נוכח האמור בהודעה המשותפת של המערער והמשיב 2 מיום 28.3.2014, ובהתחשב בעמדת הכונס הרשמי מיום 6.4.2014, נקבע כדלקמן:

א. הערעור מתקבל ויחודשו הליכי פשיטת הרגל לגבי המערער.

ב. חידוש ההליכים מותנה בכך שחוב הפיגורים של המערער בסך 57,020 ש"ח ייפרע, וזאת על דרך חילוט כספים מקופת הגמל של המערער, וכן בכפוף לכך שהמערער יגיש את הדו"חות החודשיים לתקופה שמיום 1.6.2013.

ג. המערער רשאי להגיש בקשה לאיחוד תיק פשיטת הרגל שלו עם התיק של אשתו, גב' שלומית אמסלם, וכן רשאי הוא להגיש בקשה להפטר בכפוף לתשלום סכום כולל של 350,000 ש"ח.

ד. אין צו להוצאות.
