המשנה לנשיאה א' ריבלין:

העותר מבקש לצאת ללימודים בגרמניה למשך מספר שנים. כך היה עניינה העיקרי של העתירה. המשיבים הסכימו לפנים משורת-הדין להתיר את יציאתו של העותר לגרמניה דרך מעבר אלנבי, וזאת בכפוף להעדר מניעה בטחונית. נערכה בדיקה שכזו ונמצא שאין מניעה של יציאתו של העותר דרך המעבר כאמור.

בכך בא העותר על סיפוקו בכל הנוגע לעניין שהצדיק טיפול דחוף בעניינו. העותר אינו מסתפק בכך ומבקש שהמשיבים יתחייבו מראש לאפשר לו להגיע לביקורים במקום מגוריו בשטחים, ויתחייבו גם מראש לאפשר לו לחזור לשטחים עם סיום לימודיו.

המשיבים מודיעים שאם אכן יבקש העותר לבקר באזור או לשוב להתגורר בו בעוד מספר שנים, הוא יידרש להגיש בקשה מתאימה והיא תידון על-פי הנסיבות שיתקיימו בעת הגשתה.

למעלה מן הדרוש מודיעים המשיבים כי העותר נולד ברצועת עזה ושם התגורר מרבית חייו, וכי הוא לא קיבל מעולם היתר להשתקע באזור יהודה ושומרון ואף לא ביקש עד היום לעשות כך. בפועל, התגורר שלא-כדין באיזור ביר-זית. עוד מודיעים המשיבים כי נכון להיום, בשל המצב הבטחוני ברצועה ובאיזור, אין ישראל מאשרת מעבר והעתקת מקום מגורים מאזור רצועת עזה לאזור יהודה ושומרון, אלא אם כן מ דובר במקרים חריגים. אולם, גם עובדה זו עשויה להשתנות בעתיד וממילא לא ניתן להציע מענה לעותר מראש.

דין העתירה איפוא להידחות וכך אנו מורים.

אין צו להוצאות.
