במהלך הדיון, ועל פי הצעת בית המשפט, הודיע ב"כ המשיב 1 כי מבלי להודות בשום חבות או טענה של המערערת, או בקיום נזק או עילה כלשהי, הוא מסכים להצהרה המבוקשת בפתח המרצת הפתיחה שהוגשה, ככל שהיא מתייחסת לחשבונה העסקי של המערערת אצל הבנק, וזאת אף שהבנק סבור כי מ דובר בהצהרה שהיא אקדמית גרידא.

על יסוד הודעת הבנק, ובכפוף לתוכנה, אנו מקבלים את הערעור, מבטלים את פסק דינו של בית המשפט קמא, וקובעים בהסכמת הצדדים כי ניתן בזה הסעד ההצהרתי המבוקש ברישא להמרצת הפתיחה שהוגשה על ידי המערערת.
