המשנה לנשיאה א' ריבלין:

העתירה מכוונת כנגד צו המעצר המינהלי שהוצא כנגד העותר. הצו מורה על החזקתו במעצר מינהלי עד ליום 27.8.2008, אושר בערכאה הראשונה אך קוצר באופן בלתי מהותי עד ליום 27.6.2008. ערכאות השיפוט הצבאיות, שדנו בעניינו של העותר, קבעו שמ דובר בפעיל חמאס בכיר העוסק בפעילות אינטנסיבית, עדכנית, המסכנת את בטחון האיזור.

לבקשת העותר עיינו בחומר החסוי שהוצג לנו על-ידי המשיב ולא מצאנו עילה להתערב בהחלטת בית-המשפט הצבאי לערעורים.

העתירה נדחית ללא צו להוצאות.
