1.עניינה של העתירה שלפנינו בבקשת העותר, כי נורה למשיב ליתן טעם לשינויים המהותיים שערך בתכנית הלימודים בהיסטוריה בחינוך הממלכתי דתי אשר נכנסה לתוקף בשנת הלימודים תשע"ג.

2.העותר – שהעיד על עצמו כמי שעוסק בהוראת מקצוע ההיסטוריה ואף נמנה על מחברי ספרי היסטוריה אשר נלמדים בבתי הספר בחינוך הממלכתי-דתי – גורס כי השינויים שהתבצעו בתוכנית הלימודים בחינוך הממלכתי-דתי נטולי הגיון, ובמתכונתם הנוכחית יש בהם כדי לפגוע פגיעה ממשית בסדר הכרונולוגי וברצף הסדיר של תוכנית הלימודים. בעתירתו מפרט העותר את השיבושים אשר חלו לשיטתו בתוכנית הלימודים, וביניהם - נושאים מהותיים הנעדרים מן התוכנית, פרקים מרכזיים המוצבים שלא במקומם ובמנותק מהקשרם ההיסטורי, הכבדה ממשית בהיקף החומר הנדרש בחלק מיחידות הלימוד ללא שינוי הולם במכסת שעות הלימוד, וכן שיבושים נוספים. לטענת העותר, בכל אלה, יש כדי לגרום לפגיעה ממשית בתלמידים הנמנים על החינוך הממלכתי הדתי.

בנוסף לכך קובל העותר על אפליה ואי שוויון המתקיימים בין החינוך הממלכתי-כללי לחינוך הממלכתי-דתי. כך, ציין העותר הבדל משמעותי בכמות החומר הנלמד, המתבטא בכך שפרקים מסוימים הנכללים בתוכנית בחינוך הממלכתי-דתי אינם נכללים בתוכנית בחינוך הממלכתי-כללי. לטענת העותר, הפרקים הנוספים משיתים עומס חריג ולא שוויוני על תלמידי החינוך הממלכתי-דתי, ופוגעים בסיכויי הצלחתם ביחס לתלמידי החינוך הממלכתי.

3.המשיב טוען כי דין העתירה להידחות הן על הסף והן לגופה של עתירה. כבסיס לדחייה על הסף ציין המשיב את הלשון הבוטה בה נקט העותר במכתביו לרשויות השונות. לגופו של עניין, נטען כי העותר לא הציג כל עילה משפטית או הוראת דין המצדיקה התערבות של בית המשפט בתכנית הלימודים. המשיב הצביע על כך שהעותר הציג נתונים עובדתיים לא מדויקים, ולדוגמה, מהתוכנית שפורסמה עולה רצף כרונולוגי בנושאים הנלמדים, בניגוד לטענת העותר. עוד נטען כי תוכנית הלימודים גובשה ונבחנה בידי גורמי מקצוע בעלי מומחיות מובהקת הן בתחום ההיסטורי והן בתחום הפדגוגי, בוועדה בראשותו של פרופ' שאול שטמפפר מהמחלקה להיסטוריה באוניברסיטה העברית. לאחר גיבוש התוכנית אושרה התוכנית גם על ידי ועדת המקצוע להיסטוריה בחינוך הממלכתי-דתי בראשות פרופ' דן מכמן מהמחלקה לתולדות עם ישראל באוניברסיטת בר אילן, ואשר מונתה על ידי יו"ר המועצה הפדגוגית של משרד החינוך.

4.דין העתירה להידחות.

במוקד העתירה שלפנינו עומדת כאמור תוכנית הלימודים החדשה לחינוך הממלכתי-דתי אותה אישר משרד החינוך. ברגיל, קביעת תוכנית לימודים במקצוע זה או אחר, היא סוגיה בעלת גוון מקצועי מובהק, וכפי שעולה מתשובת המשיב, התוכנית גובשה על ידי אנשי מקצוע בתחום ההיסטוריה ובתחום הפדגוגיה. ככלל, לא יתערב בית משפט זה בעניינים בהם התקבלה החלטה על ידי גוף מקצועי ובהתבסס על שיקולים מקצועיים. על מנת שבית המשפט ייאות לעשות כן, על העותר להצביע על עילת התערבות מתאימה, כגון חריגה ברורה וקיצונית של ההחלטה ממתחם הסבירות (ראו למשל: בג"ץ 3930/94 ג'זמאוי נ' שר הבריאות, פ"ד מח(4) 778, 786-785 (1994); בג"ץ 624/06 רון-גל הסעות בע"מ נ' שר החינוך (30.1.2007)). בעניין זה, לא עלה ביד העותר לעשות כן.

5.העותר טען כי תכנית הלימודים החדשה מפלה את תלמידי מערכת החינוך הממלכתי-דתי מאחר שהיא כוללת נושאים אשר אינם נמצאים בתוכנית הלימודים המקבילה של תלמידי מערכת החינוך הממלכתי-כללי.

הזרם הממלכתי והממלכתי-דתי הם שני זרמי חינוך נפרדים, כך שאין בהכרח חפיפה מלאה בתוכניות הלימודים, ובהתאם לתוכניות השונות נבחנים התלמידים גם בבחינות בגרות אשר מותאמות לתוכנית הלימודים. אשר על כן, על מנת להוכיח את טענת האפליה האמורה לא סגי בעצם קיומם של הבדלים בתכנים הנלמדים, ולא עלה בידי העותר להראות מדוע ההבדלים בתכני הלימוד, מהווים הבחנה לא מוצדקת אשר פוגעת בתלמידי הזרם הממלכתי-דתי.

6.לא למותר לציין כי בעבר כבר העלה העותר בפני בית משפט זה טענת אפליה (בג"ץ 5920/06 חדד נ' משרד החינוך והתרבות (30.6.2009)). במסגרת אותה עתירה, הלין העותר על כך ש הזמן המוקצב לפתרון השאלון בבחינת הבגרות במגזר הכללי הינו 120 דקות, ואילו הזמן המוקצב לשם כך במגזר הממלכתי דתי הוא 90 דקות בלבד. העתירה נדחתה ונקבע לגבי הכרעות מקצועיות מעין אלו כי "עניין זה מסור לשיקול דעתם של הגורמים המקצועיים במשרד החינוך, ולא לנו להחליף את שיקול דעתם בשלנו". לגבי טענת האפליה ציין בית המשפט כי "העותר לא הראה מדוע הפרש זה מהווה הפלייה פסולה ולא אך הבחנה מוצדקת", והדברים יפים אף לענייננו.

בהקשר זה אציין כי לא מצאתי ממש בטענת העותר בדבר הקושי בבחינות הבגרות הנגזר מן ההכבדה בדרישות התוכנית. מכל מקום, חזקה על המשיב כי ידע לשקלל את ההבדלים הנטענים בכמות הנושאים הנכללים בתוכניות השונות, כך שיבואו לידי ביטוי גם בהיקף הבחינות וברמת הקושי שלהן.

7.בשולי הדברים אציין כי מהמכתבים שצירף העותר לעתירתו, ואותם הפנה לגורמים שונים, עולה כי העותר נוקט לשון בוטה ומשתלחת, שהיה בה כדי להצדיק דחיית העתירה על הסף. כך, לדוגמה, מכתבו של העותר ליועץ המשפטי לממשלה נושא את הכותרת "משרד החינוך הוא משרד של עבריינים ומטומטמים", ביטוי עליו חזר העותר במכתבו למפקחת הארצית בחינוך הממלכתי-דתי.

8.לנוכח האמור לעיל, אנו דוחים את העתירה. העותר ישא בהוצאות המשיבים בסך 3,000 ₪.
