פסק-דין

ערעור על החלטת כבוד הרשם יגאל מרזל, לפיה ההליך הנכון לתקיפת החלטה של בית המשפט המחוזי הוא בקשת רשות ערעור ולא ערעור.

החלטתו של בית המשפט המחוזי, שעליה מבקשים המערערים להשיג בפני בית משפט זה, ניתנה ביום 21.5.2006. בהחלטה קודמת, מיום 4.8.2005, הורה בית המשפט המחוזי על מינוי חוקרים, אשר יבדקו את נסיבות קריסתה של רשת קלאבמרקט ואת הפעולות שנעשו קודם לקריסה. המערערים, שזומנו להופיע בפני החוקרים, הגישו לבית המשפט בקשה למתן הוראות בשאלות שונות הקשורות בסמכויות החוקרים. בית המשפט נתן החלטתו – זו ההחלטה מיום 21.5.2006 – והמערערים חפצים להשיג עליה. כבוד הרשם קבע כאמור שהערעור על ההחלטה טעון רשות, כיוון שההחלטה היא "החלטה אחרת" (להבדיל מפסק-דין). מ דובר – כך נקבע – בהחלטה שהיא "טפלה להחלטה העיקרית על עצם מינוי החוקרים" (כאשר זו האחרונה היא החלטה חלוטה שכן לא הוגש עליה ערעור), "ומהווה היא החלטת ביניים במהותה בשל מהות הליך החקירה והעובדה כי החקירה טרם הושלמה ולא הוסקו בגינה מסקנות".

המערערים שבים וטוענים כי זכות עומדת להם לערער על החלטת בית המשפט המחוזי. מקצת מהמשיבים מסכימים עמם, אחרים – חולקים עליהם. בטרם הכרעה בערעור, ביקשתי את התייחסותם של המשיבים המתנגדים לערעור (3-1 ו- 5) לשאלה מהו לשיטתם הסיווג הנכון של ההחלטה בדבר עצם מינוי החוקרים (ההחלטה מיום 4.8.2005) – פסק-דין או החלטה אחרת. בהמשך להחלטה זו, הביעו המשיבים את עמדתם כי מ דובר בהחלטה אחרת. אפשר שעמדה זו אינה עולה בקנה אחד עם הדברים שהשמיעו קודם לכן, אך מכל מקום, לגופו של עניין, נראה כי לפי מבחן הסופיות המקובל בכגון דא, אין לראות בהחלטה מיום 4.8.2005 כפסק-דין. משמעות הדבר היא שלא היה מקום לקבוע – כפי שקבע כבוד הרשם – שההחלטה מיום 4.8.2005 הפכה חלוטה משלא הוגש עליה ערעור (ראו תקנה 411 לתקנות סדר הדין האזרחי, התשמ"ד-1984). גם לא היה מקום לבסס את ההכרעה בשאלת סיווגה הנכון של ההחלטה מיום 21.5.2006 לפי המבחן אם החלטה זו "טפלה" להחלטה העיקרית בדבר מינוי החוקרים (מבחן המשמש ברגיל בכל הנוגע להחלטות הניתנות לאחר פסק-דין סופי – ראו ע"א 2817/91 מימון נ' שאולי, פ"ד מז(1) 152 (1993); יואל זוסמן סדר הדין האזרחי 767 (מהדורה ז, שלמה לוין עורך, 1995)). המבחן הרלבנטי, אפוא, ביחס להחלטה מיום 21.5.2006, הוא מבחן הסופיות, ובהקשר זה מקובלת עלי קביעתו של כבוד הרשם כי ההחלטה אינה סופית והיא נושאת מאפיינים של החלטת ביניים. לפיכך, אין להתערב בקביעתו של כבוד הרשם כי הערעור על ההחלטה טעון רשות.

אעיר, כי כשלעצמי אני סבור שלגבי החלטות הניתנות לאחר פסק-דין סופי, מן הראוי לנקוט מדיניות ליברלית יחסית הן בסיווגן כהחלטות שיש לגביהן זכות ערעור, הן במתן רשות ערעור כשקיים צורך בכך. טעם הדבר: בניגוד להחלטות ביניים, שלגביהן תמיד קיימת האפשרות לערער בזכות במסגרת הערעור על פסק-הדין הסופי, הרי שלגבי החלטות הניתנות לאחר פסק-הדין הסופי האפשרות הזו אינה בהכרח קיימת. מכל מקום, בענייננו סיווגנו כאמור את ההחלטות כולן כהחלטות שאינן סופיות.

לכן, הערעור נדחה. עם זאת, בנסיבות העניין, ומשום שלגוף העניין יש לכאורה עילה ליתן רשות ערעור בתיק זה, לא ראיתי לנכון לעשות צו להוצאות.
