השופט ס' ג'ובראן:

עניינה של העתירה שבפנינו בבקשת העותר, כי נורה למשיבים ליתן טעם מדוע לא יבוטלו או יוכרזו כבטלות תקנה 2(א) ותקנה 6 לתקנות התכנון והבניה (סדרי דין בבקשה לפי סעיף 207 לחוק), התשס"ט-2008 (להלן: תקנות התכנון והבניה), בהיותן מנוגדות להוראות חוק שונות. במסגרת העתירה מבקש העותר צו ביניים, לפיו יימנעו המשיבים מיישומן של התקנות האמורות.

לטענת העותר, שהינו עורך דין במקצועו, תקנות התכנון והבניה עומדות בסתירה להוראת סעיף 207 לחוק התכנון והבניה, התשכ"ה-1965 (להלן: חוק התכנון והבניה) אשר לשונו כדלקמן:

"בית המשפט רשאי, בזמן מתן צו לפי סעיפים 205 או 206 ובכל עת לאחר מכן, לקבוע את המועד לביצועו, ורשאי הוא להאריך מועד שקבע, אם ראה טעם לעשות כן."

תקנה 2(א) לתקנות התכנון והבניה, לעומת זאת, קובעת כי בקשה לפי סעיף 207 לחוק התכנון והבניה תוגש לא יאוחר מעשרים ואחד ימים עובר לביצועו של צו הריסה שניתן על ידי בית המשפט; ואילו תקנה 6 לאותן תקנות קובעת כי בית המשפט לא ידון בבקשה שלא מתקיימים בה כל התנאים המנויים בתקנות, אלא מנימוקים מיוחדים שיירשמו. יוצא אפוא, לטענת העותר, כי אדם אשר מגיש בקשה לפי סעיף 207 להארכת מועד ביצוע צו הריסה פחות מעשרים ואחד ימים לפני מועד ביצועו, לא יוכל לקבל סעד כמבוקש מבית המשפט. העותר גורס כי בכך סותרות התקנות לעיל את האמור בסעיף 207 לחוק התכנון והבניה, ועל כן הן בטלות מעיקרן ואינן סבירות. עוד מוסיף העותר כי התקנות פוגעות הן בזכות הגישה לערכאות והן בזכותו של אדם לקניין, אך אין הן עומדות בתנאי פסקת ההגבלה המצויה בסעיף 8 לחוק יסוד: כבוד האדם וחירותו, ומשכך דינן להתבטל גם כן.

לאחר עיון בעתירה ובתגובת המשיבים, הגענו למסקנה כי דין העתירה להידחות על הסף, זאת בשל היותה מוקדמת ולוקה באי מיצוי הליכים. טרם יפנה העותר לבית משפט זה בשבתו כבית משפט גבוה לצדק, עליו לפנות לרשויות האמונות על קביעתן וביצוען של התקנות עליהן הוא מלין, כפי שנקבע לא פעם בעבר:

"עקרון מושרש ומקובל הוא מלפנינו כי פניה לרשות המינהלית או הציבורית הנוגעת לעניין הינה בבחינת תנאי סף על מנת שבית משפט זה ייזקק לעתירה נגדה. משלא נעשתה פניה כאמור... הרי שדין העתירה להידחות על הסף מחמת אי מיצוי הליכים." (בג"צ 10312/05 כהן נ' בן שלמה (לא פורסם, 6.11.2005); בג"צ 549/83 הופר נ' חברי ועדת המינויים, פ"ד לז(4) 24, 26 (1983); בג"צ 2624/97 ידיד נ' ממשלת ישראל, פ"ד נא(3) 21, 82-83 (1997)).

עילת סף זו שרירה וקיימת גם כשהמדובר בעתירות הנוגעות לביטול חוקים ותקנות (בג"צ 3481/02 קריב נ' מדינת ישראל, פ"ד נו(6) 869, 873 (2002)). במקרה שלפנינו, העתירה אילמת ככל שהדבר נוגע לפניות שנעשו למשיבים טרם הגשתה לפתחנו, ובתגובת המשיבים אכן נטען כי לא הופנתה אליהן פנייה מקדימה בנושא.

אשר על כן, דין העתירה להידחות על הסף.
