורשים מסכימים כי זכותו של הבנק תעמוד לו לגבי הנכס כפנוי.

ד) היה והנכס יימכר לפני 120, זכאי הבנק לקבל מחצית מן התמורה.

ה) היורשים מצהירים כי זכותו של הבנק לגבי הנכס עדיפה על פני זכותם של נושים אחרים של העיזבון (אם קיימים כאלה).

2.ניתן תוקף של פסק-דין למוסכם. אין צו להוצאות.

ניתן היום, ו' בטבת התשע"ד (9.12.2013), בנוכחות באי כוח בעלי הדין.
