פסק-דין

המשנה לנשיאה א' ריבלין:

הערעורים נסבים על פסק-דין של בית המשפט המחוזי בחיפה (כבוד השופט י' גריל) בעניין שיעור הפיצויים המגיעים למשיב בע"א 9547/05 (המערער בע"א 9780/05), יליד שנת 1982, בגין הנזקים הקשים שנגרמו לו בתאונת דרכים שהתרחשה ביום 25.12.1999 (100% נכות). פסק-הדין של בית המשפט המחוזי ניתן בתאריך 23.8.2005. הדיון בבית משפט זה התקיים בתאריך 21.2.2007. לאחר מכן ביקשו הצדדים לעכב את מתן פסק-הדין לאור קיום מגעים לפשרה. ביום 17.3.2008 הודע לנו כי המגעים לא צלחו וכי אין מנוס ממתן פסק-דין.

בחנו את טענות הצדדים וראינו מקום להתייחס למספר נקודות, כמפורט להלן:

מאז שניתן פסק-הדין של בית המשפט המחוזי זרמו מים רבים וחלה התפתחות משמעותית בפסיקה הנוגעת לפיצוי עבור הפסד ההשתכרות "בשנים האבודות". אין עוד צורך לחזור על הדברים ולהרבות בהפניות – כל שנותר בהקשר זה, במקרה הנדון, הוא להתאים את הפיצוי לאמות המידה שנקבעו. כיוון שמ דובר בניזוק חסר-תלויים, יעמוד הפיצוי על 30% מבסיס השכר שנקבע (השכר הממוצע במשק), בהיוון כפול החל משנת 2010 (המועד שנקבע לתוחלת חייו של המשיב) ועד לגיל 67 שנים.

יש לבטל את הפיצוי שנפסק למשיב בגין הפסדי השתכרות בגילאים 21-18. הפסיקה שקבעה את הפיצוי ביחס לשנות השירות הצבאי (ע"א 357/80 נעים נ' ברדה, פ"ד לו(3) 762, 788) הבהירה כי אין מ דובר בפיצוי עבור הפסד השתכרות, אלא בפיצוי עבור ההפסד המתבטא בכך שהצבא לא יכסה את מחסורו של הנפגע במזון, בדיור ובביגוד. בענייננו, המשיב שוהה במוסד, והוצאותיו בגין מזון, דיור וביגוד מכוסות שם (ראו שם). על כן, אין מקום לפיצוי נוסף עבור התקופה המתייחסת לגילאים 21-18, ופסיקתו של בית המשפט המחוזי המתייחסת להפסד ההשתכרות בתקופה זו תתבטל אפוא.

בית המשפט המחוזי נמנע מלהוסיף ריבית על הפיצויים המתייחסים לנזקי העבר, בציינו כי במקביל לא תתווסף ריבית לתשלומים התכופים ולגמולי המל"ל שיופחתו מן הפיצוי. בעניין זה כבר נפסק, כי אין מקום לקיזוז כזה אלא במקום שבו מ דובר על "משחק סכום אפס" (ראו ע"א 6129/04 טרטמן נ' "הכשרת הישוב" חברה לביטוח בע"מ, תק-על 2005(4) 3640). אם לא יגיעו הצדדים להסכמה בעניין זה ולא יודיעו על דבר ההסכמה תוך 30 ימים מהיום, אזי יוחזר התיק לבית המשפט המחוזי, לצורך חישוב מרכיב הריבית כנדרש.

ביתר העניינים שהועלו לא מצאנו מקום להתערבותה של ערכאת הערעור בממצאיה של הערכאה המבררת ובשיקול דעתה.

התוצאה היא ששיעור הפיצויים יתוקן בהתאם למפורט, כאשר לגבי הריבית יוחזר התיק לבית המשפט המחוזי אלא אם יודיעו הצדדים בתוך 30 ימים כי הגיעו להסכמה בעניין זה, הכל כאמור לעיל. בנסיבות העניין ולאור התוצאה אין צו להוצאות בערכאה זו.
