השופטת א' חיות:

1.ביום 17.4.2008 פגעה מונית שבה נהג רמי דקל (להלן: דקל) ביצחק רייכמן (להלן: המנוח) בעת שחצה את הכביש ברחוב כצנלסון בגבעתיים והוא נפטר מפצעיו לאחר כחודש, למרבה הצער. בוחן תנועה שבחן את האירוע קבע כי המנוח נפגע כאשר חצה את הכביש במעבר חצייה ומשכך המליץ על העמדתו של דקל לדין בגין גרימת מוות ברשלנות. אולם, לאחר שהחומר הרלבנטי הועבר לבחינת פרקליטות מחוז תל-אביב, הגיעו הגורמים המוסמכים למסקנה כי אין ראיות מספיקות לביסוס העמדתו של דקל לדין בגין גרימת מותו של המנוח בקובעם כי מן הראיות עולה שהתאונה היתה בלתי נמנעת, בין היתר משום שאין בנמצא נתונים שעל בסיסם ניתן לקבוע כי המנוח חצה את הכביש במעבר חציה.

העותר, בנו של המנוח, סירב להשלים עם החלטת פרקליטות מחוז תל-אביב ובערר שהגיש בעניין זה ביום 15.3.2009 טען כי מן הראיות שנאספו עולה כי דקל עבר עבירה של גרם מוות ברשלנות. העותר הדגיש בהקשר זה, בין היתר, את ממצאיו של בוחן התנועה, את העובדה שדקל נהג ללא רשיון נהיגה בר תוקף וללא ביטוח כדין וכן את ממצאי הדו"ח הפתולוגי. עוד טען העותר כי לאחר התאונה הפקיר דקל את המנוח וברח. אולם, ביום 8.11.2010 דחה המשנה לפרקליט המדינה לעניינים פליליים את הערר (ראו מכתבה של ש רון אדרי, סגנית בכירה א' לפרקליט המדינה וממונה בתחום העררים). בהחלטה צויין, בין היתר, כי אין בסיס לטענת העותר לפיה דקל הפקיר את המנוח לאחר התאונה וכי עניינו הועבר למשטרת התנועה לצורך בחינת החומר בקשר עם נהיגתו ללא רשיון בר תוקף. עם זאת, כך הודגש, נהיגה ללא רשיון אף שהיא מהווה עבירה לעצמה אינה מלמדת על נסיבות התאונה.

2.נגד החלטה זו מופנית העתירה שבפנינו. העותר מבקש כי נורה למשיבה להעמיד את דקל לדין בעבירה של גרם מוות ברשלנות בגין התאונה בה נהרג המנוח. בעתירתו שב העותר על הטענות אותן העלה בערר והוא סבור כי ההחלטה שלא להגיש כתב אישום נגד דקל לוקה בחוסר סבירות קיצוני ומנוגדת לאינטרס הציבורי. לגישת העותר עולה מן הממצאים כי המנוח נפגע בתאונת "פגע וברח" בעת שדקל נהג ברכב ללא רשיון בר תוקף ולטענתו הנסיבות הקיצוניות של המקרה דנן מצדיקות את התערבותו של בית משפט זה.

המשיבה טוענת מנגד כי דין העתירה להידחות, בהדגישה כי העותר לא הצביע על עילה להתערבות בשיקול הדעת של רשויות החקירה והתביעה ובציינה עוד כי דקל לא צורף כמשיב לעתירה. כמו כן טוענת המשיבה כי דין העתירה להידחות לגופה וכי העובדות העולות מן הראיות מתיישבות יותר עם המסקנה שהתאונה היתה בלתי נמנעת. עוד נטען כי אין בסיס לטענת העותר לפיה מדובר בתאונת "פגע וברח", וכי אין די בכך שקיים קשר סיבתי בין התאונה למותו של המנוח ואף לא בכך שדקל נהג ללא רשיון נהיגה בתוקף, לשם ביסוס עבירה של גרימת מוות ברשלנות.

3.דין העתירה להידחות על הסף.

האסון שפקד את העותר ומשפחתו בשל מות אבי המשפחה בתאונת הדרכים המתוארת, הוא כבד מאוד וכאבם ברור ומובן. יחד עם זאת, ההחלטה אם יש בחומר הראיות בסיס מספיק להעמדה לדין היא החלטה המסורה לגורמים המוסמכים המופקדים על התביעה הפלילית ובמקרה דנן החליטו גורמים אלה לאחר חקירה ובדיקה שלא להעמיד לדין פלילי את הנהג הפוגע בגין גרימת מותו של המנוח, בקובעם כי אין ראיות מספיקות לצורך כך. החלטת פרקליטות מחוז תל-אביב בעניין זה אף נבחנה על ידי המשנה לפרקליט המדינה לעניינים פליליים בעקבות הערר שהגיש העותר, והוא סבר כי אין מקום לקבלת הערר.

הלכה היא כי מרחב שיקול הדעת המסור לרשויות התביעה בעניינים אלה הינו רחב וכי מידת התערבותו של בית המשפט הגבוה לצדק בהחלטות הרשות הנוגעות לניהולה של החקירה הפלילית או להערכת הראיות וגיבוש המסקנות לצורך העמדה לדין, הינה מצומצמת לאותם מקרים נדירים בהם לוקה ההחלטה בחוסר סבירות קיצוני או בעיוות מהותי (ראו בג"ץ 3041/07 ראדה נ' פרקליט המדינה, פסקה 4 (טרם פורסם, 17.5.2007); בג"ץ 10034/05 עזבון המנוח אהוד בריל ז"ל נ' מדינת ישראל, פסקה 4 (טרם פורסם, 23.11.2005)). במקרה דנן, וכעולה מתשובתה המפורטת של המשיבה, נראה כי טענותיו של העותר לא נעלמו מעיניה וכי הן נבחנו לגופן כנדרש, אך בחינת חומר החקירה על ידי הגורמים המוסמכים העלתה, כאמור, כי אין די בראיות שנאספו כדי להעמיד את דקל לדין פלילי בגין גרימת מותו של המנוח. אין מדובר, אפוא, בחריגה ממתחם שיקול הדעת המסור לרשויות התביעה ואין עילה להתערבותנו בהחלטה נשוא העתירה, על פי המבחנים שנקבעו לעניין זה בפסיקה.

העתירה נדחית. אין צו להוצאות.
