ערעור על החלטתו של בית משפט השלום בכפר-סבא מיום 9.1.2014 בת"פ 60254-12-12, שניתנה על ידי כבוד השופט מ' קרשן

פסק-דין

1.לפניי ערעור על החלטת בית משפט השלום בכפר סבא (כבוד השופט מ' קרשן) מיום 9.1.2014, שלא לפסול עצמו מלדון בת"פ 60254-12-12.

2.נגד המערער הוגש כתב אישום המייחס לו עבירות שונות, ביניהן איומים לפי סעיף 192 לחוק העונשין, התשל"ז-1977, תקיפת עובד ציבור לפי סעיף 382א(א) לחוק העונשין, ושימוש בכוח או באיומים למנוע מעצר לפי סעיף 47(א) לפקודת סדר הדין הפלילי (מעצר וחיפוש) [נוסח חדש], התשכ"ט-1969. ביום 9.1.2014 ביקש המערער מבית משפט השלום לפסול עצמו מלדון בעניינו, וכן כי פרקליטו ישוחרר מן הייצוג. בערעור לא מצוין מה היה הנימוק לבקשת הפסלות. באותו היום דחה בית המשפט את בקשת הפסלות בציינו כי לא הובא כל נימוק שיצדיק פסלות. על החלטה זו הוגש הערעור דנא. בכתב הערעור טוען המערער כי יש לפסול את בית המשפט משום שלא הוקצה מספיק זמן לטיפול בעניינו, ומשום שלא ניתנה לו "זכות דיבור" בדיון שהתקיים ביום 8.1.2013. יצוין, כי כתב הערעור משתרע על פני עמוד אחד, כאשר מחציתו מחזיקה את החלטת בית המשפט לדחות את בקשת הפסלות.

3.אין בערעור ממש. ראשית, המערער לא הראה כי הדיון היה קצר מן הנדרש, וכי הוא לא נשמע. שנית, אף אם נערך דיון קצר ואף אם המערער לא נשמע אלא רק פרקליטו, אין באלה בהכרח משום פגם כלשהו, שכן הדבר תלוי נסיבות. שלישית, גם אם נפל פגם כלשהו בהליך, וכאמור לא הובא לכך כל ביסוס, אין בכך כדי להקים עילת פסלות.

4.לפיכך, הערעור נדחה מבלי שהמשיבה נדרשה להשיב.
