זוהי עתירה למתן צו על-תנאי שיורה למשיב ליתן טעם מדוע לא יקדים את מועד הבחירות בעיר טייבה, שנקבעו ליום 20.10.2015 ולחלופין מדוע לא יעביר את יושב ראש הוועדה הממונה בטייבה (להלן: יו"ר הוועדה) מתפקידו.

1.בשנת 2007 החליט המשיב לפזר את מועצת העיר טייבה, להדיח את ראש העירייה ולמנות ועדה ממונה לניהול העיר, נוכח הגירעון הכבד שאליו נקלעה עיריית טייבה (להלן: העירייה). ביום 1.5.2013 החליט המשיב כי הוועדה הממונה תמשיך למלא את תפקידה בניהול העיר וכי הבחירות לעיריית טייבה לא יתקיימו במועד שנקבע לקיום הבחירות ברשויות המקומיות (22.10.2013) אלא ביום 20.10.2015. ביום 16.5.2013 הגיש העותר עתירה לבית משפט זה נגד החלטתו זו של המשיב (בג"ץ 3495/13; להלן: העתירה הראשונה), והיא נדונה עם עתירה נוספת שהגיש עותר נוסף באותו עניין (בג"ץ 4278/13). בית המשפט (כבוד השופטים א' רובינשטיין, א' חיות וצ' זילברטל) דחה את העתירות על הסף ביום 29.7.2013 בקובעו כי לא נמצאה אי-סבירות קיצונית בהחלטת המשיב על דחיית הבחירות. עם זאת, קבע בית המשפט כי המשיב יעקוב באורח שוטף אחר הנעשה בטייבה וישקול מחדש את החלטתו בעניין מועד הבחירות בחלוף שנה נוספת.

ביום 27.3.2014 הגיש העותר את העתירה דנן בה הוא טוען כי המשיב אינו מקיים את פסק הדין בעתירה הראשונה ואינו שוקל מחדש קיום בחירות בעיר טייבה. לשיטת העותר, בחודש ינואר 2014 אושר הסדר נושים בבית המשפט המחוזי בתל-אביב, המסיים את הליכי חדלות הפירעון שבהם הייתה העירייה מצויה משנת 2007. לכן ומשהחלטת המשיב לדחות את הבחירות התבססה על הליכי חדלות הפירעון שבהן הייתה העירייה נתונה, סבור העותר כי סיומם מצדיק את קיום הבחירות לאלתר. עוד טוען העותר כי חמישים אלף תושבי העיר טייבה ראויים להחליט בעצמם על זהות נבחריהם וכי המשיב יכול להסתפק בהטלת פיקוח הדוק על פעולות מועצת העיר שתיבחר. לחלופין טוען העותר כי יש להדיח את יו"ר הוועדה הממונה אשר מעורב לטענת העותר בפלילים ואינו ראוי לכהן בתפקיד ציבורי. העותר מוסיף וטוען כי הביא לידיעת המשיב את כל טענותיו בפגישה שקיים בלשכתו, אך נמסר לו כי אין בכוונת המשיב לפעול בנושא.

2.המשיב טוען מנגד כי דין העתירה להידחות על הסף בציינו כי העתירה הוגשה בטרם חלפה שנה מיום החלטתו על דחיית הבחירות בטייבה ובוודאי בטרם חלפה שנה מיום שניתן פסק הדין בעתירה הראשונה. לפיכך סבור המשיב כי אין כל הצדקה לשוב ולהידרש לעתירה בהיותה מוקדמת מדי והוא מוסיף וטוען כי לא נמצא תיעוד לטענת העותר לפיה טרם הגשת העתירה מיצה את ההליכים בפגישה שקיים בלשכת השר. אשר לסעד החלופי שהתבקש בעתירה טוען המשיב כי על אף הטענות החמורות נגדו לא צורף יו"ר הוועדה כמשיב וכי יו"ר הוועדה מעולם לא נחקר במשטרה ומעולם לא נפתח נגדו תיק פלילי.

3.דין העתירה להידחות על הסף מחמת אי-מיצוי הליכים.

מתגובת המשיב, הנתמכת בתצהיר יועצו, עולה כי אין כל תיעוד לכך שהתקיימה פגישה בה שטח העותר את טענותיו בפני המשיב או בפני מי מיועציו. משכך, ובהיעדר כל פירוט בדבר מועד הפגישה הנטענת או זהות האנשים שהשתתפו בה, אין מנוס מן המסקנה כי העותר לא הרים את הנטל להראות כי פנה אל המשיב בנושא העתירה טרם שפנה לבית המשפט (בג"ץ 3977/02 גורג נ' מדינת ישראל – הנהלת בתי המשפט (29.5.2002); בג"ץ 2466/05 נהאיה נ' שר הפנים (19.4.2005); בג"ץ 7823/10 תנועת יש גבול נ' הוועדה המייעצת למינויים לתפקידים בכירים, פס' 6 (18.1.2011); יצחק זמיר הסמכות המינהלית ג 1877-1874 (2014)). די בטעם זה על מנת לדחות את העתירה ומכל מקום, חזקה על המשיב כי יפעל בהתאם לאמור בפסק-הדין הראשון וישקול מחדש את האפשרות להקדים את תאריך הבחירות בעיר טייבה תוך התייחסות, בין היתר, לסיום הליכי חדלות הפירעון שננקטו בעניינה.

אוסיף ואציין כי לא ראיתי מקום להידרש לטענות שהועלו בעתירה בדבר עבירות פליליות שביצע לכאורה יו"ר הוועדה. לטענות אלה לא הונח בסיס כלשהו בעתירה ולו על פני הדברים ואילו המשיב ציין מצידו כי מעולם לא נפתחה נגד יו"ר הוועדה חקירת משטרה בעניינים הנוגעים לניהול העירייה או בכלל.

אשר על כן, העתירה נדחית. העותר ישלם למשיב שכר טרחת עורך-דין בסך של 5,000 ש"ח.
