בפני ערעור על החלטתה של כבוד הרשמת בבית משפט זה, ש' ליבוביץ', בה פטרה את המערער מתשלום אגרת בית משפט, אך לאור סיכוי ההליך הקלושים – כך להערכתה – ובהתחשב בהוצאות שהושתו עליו בבית המשפט המחוזי, העמידה את העירבון על סכום של 10,000 ש"ח.

לאחר שעיינתי בטענות הצדדים הגעתי לכלל מסקנה כי דין הערעור להדחות. בכדי להיות זכאי לפטור מהפקדת עירבון, לא די בכך שהמערער מצוי במצוקה כלכלית – ועל כך אין חולק. על בית המשפט להשתכנע גם כי סיכויי ההליך אינם מזעריים: "אם סיכויי ההצלחה של המבקש דחוקים או קלושים הבקשה לא תיענה בחיוב. אם הסיכוי הוא ממשי תישקל העתירה בחיוב" (בש"א 329/90 אברך נ' גרוגר, פ"ד מד(2) 383, 389). במקרה זה מ דובר – כפי שציינה כבוד הרשמת – בבקשת רשות ערעור ב"גלגול שלישי", כאשר הערעור בבית המשפט המחוזי נדחה כיוון שהוא הופנה כנגד קביעות עובדתיות וממצאי מהימנות של הערכאה המבררת. סיכויי בקשת רשות הערעור בנסיבות אלה לא הצדיקו, לדעת כבוד הרשמת, פטור מלא מעירבון, ובשקול שעתה בעניין זה אין מקום להתערבותנו. לכן הערעור נדחה. אין צו להוצאות.
