פסק-דין

השופטת א' פרוקצ'יה:

1.בעתירה שלפנינו מבקשת העותרת, הטוענת לזכויות בחלקת מקרקעין המצויה ברחובות, כי יינתנו לה שלושה סעדים בנוגע לחלקה זו: ביטול החלטה להפקעת החלקה, ביטול תכנית איחוד וחלוקה ודיון בתכנית מחדש, תוך הכללת החלקה בחלקות המיקבץ.

2.נשוא העתירה היא חלקה 152 בגוש 3658 המצויה בעיר רחובות (להלן – החלקה). לטענת העותרת, היא והמשיבים 6 ו-7 לעתירה הם בעלי זכויות בחלקה. המשיבות 3 ו-4, שתי חברות קדישא, הן בעלות רישיון קבורה בבתי עלמין, ופועלות על חלקות הסמוכות לחלקה זו. טוענת העותרת, כי המשיבה 2, הוועדה המקומית לתכנון ולבניה רחובות (להלן – הוועדה המקומית), יזמה את תכנית מתאר רח/1000/ב, המשנה את ייעוד החלקה ממגורים לקבורה. העותרת ומשיבים 6 ו-7 התנגדו לאישור התכנית, מן הטעם שזו שינתה את ייעוד השימוש בחלקה, מבלי לכלול אותה במקבץ חלקות אחרות לצורך תכנית האיחוד והחלוקה, וביניהן חלקות 82 ו-83, המיועדות למלאכה. במהלך הדיון בהתנגדויות, הציע יושב-ראש הוועדה המחוזית למתנגדים, על פי הטענה, כי תיעשה ההחלפה הבאה: חברה קדישא שעריים (המשיבה 3), תקבל את החלקה, ואילו בעליה יקבלו את חלקות 82 ו-83. טוענת העותרת כי הצדדים הסכימו לכך, ועל יסוד זה חזרו בהם המתנגדים מן ההתנגדויות, והתכנית אושרה.

3.לאחר מכן, פנתה העותרת, לטענתה, לחברה קדישא שעריים כדי לבצע את חילופי החלקות. האחרונה הודיעה כי היא מסרבת לבצע את החילופין, וכי תפעל להפקעת החלקה. על רקע זה הגישה העותרת בקשה למתן רישיון קבורה בחלקה. בקשותיה נדחו, ועל כן הגישה בקשה לקבורה דתית בקומות. מספר פניות בעניין זה לא נענו, לטענת העותרת.

4.בהמשך, הכינה הוועדה המקומית תכנית איחוד וחלוקה על-פי תכנית המתאר רח/1000/ב. העותרת הגישה התנגדות לתכנית האיחוד והחלוקה, בה טענה כי יש לכלול את החלקה במקבץ החלקות לצורך איחוד וחלוקה ובכלל זה, עם חלקות 82 ו-83. ההתנגדות נדחתה. הערר על כך נדחה אף הוא.

5.בחודש מאי 2007 פרסמה הוועדה המקומית הודעה כי בכוונתה להפקיע את החלקה, ודרשה את מסירת החזקה בה. העותרת ביקשה מן הוועדה לחזור בה מהחלטה זו. התברר לעותרת, כי בכוונת הוועדה למכור את החלקה, ועל כן דרשה, בכפוף לחוקיות ההפקעה, לשלם לה את שווי חלקה בחלקה. העותרת נענתה כי אין בכוונת העירייה לחזור בה מההפקעה, וכי ייערך מכרז להחכרת השטח לצרכי קבורה.

על רקע כל אלה הוגשה העתירה.

6.בפי העותרת טענות למכביר. בין היתר טוענת היא, כי ההפקעה נגועה באי-חוקיות, וכי נפלו פגמים בהליך ההפקעה. לדבריה, שר האוצר והוועדה המקומית מתערבים שלא כדין ביחסים החוזיים בין בעלי הזכויות בחלקה לבין חברה קדישא שעריים, לצורך הכשלת ההסכמה להחלפת החלקות. עוד טוענת העותרת, כי הוועדה המקומית התנגדה להכללת החלקה בתכנית האיחוד והחלוקה בשל מזימה שנרקמה להפקיע את החלקה. כמו כן, לטענתה, היא תשרת טוב יותר את האינטרס הציבורי אם יתאפשר לה לקבור בחלקה, שכן היא תקבור בקומות, לעומת החברה קדישא אשר תקבור בקרקע בלבד.

על כן, מבקשת העותרת, כי תבוטל ההחלטה להפקיע את החלקה, וכי תידון בקשתה לקבל רישיון קבורה בקומות בחלקה. לחלופין היא מבקשת, כי תבוטל החלטת שר הפנים לאשר את תכנית האיחוד והחלוקה, על מנת שזו תידון מחדש לאחר שהחלקה תיכלל בחלקות המקבץ.

7.המשיבים הגישו כולם את תגובותיהם לעתירה.

8.פרקליטות המדינה הגיבה בשם שר האוצר, מנהל הרשות לשירותי דת, שר הפנים וראש הממשלה (המשיבים 1, 5, 8 ו-9). לעמדתה, יש לדחות את העתירה על הסף. החלקה הנדונה בעתירה הופקעה על-פי חוק התכנון והבניה, התשכ"ה-1965 (להלן – חוק התכנון והבניה), ועל כן הסוגיות הכרוכות בה דינן להתברר בבית המשפט לעניינים מינהליים. כך גם הטענות בענין אישורה של תכנית האיחוד והחלוקה. יש, אפוא, בידי העותרת סעד חלופי.

9.אשר לבקשה לקבלת רישיון קבורה בחלקה, טוענת המדינה, ראשית, כי העותרת לא הוכיחה מהן זכויותיה בחלקה. נסח הרישום שצירפה העותרת לעתירתה מלמד כי זכות הבעלות נתונה לקרן הקיימת לישראל, וכי זכות חכירה לתקופת 49 שנים ניתנה לארבעה חוכרים, שהעותרת אינה ביניהם. כל שיש בידה, על-פי הנסח, הוא הערת אזהרה המעידה על כוונתה לרכוש 6/16 חלקים מזכויות החכירה בחלקה. כמו כן, העותרת צירפה כמשיבים לעתירה רק שניים מן החוכרים הרשומים במרשם המקרקעין, ומכאן שלא צורפו כל בעלי הדין הנדרשים לענין. עוד מציינת המדינה, כי ככלל, בקשה לקבל רישיון קבורה מוגשת על-גבי טופס בקשה שהוכן ופורסם על-ידי הרשות הארצית לשירותי דת. בקשה כזו לא צורפה לעתירה, ולמיטב ידיעת המדינה, אין בפניה בקשה כזו מטעם העותרת. כמו כן, העותרת לא עמדה בתנאים נדרשים נוספים לקבלת הרישיון, כגון הצגת הסכם חתום עם המוסד לביטוח לאומי. על כן, מ דובר בעתירה מוקדמת, אשר הוגשה בטרם מוצו כל ההליכים הנדרשים כלפי הרשות המוסמכת.

לבד מזאת, מבקשת המדינה למחוק את שר האוצר כמשיב לעתירה, בשל אי-מעורבותו בהפקעה "התכנונית" הנדונה בעתירה, המתבצעת על-ידי ועדה מקומית לתכנון ולבניה. שר הפנים גם הוא איננו משיב הדרוש בעתירה, שכן תכנית האיחוד והחלוקה לא נקבעה כתכנית הטעונה אישור שר הפנים על-פי סעיף 109 לחוק התכנון והבניה, וממילא לא אושרה על ידו.

10.הוועדה המקומית ולתכנון ולבניה רחובות (המשיבה 2) טוענת כי דין העתירה להידחות על הסף, מטעמים שונים. בין היתר טוענת היא, כי הסעד היחידי המופנה כלפיה, הוא ביטול ההחלטה להפקיע את החלקה, וזה מצוי בסמכותו של בית המשפט לעניינים מינהליים. הדברים נכונים גם באשר לסעד, המופנה כנגד שר הפנים, שעניינו ביטול התכנית. הוועדה טוענת, בדומה למדינה, כי אין זה ברור מדוע צורף שר הפנים כמשיב בעתירה המכוונת כנגד תכנית שאישרה הוועדה המקומית, וכי לא ניתן ללמוד מהעתירה מהן זכויותיה של העותרת בחלקה. הוועדה הוסיפה טעמים שונים המצדיקים, לעמדתה, גם את דחיית העתירה לגופה.

11.המשיבה 3, חברה קדישא גחש"א שעריים, מציינת בתגובתה כי מעולם לא הסכימה להחלפת חלקות 82 ו-83 בחלקה. משכך, ובניגוד לטענות העותרת, מעולם לא נחתם הסכם בענין זה.

12.המשיבה 4, חברה קדישא "מרמורק", פירטה את השתלשלות ההליכים שקדמו לקבלת תכנית מתאר רח/1000/ב. לטענתה, יש לדחות את העתירה, בין היתר, מחמת שיהוי, מפני שהיה על העותרת לפעול לאחר שנדחתה התנגדותה והתכנית אושרה.

13.המשיבים 6 ו-7, דוד קפרא ויוחנן דרום, מחוכרי החלקה, מסרו בתגובתם כי הם אינם מתנגדים לעתירה.

14.לאחר בחינת עיקרי העתירה, מצאנו כי דינה להידחות על הסף. הן תכנית האיחוד והחלוקה והן ההפקעה בוצעו מכח חוק התכנון והבניה. שילוב סעיף 5(1) לחוק בתי משפט לענינים מינהליים, התש"ס-2000 עם פריט 10(א) לתוספת הראשונה לחוק זה מורה, כי עתירה בענייני תכנון ובניה לפי חוק התכנון והבניה, תידון בבית משפט לעניינים מינהליים, למעט עבירות ועונשין לפי חוק התכנון והבניה, החלטות שעניינן תכנית מיתאר ארצית או מחוזית, והחלטות שר הפנים. העניין שלפנינו איננו נכנס לגדר החריגים המופיעים בסיפא לפריט 10(א), והוא, במובהק, ענין מענייני תכנון ובניה. משכך, בידי העותרת סעד חלופי של פנייה לבית המשפט לעניינים מינהליים בכל הנוגע לביטול החלטת ההפקעה ולביטול תכנית האיחוד והחלוקה (בג"צ 6188/00 אסולין נ' עיריית עפולה (לא פורסם, 3.10.00); בג"צ 4519/03 מחבר נ' הוועדה המקומית לתכנון ולבניה ירושלים (לא פורסם, 24.7.03); בג"צ 8442/03 מרגליות נ' עיריית אשדוד (לא פורסם, 21.10.03)). נוכח קיומו של סעד חלופי כאמור, אין מקום כי בית משפט זה יזקק לסוגיות אלה, הכלולות בעתירה.

15.אשר לענין הבקשה לקבלת רשיון קבורה – העתירה מוקדמת, ולא מוצו ההליכים בגינה. כפי שטענה המדינה, לזכויותיה של העותרת בחלקה לא ניתן ביסוס מספיק; לעתירה צורפו רק חלק מהחוכרים הרלבנטיים, ולא ננקטו כל הצעדים המתחייבים לצורך הגשת בקשה לרשיון בידי העותרת, תוך עמידה בכל התנאים הנדרשים לצורך כך (תקנות 2(א) ו-4 ל תקנות שירותי הדת היהודיים (חברות לעניני קבורה), התשכ"ז-1966; בג"צ 4499/07 ויליטניצקי נ' משרד הפנים (לא פורסם, 17.9.07); בג"צ 7953/07 יערי נ' שר המשפטים (לא פורסם, 18.11.07), פיסקה 8; בג"צ 10381/07 עדיני נ' יושב-ראש רשות ניירות ערך (לא פורסם, 19.12.07)).

לאור האמור, העתירה נדחית על הסף.
