בראשית הדיון הבהרנו לבאי כוחם של העותרים כי נראה שגורלה של העתירה נגזר לדחייה משום שהעותרים לא השכילו להמציא צילום של דף רישום לידה מספר הלידות משנת 1940 (כאמור בהחלטתנו מיום 31.10.2012). ציינו, כמו כן, כי פתוחה הדרך בפני העותרים להגיש בעתיד למשיב חומר נוסף לביסוס טענתם בדבר זכותם על פי חוק השבות, תש"י-1950. על רקע זה הצענו שהעתירה תימחק, תוך שהעותרים יוכלו לפנות בעתיד שוב למשרד הפנים כאמור.

פרקליטי העותרים קיבלו את שהצענו ובהתאם לכך אנו מורים על מחיקתה של העתירה בלא צו להוצאות.
