ערעור על פסק דינו של בית המשפט המחוזי בחיפה מיום 23.11.2011 (כבוד השופט יצחק כהן) בת.א. 1939-02-10.

1.המשיב, יליד 1985, נפגע בתאונת דרכים ביום 30.7.2007 עת רכב על אופנועו במהלך עבודתו כשליח במסעדה, ועל כן הוכרה התאונה כתאונת עבודה. נכותו הרפואית הצמיתה של המשיב הועמדה על ידי המוסד לביטוח לאומי על 30% בגין שיתוק של עצב ביד שמאל, והופעלה תקנה 15 במלואה, כך שהנכות הועמדה על 45%. המשיב היה בתקופת אי כושר של 100% עד ליום 31.3.2008 ולאחר מכן הועמדה נכותו הזמנית על 50% לתקופה עד ליום 31.10.2008. כשנה לאחר התאונה, החל המשיב ללמוד כלכלה ומנהל עסקים באוניברסיטה ונכון ליום מתן פסק הדין בבית משפט קמא, היה בשנה האחרונה ללימודיו.

2.בית משפט קמא, שנתן פסק דינו על אתר, לאחר שהצדדים סיכמו בעל פה, העמיד את נכותו התפקודית של המשיב, וליתר דיוק את הפסד כושר השתכרותו, על 45%. בהתאם לכך חישב בית המשפט את הפסדי השכר בעתיד על בסיס השכר הממוצע במשק נטו והעמיד הפיצוי בראש נזק זה על 940,000 ₪ במעוגל. בנוסף נפסקו לזכות המשיב סכומים בגין ראשי הנזק הבאים: פיצוי בגין הפסד השתכרות בעבר על בסיס שכרו עובר לתאונה – 200,000 ₪; הפסדי פנסיה – 94,000 ₪; נזק לא ממוני – 61,000 ₪; עזרת צד שלישי בעבר – 25,000 ₪; הוצאות שונות – 10,000 ₪. מסכומים אלה נוכו תגמולי הביטוח הלאומי לעבר ולעתיד בסך 780,000 ₪, כך שסך הכול הועמד הפיצוי על סך של 550,000 ₪.

על כך נסב הערעור שבפנינו.

3.לזכות המערערת אציין כי מיקדה את הערעור בשתי נקודות והן:

הפסד השתכרות בעבר – נטען כי הסכום של 200,000 ₪ הוא מופרז בנסיבות העניין.

שיעור הנכות התפקודית – נטען כי החלטת המל"ל לגבי הנכות הרפואית מחייבת כקביעה על פי דין לפי סעיף 6ב לחוק הפיצויים לנפגעי תאונות דרכים, התשל"ה-1975, אולם הנכות התפקודית מסורה לשיקול דעת בית המשפט. המל"ל אכן מצא להפעיל את תקנה 15 במלואה, אך זאת לאור עבודתו של המשיב כשליח על קטנוע בעת התאונה. אולם מסלול לימודיו של המשיב באוניברסיטה מצביע על כך שלא יעבוד בעתיד בעבודת כפיים, ומאחר שלא הוכח כי הוא מוגבל בהפעלת מחשב, לא היה מקום להעמיד נכותו התפקודית לצורך חישוב הפסדי ההשתכרות בעתיד על 45%.

4.דין הערעור להידחות על שני ראשיו.

לעניין הפסד השכר בעבר: הסכום של 200,000 ₪ משקף את הפסד השתכרותו המלא של המשיב למשך שנה והפסד השתכרות חלקי למשך כשלוש שנים נוספות, על בסיס שכרו של המשיב עובר לתאונה, כך שאין כלל מקום להשגת המערערת בנקודה זו.

לעניין העמדת הפגיעה בכושר ההשתכרות על 45%: לא אכחד כי התלבטתי בעניין זה, שהרי קביעת המל"ל לגבי הפעלת תקנה 15 אינה מחייבת את בית המשפט, שהוא הפוסק האחרון לגבי נכותו התפקודית של הנפגע, ובמקרה דנן, ניתן להסביר את הפעלת תקנה 15 בכך שבעת התאונה המשיב עבד עבודה פיזית כשליח על קטנוע, ונראה כי בעתיד לא יעסוק בעבודה פיזית מעין זו. לכך יש להוסיף כי ברגיל, הנטייה היא לזהות את הנכות האורטופדית הרפואית עם הנכות התפקודית.

למרות זאת, ובסופו של יום, מצאתי כי אין מקום להתערב בקביעה זו של בית משפט קמא. קביעת הנכות התפקודית והפגיעה בכושר ההשתכרות, היא מהנושאים המובהקים הנמצאים בליבת שיקול הדעת של הערכאה הדיונית ששמעה את הצדדים והתרשמה באופן בלתי אמצעי מהנפגע (ראו, לדוגמה, ע"א 7871/10 חורי נ' כלל חברה לביטוח פסקה 8 (לא פורסם, 22.5.2011)). בית משפט קמא דחה, מחד, את טענות המשיב כי התאונה קטעה מסלול לימודי רפואה שהתעתד ללמוד בגרמניה, ומאידך, מצא כי "ההפרעה שנגרמה לתובע בידו תלווה אותו בכל מקצוע שיבחר, גם בעבודתו במקצועות המוגדרים כמקצועות של אנשים בצוארון לבן". בקביעה עובדתית זו, הנסמכת על התרשמותה של הערכאה הדיונית, איני רואה מקום להתערב.

5.אשר על כן, דין הערעור להידחות. המערערת תשא בשכר טרחת המשיב בסך 15,000 ₪.
