השופטת מ' נאור:

1.העתירה שלפנינו הוכתרה כ"עתירה לצו הביאס קורפוס". התבקשה תגובה לעתירה ותשובה לתגובה. הגעתי לכלל מסקנה כי דין העתירה להדחות על הסף. נוכח דחיפות העניין אפרט את הדברים בקצרה.

2.בית דין צבאי הרשיע את העותר בחלק מהעבירות שיוחסו לו וזיכה אותו מאחרות. על העותר נגזרו 3 שנות מאסר בפועל. מועד תום ריצוי המאסר בפועל הוא ביום 6.6.2009. המשיב 3 – נציב שירות בתי הסוהר – החליט על קיצור מנהלי של המאסר כך שיסתיים ביום 17.4.2009 (דהיינו, מחר). בין לבין הגישה המדינה למשיב 1 – בית המשפט הצבאי לערעורים – ערעור על פסק הדין (הן על הזיכוי החלקי והן לחילופין על גזר הדין). נוכח המועד הקרוב שנקבע לתום מאסרו של העותר ביקשה המדינה במהלך הדיון בערעור את מעצרו של העותר עד לתום הליכי הערעור. העותר הגיש תגובה לבקשה. המשיב 2 – נשיא בית המשפט הצבאי לערעורים החליט ביום 7.4.2009 כדלקמן:

"מ דובר בתיק מורכב וכתיבת פסק הדין טרם הסתימה.

התביעה מבקשת את מעצרו של המשיב [העותר – מ"נ] עד מתן פסק הדין והסנגור מתנגד לכך.

בנסיבות העניין אני מורה בשלב זה שמאסר[ו] של העורר [צ"ל המשיב (העותר) – מ"נ] לא יקוצר בקיצור מנהלי ומורה על מעצרו עד ליום 6/6/09, מועד תום ריצוי עונש המאסר בפועל"

3.בעתירה שלפנינו נטען כי החלטת המשיב 2 ניתנה בחוסר סמכות: בית המשפט הצבאי לערעורים אינו מוסמך לבטל את החלטת המשיב 3 לקצר באופן מינהלי את מאסרו של העותר. העותר הדגיש בהקשר זה את השורה בהחלטה בה הורה המשיב 2 על כך שמאסרו של העותר לא יקוצר בקיצור מנהלי. גם לגופו של עניין טען העותר שלאחר זיכויו החלקי אין להורות על מעצרו בוודאי שלא מן הטעם כי כתיבת פסק הדין טרם הסתיימה. לטענת העותר כדי להצדיק מעצר בשלב ערעור (של מי שסיים את ריצוי מאסרו) על המדינה לעמוד בנטל כבד ובענייננו המדינה לא עמדה בו.

4.המדינה טוענת כי דין העתירה להדחות על הסף מאחר שבית משפט זה אינו יושב כערכאת ערעור על החלטות בית המשפט הצבאי לערעורים ומקל וחומר כאשר מ דובר בהחלטה בעניין מעצר. גם לגופו של עניין טוענת המדינה כי דין העתירה להדחות. לטענת המדינה עניין הקיצור המינהלי לא היווה מקור הסמכות להחלטת המשיב 2 אלא נקודת איזון בעניין אורך תקופת המעצר ולראייה שהמשיב 2 סיים את החלטתו בכך שהורה על מעצרו של העותר ולא על המשך מאסרו.

5.עמדת המדינה מקובלת עליי. אכן בית משפט זה אינו יושב כערכאת ערעור על החלטות בית המשפט הצבאי בפרט כאשר מ דובר בהחלטות ביניים וכן החלטות בעניין מעצר (בג"ץ 8033/07 חאמד נ' בית המשפט הצבאי לערעורים באזור יהודה ושומרון, פסקה 3 (טרם פורסם, 26.9.2007)). על כן, אין מקום לדון בטענות "ערעוריות" ובעיקר בשאלה האם לגופו של עניין ראוי היה להורות על מעצר בנסיבות העניין שלפנינו. אשר לטענת העותר כי ההחלטה ניתנה בחוסר סמכות משום ביטול הקיצור המינהלי של מאסרו. טענה זו דינה להידחות ולו משום שמן ההחלטה עולה מפורשות כי בסופו של דבר הורה בית המשפט על מעצרו של העותר (ולא, על המשך מאסרו) ואין מחלוקת כי הייתה לו סמכות להורות על מעצר כאמור (סעיף 78(ז) לצו בדבר הוראות בטחון; כן ראו והשוו לגבי הדין בישראל ע"פ 1708/06 מדינת ישראל נ' דדון (טרם פורסם, 26.2.2006)). בקשת המדינה היתה, כמבואר, לעצור את העותר וכך הורה בית המשפט. החלטת המעצר היא לכל הדעות בסמכות בית המשפט.

6.אשר על כן, העתירה נדחית על הסף. אין צו להוצאות.
