עניינה של העתירה דכאן באחוזי נכות שנקבעו לעותר בגין תאונות עבודה במסגרת עבודתו כמורה לחינוך גופני במשרד החינוך.

1.בעתירה נטען כי בשנת 1960 נפגע העותר בתאונת דרכים בדרכו חזרה מעבודתו (להלן: התאונה הראשונה). התאונה לא הוכרה כתאונת עבודה על ידי הביטוח הלאומי, ואף לא נקבעו לעותר אחוזי נכות בגינה. רק כעבור כ-35 שנים, בשנת 1995, החל העותר בהליכים משפטיים נגד משרד החינוך והמל"ל. כפי שעולה מהעתירה, תביעתו של העותר להכרה בנכותו נדחתה על ידי המל"ל מחמת התיישנות, ערעור שהוגש לבית הדין האזורי לעבודה נדחה, אולם בית הדין הארצי קיבל את ערעורו של העותר והורה למל"ל להכיר בתאונה כתאונת עבודה (אציין כי ההחלטה לא צורפה לעתירה והאמור לעיל נסמך על האמור בעתירה).

2.בשנת 1978 נפגע העותר באצבעו במהלך שיעור חינוך גופני (להלן: התאונה השניה). לטענתו של העותר הוא טופל בהקרנות רנטגן ב קופת חולים כללית ומאז ועד היום הוא סובל מכאבים וקשיי תפקוד ביד.

העותר הגיש תביעה למל"ל לתשלומי נכות בגין התאונה השניה, אולם נקבע כי הוא לא עומד בקריטריונים לקבלת דמי פגיעה. ביום 12.9.06 ניתן בבית הדין לעבודה תוקף של פסק דין להסכמת המל"ל להשיב את ענייננו של העותר לועדה הרפואית, אשר תדון בטענותיו לגבי אחוזי הנכות, במיוחד על רקע הטענה כי נפגע כתוצאה מטיפולי ההקרנות (החלטת בית הדין הארצי לעבודה מיום 8.4.08 בעב"ל 250/06). ואכן, ביום 29.4.08 הובא ענייננו של העותר בפני הועדה ונקבעו לו 21% נכות בגין מגבלות שונות בתפקוד כף היד.

3.ביני לביני הגיש העותר שש תביעות מאוחדות לבית הדין האזורי לעבודה כנגד מל"ל ו קופת חולים כללית, בין היתר כמפורט להלן: תביעת פיצויים בגין הנזק שאירע לו בתאונה הראשונה והכרה בה כתאונת עבודה; תביעה נגד קופת החולים בגין טיפול רשלני; תביעה נוספת נגד המל"ל להכיר בנכות שנגרמה כתוצאה מההקרנות שעבר; בקשה להתיר את זיהוי רופאי הועדה הרפואית כדי שיוכל לתבוע אותם אישית; תביעה כספית בגין "רשלנות הונאה ומרמה של הביטוח הלאומי" בשל כך שלא הכיר בתאונה הראשונה כתאונת עבודה. בית הדין האזורי לעבודה בתל אביב-יפו מחק על הסף את כל התביעות בנימוקים של היעדר סמכות, מעשה בית דין, התיישנות ואי מיצוי הליכים. ערעור שהוגש לבית הדין הארצי לעבודה נדחה גם הוא, מלבד עניין אחד בנוגע להיוון קצבה, בו הוחלט כי הנושא יוחזר לבית הדין האזורי לצורך המשך הליכים וקיום דיון הוכחות (עב"ל 468/09).

4.ככל שניתן לרדת לסוף דעתו של העותר, שאיננו מיוצג, העתירה דכאן נסבה על אחוזי הנכות שנקבעו לו בגין הנכות ביד. לעותר נקבעו כאמור 21% נכות, אולם נטען לנכות נוספת כתוצאה מטיפולי ההקרנות שעבר. עוד נטען כי הועדה תיאמה את אחוזי הנכות בהתאם לקצבת הזקנה המגיעה לו ממילא, ואין בכך כדי לשקף את נכותו האמיתית. בנוסף מופנית העתירה נגד משרד החינוך לבוא ולהכיר בנכותו של העותר שנגרמה כתוצאה מתאונות עבודה, וכן נגד קופת חולים לפצותו בגין הנזקים שנגרמו לו כתוצאה מרשלנותה בטיפול בו לאחר שתי התאונות שעבר.

5.דינה של העתירה להידחות על הסף. ככל שהעתירה מופנית נגד החלטת הועדה הרפואית או קופת חולים, הרי שאין בית משפט זה יושב כערכאת ערעור על עניינים מעין אלה. מה עוד, שנראה כי העילות העומדות בבסיסה של העתירה הנוכחית שימשו את העותר גם בתביעות שהגיש לבית הדין האזורי לעבודה, תביעות שנדחו על הסף. כך, התביעה נגד קופת החולים נדחתה על הסף בשל חוסר סמכות עניינית של בית הדין לעבודה לדון בתביעה מעין זו (ב"ל 6283/08), ותביעה שהגיש העותר נגד הועדה הרפואית בגין אחוזי נכותו נדחתה בבית הדין האזורי לעבודה לגופה. לאחר זמן הגיש העותר תביעה נוספת שנדחתה גם היא, הפעם בנימוק של מעשה בית דין והתיישנות (ב"ל 6026/08), ופסק הדין אושר בבית הדין הארצי לעבודה (החלטה מיום 13.5.10).

יפים לענייננו דברים שנאמרו בבג"ץ 9624/10 יסחקוב נ' בית הדין הארצי לעבודה בירושלים (לא פורסם, 11.1.2011):

"עניינו של העותר נדון בפני לא פחות משלוש ערכאות שיפוטיות ומעין-שיפוטיות שונות (לעניין היותה של הוועדה הרפואית לעררים גוף מעין-שיפוטי ראו, בג"ץ 1082/02 המוסד לביטוח לאומי נ' בית הדין הארצי לעבודה, פ"ד נז (4) 443 (2003); בג"ץ 570/09 וינאפל נ' שר האוצר (לא פורסם, 18.11.09)). כלל ידוע הוא כי בית משפט זה אינו פועל בגדר ערכאת ערעור על בית הדין הארצי לעבודה, ולא ימהר להתערב בנושאים שנדונו בפניו אשר נמצאים בתחום סמכותו הייחודית. בית משפט זה יתערב בפסיקתו של בית הדין הארצי רק כאשר נתגלתה טעות משפטית מהותית, ויחד עם זאת הצדק מחייב התערבות (בג"ץ 525/84 חטיב נ' בית הדין הארצי לעבודה, פ"ד מ(1) 673, 693 (1986))".

6.מעבר לנדרש, וככל שירדתי לסוף דעתו של העותר, נראה כי גם לגופו של עניין אין לעתירה על מה לסמוך. טענותיו של העותר נדונו בערכאות השונות, וככל שהעותר סבור כי נשתנו הנסיבות או שקיימת עילת תביעה חדשה שלא נדונה עד כה, ייכבד ויפנה לערכאות המוסמכות.

7.בשולי הדברים אציין כי דומה שהעותר, שאינו מיוצג, מעסיק את בתי המשפט תדיר בתביעות שנראה כי אין להן על מה לסמוך. אין לי אלא לחזור על המלצתו של בית הדין הארצי לעבודה כי טוב יעשה העותר אם יפנה לקבלת ייעוץ משפטי טרם ינקוט בהליכים משפטיים.

סופו של דבר שאנו דוחים את העתירה על הסף.
