השופט א' א' לוי:

1.נגד המערערים, בנו ואחיו של אחד - סעד קהמוז (להלן: סעד), הוגש כתב אישום בו נטען כי השלושה עסקו בייבוא של סמים מסוכנים מלבנון לישראל. הדמות המובילה בפרשה הוא סעד, שבחודש אפריל 2001 יצר קשר עם תושב לבנון בשם רמזי נהאר (להלן: רמזי), ובעקבות כך הוקמה רשת ששמה לה למטרה לייבא את הסם ולהפיצו בקרב הצרכנים בישראל. המערערים (להלן: יוסף ואחמד), היו פעילים מרכזיים באותה רשת שעליה נמנו גם אחרים, וביניהם צ'רלי פרץ. השניים נשלחו על ידי סעד למפגשים עם רמזי, ובחודש ספטמבר 2001 הם ייבאו כ- 30 ק"ג של חשיש לישראל, שלאחר מעשה התברר כי הוא באיכות ירודה. על פי גרסת המשיבה, עד למעצרם בחודש ינואר 2003 היו המערערים מעורבים בעשרות רבות של מקרים בהם ייובאו לישראל סמים כמויות אדירות - 4 עד 5 טון של חשיש. כן נטען, כי סעד הסתנן ללבנון מספר פעמים וביקר את רמזי בביתו. מפיו של זה האחרון נודע לסעד כי בן שיחו משתף פעולה עם ארגון חיזבאללה, ובהמשך נתבקש סעד להעביר ללבנון ספרים, עיתונים, אטלס, משקפת לראיית לילה, תרגומונים, שנתון סטטיסטי של מדינת ישראל, וצילומים של אזורים שונים ובכללם בסיסים צבאיים ומרכזי קניות. בשובו לישראל סיפר סעד למערערים על קשריו של רמזי עם ארגון החיזבאללה, ובהמשך העביר יוסף לרמזי חלק מאותם פריטים שביקש לקבל. בכתב האישום נטען עוד, כי בתחילת שנת 2002 החל אחד – מוחמד פתאלי, לעסוק גם הוא בייבוא סמים, תוך שסעד והמערערים מסייעים בידו. ועוד נטען, כי במועד כלשהו פנה צ'רלי לסעד וביקשו להשיג לו אקדחים עם משתיק קול שייובאו מלבנון. לאחר זמן העביר רמזי באמצעות המערערים שני אקדחים אשר היו מיושנים. אקדחים אלה הוחזרו לרמזי, ובהמשך הוא העביר לישראל שני אקדחים אחרים שעל אחד מהם היה מותקן משתיק קול.

2.המערערים הודו בעובדות אשר יוחסו להם, ובעקבות כך הורשעו בעבירות של יבוא, החזקה וסחר בסם מסוכן, עבירות בנשק, קשירת קשר לבצע פשע והסתייעות ברכב לפשע. יוסף קהמוז הורשע גם בעבירה של מסירת ידיעה העלולה להיות לתועלת האויב, לפי סעיף 111 לחוק העונשין. המערערים הוסיפו והודו בעובדותיו של כתב אישום נוסף שהוגש נגדם, ובו נטען כי מששוחררו ממעצר הם זומנו להעיד במשפטו של מי שנטען כי סייע בידם בביצוען של עבירות הסמים – שלמה מוזס – אולם עקבותיהם נעלמו במשך מספר חודשים, עד שנעצרו בחודש יולי 2006. בפרשה זו יוחסו למערערים עבירות של שיבוש מהלכי משפט והפרת הוראה חוקית. אחמד קהמוז הוסיף והודה בכתב אישום שלישי שהוגש נגדו, ובו נטען, כי בתאריך 23.12.07, הוא נהג ברכב ועמו היה סכום של 50 אלף דולר, אשר הגיע לידיו כתוצאה מעסקת סמים בה היה מעורב. משהבחין במחסום משטרתי הניצב בדרכו, הוא ביצע פניית פרסה והחל להימלט. בעקבות כך החלו שוטרים לדלוק אחריו, ובמהלך מרדף זה נהג אחמד בצורה פרועה, תוך שהוא מסכן את חייהם של אלה שנקלעו לדרכו, עד שבשלב מסוים אף פגע בניידת משטרה. בפרשה זו הורשע אחמד בשורה של עבירות נוספות, וביניהן, חבלה בכוונה מחמירה, סיכון חיי אדם בנתיב תחבורה, מעשה פזיזות ורשלנות, השמדת ראייה ושיבוש מהלכי משפט, וכן עבירות תעבורה שונות.

לאחר שלבית המשפט הוגשו תסקירים שהכין שירות מבחן והצדדים טענו לעונש, נדון יוסף ל-12 שנות מאסר בעוד שאחמד נדון ל-11 שנות מאסר. כמו כן, נדונו המערערים למאסר על-תנאי, קנס בסך 100 אלף ש"ח או 12 חודשי מאסר תמורתו, והם נפסלו מלהחזיק ברישיון נהיגה במשך 5 שנים.

3.הערעור שבפנינו מופנה כנגד תקופות המאסר והקנס שהושתו על המערערים. נטען, כי הדמות המרכזית בפרשה היתה זו של סעד, והמערערים חשו חובה לסייע בידו עקב קשרי המשפחה שביניהם. להשקפת בא-כוח המערערים, לא נתן בית המשפט המחוזי משקל הולם לאותם יחסי מרות - סמכות מיוחדים, כמו גם לעובדה שעל הרשת נמנו חברים אחרים שהעונש אשר הושת עליהם נופל במידה ניכרת מהעונשים שנגזרו למערערים.

4.לא ראינו מקום להיעתר לערעור. המערערים נמנו על הגרעין שהגה וביצע ייבוא של סם מסוכן בכמויות אדירות מלבנון לישראל. אכן, סעד עמד בראש הרשת, והיה הדמות המובילה, אולם המערערים היו אנשי אמונו וככאלה נטלו חלק פעיל ומרכזי בביצוען של העבירות, כאשר הם מבצעים משימות "עדינות" כמו המפגשים עם רמזי, העברת הכסף לידיו וקבלת הסם. בנסיבות אלו לא גילינו בעונש שהושת עליהם פן כלשהו של חומרה. אדרבא, המערערים נמנים על אלה המזינים את שוק הסמים בישראל, ובכך הם תרמו עד למעצרם תרומה מכרעת להפצתו של נגע זה ולהשלכות ההרסניות הכרוכות בו. המערערים עשו זאת מדעת ומרצון, וככל הנראה משום הרווח הקל הצפוי להם. על כך היה צריך להגיב במאסר ממושך ופגיעה בכיסם של העבריינים. כך נהג בית המשפט המחוזי, ועל כן דינו של הערעור להדחות, וכך אנו עושים.
