השופט י' עמית:

1.בעתירה שבפנינו, האוחזת 39 עמודים, בצירוף נספחים – המנוסחת באופן ארכני ומייגע, תוך חזרות אין ספור על אותן טענות ותוך אזכור עובדות לא רלבנטיות – עותר העותר להורות למשיבים 2-1 להגיש תלונה לועדת האתיקה של לשכת עורכי הדין נגד עורכי הדין, המשיבים מס' 5-3. זאת, באשר אלה ביצעו לשיטתו עבירת משמעת באופן ניסוח כתב ערעור הכולל ביטויים בלתי הולמים כלפי שופט בית המשפט המחוזי כב' השופט איתן אורנשטיין, במסגרת ע"א 844/14 דנקנר נ' כונס הנכסים הרשמי התלוי ועומד ב בית משפט זה.

חלק מהניסוחים אליהם נטפל העותר, ככל הנראה לאחר שעבר בזכוכית מגדלת על הודעת הערעור, אכן אינם מוצלחים במיוחד. כך, כתבו המשיבים 3-5 בהודעת הערעור כי בית המשפט המחוזי החליט "שלא להתעמק ולהכריע בטענות החברה בנוגע לחוסר במידע, וזאת בתירוץ'שגם בהצעת החברה נפל כביכול פגם'" או ש בית המשפט העדיף להתעלם מפעילות עבריינית חמורה, וגם אם לא התכוון לכך, הכשיר פעילות בלתי הוגנת ובכך נתן למעוול ליהנות מפירות עוולתו". העותר נטל מספר משפטים מהודעת הערעור, ולאורך עמודים רבים בעתירתו מפרש ומתפלפל לגביהם, משל היו טקסט ספרותי סבוך הטעון פירוש, על מנת להאדיר ולהעצים את הדברים.

2.ולגופה של עתירה.

ככל שהעותר מבקש לשמור על כבודם של שופטי ישראל, חזקה על המותב שישב לדין בערעור, כי ידע לפעול כחוכמתו אם ימצא כי כתב הערעור אינו מנוסח בדרך הולמת. אציין כי זו גם התשובה שהשיבו המשיבים 2-1 לפנייתו של העותר, שקדמה להגשת עתירה זו.

ככל שהעותר מבקש לעשות בעתירתו גזירה שווה בין אופן התבטאותו בעבר כלפי השופטת טובה סיוון ז"ל לבין כתב הערעור הנ"ל, הרי שאין ממש בהשוואה זו, ואין ולא כלום בטענה לגבי "אכיפה בררנית" כלפיו. ככל שהתרשמתי, זה המניע האמיתי להגשת העתירה – ממנה עולה כי המשיב 3 ייצג בשעתו את הצד שכנגד בסכסוך שהתנהל בפני השופטת המנוחה – ונראה אפוא שלא החרדה לכבודם של שופטי ישראל היא שעמדה נגד עיניו של העותר בהגישו את עתירתו.

3.כפי שעולה מהעתירה, העותר הגיש במקביל ובאופן עצמאי תלונה כנגד המשיבים 3-5 לועדת האתיקה הארצית של לשכת עורכי הדין, וזו הועברה לועדת האתיקה של מחוז ירושלים. חזקה גם על ועדת האתיקה כי תפעל כפי שתמצא לנכון, ודי גם בכך כדי לייתר את העתירה.

העתירה נדחית על הסף ללא צורך בתגובה. העותר ישא בהוצאות לטובת אוצר המדינה בסך 7,000 ₪.
