1.העותרת טוענת כי היא זכאית לקבל מעמד בארץ מכוח חוק השבות, התש"י-1950 (להלן: חוק השבות) בהיותה יהודיה. המשיב סבור כי העותרת לא עמדה ולו בקירוב בנטל ההוכחה הנדרש להוכחת יהדותה. מכאן – העתירה שבפנינו.

2.דין עתירתה של העותרת להידחות על הסף בשל שיהוי: העותרת הגישה עוד בשנת 1994 בעיר הולדתה טביליסי, גרוזיה, בקשה לקבלת אשרת עולה ובקשתה נדחתה. ביום 3.11.1996, נכנסה העותרת לישראל באשרת תייר שתוקפה לשלושה חודשים. שלושת החודשים עברו והעותרת נשארה בארץ שלא כדין. רק בשנת 2001 פנתה העותרת ללשכת הקשר ולאחר שהובהר כי בקשתה נדחתה עוד בשנת 1994 – סורבה פנייתה. מן העתירה המתוקנת שהגישה העותרת למדנו לדעת כי בשנת 2001 הגישו העותרת ובנה עתירה לבית משפט זה ב-בג"ץ 2837/01. עתירה זו נמחקה לבקשת העותרת בלא צו להוצאות עוד ביום 26.11.2001 בדיון שהתקיים בפני הרכב. גם לאחר מחיקת העתירה העותרת לא יצאה את הארץ. ביולי 2002 פנה בא כוחה של העותרת לראש מינהל האוכלוסין במשרד הפנים. ביום 6.8.2002 ניתנה תשובה שלילית, והעותרת נדרשה מפורשות לצאת את הארץ באופן מיידי. העותרת לא עשתה כן. רק ביום 18.3.2004 הגישה העותרת את עתירתה הנוכחית ועמה בקשה לצו ביניים, ועל פי בקשתה ניתן צו האוסר על הרחקתה מהארץ. העותרת עשתה דין לעצמה והיא שוהה שנים ארוכות בארץ שלא כדין והיא השתהתה, כמפורט, בהגשת עתירתה. די בטעמים אלו כדי לדחות את העתירה על הסף. יפים בהקשר זה, מקל וחומר, דבריה של חברתי השופטת ארבל שנאמרו בפרשה בה בוטל מעמדם בישראל של עותרים:

"אכן, דין העתירה להידחות על הסף. כחמש שנים חלפו מאז הודע לעותרים על ההחלטה לבטל את מעמדם בישראל ועל כך שעליהם לעזוב את הארץ. הם בחרו שלא לעשות כן, על דעת עצמם ונותרו בישראל באופן בלתי חוקי. בה בעת התנהלו בעצלתיים בכל הקשור בהעלאת השגותיהם על ההחלטה, כמתואר. במיוחד נכונים הדברים אם מביאים בחשבון שגם פניותיהם הנוספות למשיבים, מיום 20.2.03 ומיום 17.3.03, שנענו אף הן בכך שעליהם לעזוב את הארץ, לא הביאו את העותרים להגיש עתירה אלא כעבור מעט יותר משנה, עם הגשת עתירה זו. שיהוי כבד זה מהווה כשהוא לעצמו טעם לדחיית העתירה על הסף, היות שבנקודת הזמן הנוכחית לא ניתן עוד לבחון את החלטת המשיבים שהתבססה על נתונים עדכניים למועד הינתנה." דין העתירה להידחות על הסף. מסכימים אנו עם עמדת בא-כוח המשיב, לפיה העותר עתר לבית-משפט זה בחוסר ניקיון כפיים. שכן, העותר שוהה בישראל במשך זמן רב, באופן בלתי חוקי. כמו-כן, לעותר הודע לפני למעלה משלוש שנים, כי בקשתו לאיחוד משפחות סורבה וכי עליו לעזוב את תחומי מדינת ישראל, וזאת לאחר ששתי עתירות שהגיש וביקש במסגרתן לקבל מעמד בישראל, נדחו [...]" (בג"ץ 6952/05 ג'ראדה נ' משרד הפנים (טרם פורסם, 12.9.2005); כן ראו והשוו: בג"ץ 4291/04 פבלישין נ' מדינת ישראל (טרם פורסם, 29.8.2006), עתירה לקיום דיון נוסף נדחתה (דנג"ץ 904/07); בג"ץ 2957/04 רוסו נ' משרד הפנים (לא פורסם, 14.4.2004); בג"ץ 4370/01 לפקה נ' משרד הפנים, פסקה 21 (לא פורסם, 22.5.2003)).

3.גם לגוף העניין, ועל יסוד הנתונים שהביאה העותרת, אין מקום להתערב בהחלטת המשיב שקבע כי לא עלה בידי העותרת להראות כי זכאית היא לאזרחות מכוח שבות. העותרת ילידת 1959 הגיעה ארצה בעקבות בנה, אשר עלה ארצה ביום 15.8.1996 יחד עם בעלה לשעבר של העותרת, שהוא יהודי. מן החומר המונח לפנינו עולה כי הבן, דניס שמו, הסתבך עם גורמים בלתי רצויים, והעותרת שהגיעה בנובמבר 1996 באשרת תייר החליטה להישאר עמו (מכתב בא כוחה של העותרת מיום 13.5.2002). בעתירה נסמכה העותרת למעשה על שני מסמכים: האחד הוא תעודת לידה משוחזרת של העותרת שהוצאה בשנת 1994. תעודה זו מצביעה לכאורה על כך שאמה של העותרת היא יהודיה. ואולם - בדיקת ספר הרישום העלתה כי בשנת 1994 נערך שינוי ברישום הלאום של אמה של העותרת מ"רוסיה" ל"יהודיה" וזאת בלי שהוצגה כל החלטה רשמית המורה לעשות כן. מכאן מסקנת המשיב שתעודת הלידה המשוחזרת הנסמכת על הרישום כאמור אינה מהימנה. המסמך השני הוא תעודת לידה משוחזרת של אמה של העותרת שהוצאה על ידי שלוחת משרד המשפטים האבחזי בטביליסי בשנת 1995. ניסיונם של אנשי "נתיב" מלמד כי אמינותם של מסמכים המגיעים משלוחה זו של משרד המשפטים בטביליסי מוטלת בספק. בנוסף תעודה זו הוצאה לאחר השינויים הבלתי מוסברים בשינוי רשום לאום האם ולאחר שהוגשה הבקשה הראשונה לשגרירות בישראל (לעניין חוסר האמינות של המסמכים ראו מש/1 מכתב מ"נתיב" מיום 20.1.2005).

4.בנוסף העותרת טענה אומנם בתצהירה כי ידוע לה שאמה היא יהודיה, והיא צרפה לעתירתה המקורית תצהירים של אנשים שונים מעיר הולדתה לפיהם אמה של העותרת שמרה על מנהגים יהודיים כגון אכילת מצה בפסח, תפוח בדבש בראש השנה ועוד. ואולם, לאור השינוי שנעשה כאמור במרשם בשנת 1994 בלא החלטה רשמית המורה לעשות כן - מותר היה למשיב שלא לסמוך על תצהירים אלה.

5.על כל אלה נוסיף כי בתצהיר שנלווה לעתירה המקורית ציינה העותרת עצמה כי "בזמן הזה אני לא יכולה להוכיח שיש לי זכות לעלות ארצה בתור עולה חדשה". הדברים מדברים בעד עצמם, ואין בצרוף אותם מסמכים שוב ושוב במסגרת העתירה המתוקנת כדי לשנות מדברים ברורים אלה שהצהירה העותרת עצמה. אכן, אם יהיו בידי העותרת ראיות כבדות משקל חדשות שמורה לה טענתה כי היא יהודיה והיא תוכל לפנות בבקשה מתאימה גם בהיותה מחוץ לישראל.

6.ב"כ העותרת תוקף את חוסר מומחיותם, לטענתו, של אנשי "נתיב". בטענה זו לא מצאנו ממש. מותר למשיב לסמוך על בעלי הנסיון הפועלים מטעם המדינה ועל מומחיותם. בין כך ובין כך השינוי שנערך, ללא הסבר, ברישום הלאום של האם, מעמיד בספק את כל המסמכים האחרים שהראתה העותרת.

7.ודוק: בעתירה המתוקנת נטען כי עילת העתירה הנוכחית שונה מבקשותיה הקודמות של העותרת והיא מבוססת על אזרחותו של בנה היחיד של העותרת, שעלה כאמור ארצה עם אביו. ואולם - בנה של העותרת עתר יחד עמה עוד בעתירה שב-בג"ץ 2837/01 עתירה שנמחקה כאמור. לגוף העניין: העובדה שלעותרת בן שעלה ארצה (מכוח אביו היהודי) אינה מקנה לה עילה לקבלת תושבות או אזרחות בישראל שהרי כפי שקבעה השופטת חיות: "ככלל ועל פי המדיניות הנהוגה על ידי המשיב, כאמור, אין די בכך שתושב זר מבקש להימצא בקירבת בן משפחה, אזרח או תושב, כדי להצדיק מתן רישיון לישיבת קבע בישראל" (עע"ם 11538/05 נטיוסוב נ' שר הפנים, פסקה 6 (טרם פורסם, 25.11.2007)). באותה פרשה נדון עניינו של נוהל "קשיש ובודד" שעל פיו יכול הורה קשיש ובודד לזכות במעמד בישראל. העותרת בענייננו כלל לא הגישה בקשה בעניין למשיב ובכל אופן נראה שהיא ממילא אינה באה בגדרי נוהל זה.

8.סוף דבר: העותרת לא הוכיחה, להנחת דעת המשיב, את יהדותה. מותר היה למשיב שלא לסמוך על התצהירים בשל תעודת הלידה אותה הציגה העותרת, תעודה שהתבססה על שינוי חסר הסבר ברישום. לא ראינו עילה להתערב בהחלטת המשיב, ואנו דוחים את העתירה. אם יהיו בידי העותרת ראיות חדשות רשאית היא כאמור לפנות בבקשה חדשה גם בהיותה מחוץ לישראל. כמו כן לאחר יציאתה רשאית היא לבקש אשרות לביקור בנה. הצו שניתן ביום 8.6.2004 שמנע את הרחקת העותרת מן הארץ יעמוד בתוקפו במשך 30 ימים נוספים.

9.העתירה נדחית אפוא. לא יהיה צו להוצאות.
