המשנה לנשיאה א' ריבלין:

1.העותר מבקש להורות על פרסום המיקום המלא והמדוייק של מקורות הקרינה של רשת ה- DTT, לאמור, של משדרי ה- DTT – העושים שימוש בטכנולוגיה דיגיטלית להפצת שידורי הטלביזיה של הערוצים הפתוחים לציבור.

מערך ה- DTT מאפשר כיום צפייה בחמישה ערוצי הטלביזיה ללא תשלום.

העותר סומך בבקשתו על הוראת סעיף 19 לחוק הקרינה הבלתי מייננת, התשס"ט-2009 (להלן: חוק הקרינה המייננת) ולתקנות שהותקנו על-פיו. הוא סבור כי מכוחם יש לפרסם את מיקומם המדוייק של המשדרים באתר האינטרנט של המשרד להגנת הסביבה.

2.הפרסום נאסר תחילה בהוראת הצנזורית הראשית, מכוח סמכותה לפי תקנה 87(1) לתקנות ההגנה (שעת חרום), 1945, והעתירה במקורה כוונה כנגד הוראה זו. בינתיים, נערכה חוות-דעת של מפקד פיקוד העורף והיא הומצאה ל"ממונה", כמשמעו בחוק הקרינה הבלתי מייננת. חוות-הדעת קובעת כי מתקיים חשש ממשי לפגיעה קשה בביטחון המדינה ובשלום הציבור אם יפורסם המידע המבוקש על-ידי העותר בעתירה. האלוף מציין כי בשעת חירום מתמקדת ההסברה של פיקוד העורף באמצעי התקשורת ההמוניים, וכי הטלביזיה היא כלי מרכזי מבין האמצעים האלה לצורך העברת הנחיות לציבור. עוד הוא מבהיר כי מערך ה- DTT משמש היום אוכלוסיה ניכרת של מאות אלפי אנשים ואוכלוסיה זו צפויה לגדול בעתיד. במקרה של פגיעה עויינת באחד המשדרים תופסק קליטת השידורים באזור המכוסה על-ידי אותו משדר. פגיעה ביותר ממשדר אחד תביא כמובן להפרעה קשה יותר בשידור. מפקד פיקוד העורף קובע כי קיים חשש אמיתי וממשי כי יעדי תקשורת המוניים יהוו יעד לתקיפה על-ידי האוייב וכי יתכן שהם יותקפו בעת מלחמה אם יפורסם מיקומם המדוייק.

3.אכן, כפי שמאשרת המדינה עצמה, קיים אינטרס ציבורי בפרסום מידע אודות מקורות הקרינה הבלתי מייננת בישראל לציבור הרחב. המדינה סבורה כי עיקר תכליותיה של ההוראה המחייבת פרסום מידע בעניין זה תושגנה באמצעות הדרישות לקבלת היתרים ופיקוח על מקורות הקרינה. מכל מקום, החוק עצמו, בסעיף 19 לחוק הקרינה המייננת, כופף את חובת הפרסום להוראות סעיף 9 לחוק חופש המידע, התשנ"ח-1998 (להלן: חוק חופש המידע); הוראת סעיף 9(א)(1) לחוק זה קובעת כי "רשות ציבורית לא תמסור מידע ... אשר בגילויו יש חשש לפגיעה בבטחון המדינה, ביחסי החוץ שלה, בבטחון הציבור או בבטחונו או בשלומו של אדם". "הממונה" – כמשמעותו בחוק הקרינה הבלתי מייננת אינו רשאי, איפוא, לפרסם מידע אשר יש חשש שפרסומו יביא לפגיעה בבטחון המדינה או בבטחון הציבור. סעיף 31 לחוק מסייג את עצם תחולתו בכל הקשור לפעילות בטחונית או מבצעית של גופים מסויימים.

4.המבחן ההסתברותי שקבע המחוקק בסעיף 9(א)(1) לחוק חופש המידע הוא מבחן החשש – שבהתקיימו חל איסור לגלות מידע שעלול לפגוע בבטחון המדינה או בבטחון הציבור. אכן, אין זה מבחן העולה לכלל "ודאות קרובה" דוגמת זה המשמש כסייג לפגיעה בחופש הביטוי מכוח צנזורה (בג"ץ 680/88 שניצר נ' הצנזור הצבאי הראשי, פ"ד מב(4) 617 (1989)), אולם אין זה גם מבחן המסתפק באפשרות כלשהי, ולו גם רחוקה, לפגיעה כאמור. בפועל, מדובר במבחן הנדרש לתוחלת הפגיעה בבטחון הציבור או בשלומו. מכפלת עוצמת הסיכון בהסתברותו מצביעה על תוחלת הסיכון לשלום הציבור או לבטחונו (השוו: בג"ץ 258/07 גלאון נ' ועדת הבדיקה הממשלתית לבדיקת אירועי המערכה בלבנון 2006 (לא פורסם) 2007, מפי הנשיאה ד' ביניש). ובענייננו, כפי שמציינת המדינה בצדק, פרסום מיקומם המדוייק של משדרי ה- DTT הינו צעד בלתי הפיך ההופך אותם לפגיעים לנשק מדוייק של האוייב. במקרה זה ההסתברות לפגיעה היא ממשית – אף כי לא קרובה לוודאי – ועוצמת הנזק חמורה.

5.זאת ועוד זאת: משדרי ה- DTT אינם מוסתרים מעיני הציבור המצוי בקרבתם. הם מותקנים בגובה ממוצע של כ- 50 מטרים ואינם מוסתרים בבתים או בדירות. יתרה מכך, הממונה נוהג למסור לכל פונה יחיד המבקש מידע אודות מקור קרינה פרטני המתייחס למשדרי DTT המצויים בסביבת מגוריו. המידע מתייחס לקרינה היוצאת מן המשדר ולטווחי הביטחון הנדרשים ממנו.

בנסיבות אלה, אין מקום להיעתר לעתירה. הסירוב לפרסם ברבים את נקודות הציון בהן מצויים המשדרים – מתבקש כמעט מאליו. לעתירה לפיכך לא היה מקום והיא נדחית.

העותר ישא בהוצאות המשיבים בסכום כולל של 10,000 ש"ח שיתחלק בחלקים שווים.
