1.בעתירה שלפנינו, עותר העותר לביטול חוקים השוללים קצבת זקנה וגימלה תקציבית מאסירים, בעודם מרצים את עונשם. העותר, המייצג את עצמו, העלה טענות שונות, לעיתים בלשון בוטה, באופן המקשה על הקורא לעמוד על הטיעון המשפטי שבבסיס העתירה. כך, טוען העותר לבטלותם של שני חוקים השוללים קצבה מאסירים, מבלי לציין כנגד אילו חוקים הוא מלין, ורק מסיבה זו ניתן היה לדחות את העתירה. עם זאת, אני נכון להניח כי כוונתו של העותר לסעיף 325 לחוק הביטוח הלאומי [נוסח משולב], התשנ"ה-1995 (להלן: חוק הביטוח הלאומי), הקובע כי "הנמצא במאסר על פי פסק דין של בית משפט שדן אותו למאסר של שלושה חודשים או יותר, לא תשולם לו כל גמלה בעד הזמן שהוא במאסר", ולסעיף 56 לחוק שירות המדינה (גימלאות) [נוסח משולב], התש"ל-1970 (להלן: חוק הגמלאות), הקובע הוראה דומה. לטענת העותר, חוקים אלה פוגעים בזכותו לקניין, המעוגנת בחוק יסוד: הדמוקרטיה (ויש להניח כי העותר נתכוון לזכות הקניין הקבועה בסעיף 3 לחוק יסוד: כבוד האדם וחירותו).

2.אקדים ואומר, כי אילו ביקש העותר כי תשולם לו גימלה לפי חוק הביטוח הלאומי, הרי שהיה עליו לפנות אל בית הדין האזורי לעבודה, לו הסמכות הייחודית לדון בעניינים כגון דא (בג"צ 9661/04 סעדה נ' המוסד לביטוח לאומי (לא פורסם, 10.2.2005); בג"צ 5363/99 כהן נ' המוסד לביטוח לאומי (לא פורסם, 3.11.1999); בג"צ 10968/07 מכנס נ' המוסד לביטוח לאומי והאסמכתאות שם (לא פורסם, 22.1.2008)).

3.אולם עתירתו של העותר אינה פרטנית אלא כללית, לביטול החוקים, ומשכך, אין ענייננו בדחיה על הסף בשל סעד חלופי העומד לעותר, אלא מנימוק אחר והוא, שהוראות סעיף 325 לחוק הביטוח הלאומי וסעיף 56 לחוק הגמלאות קדמו לחוק יסוד: כבוד האדם וחירותו. משכך, ונוכח סעיף 10 לחוק היסוד, הוא סעיף שמירת הדינים, דין העתירה להידחות על הסף. בנסיבות אלה, לא נדרשת נקיטת עמדה בשאלה האם החוקים האמורים, פוגעים בזכות החוקתית לקניין.

למעלה מן הצורך אציין כי הרציונל שבבסיס סעיפי חוק אלו הוא, כי צורכי הכלכלה הבסיסית של מקבל הקצבה – לחם לאכול ובגד ללבוש וקורת גג מעל לראשו – כל אלו מסופקים לו על ידי המדינה בהיותו אסיר, ותשלום קצבה בנוסף לכך אף מיטיב את מצבו של האסיר ממצבו של אחר שאינו אסיר (בג"צ 1163/98 שדות נ' שירות בתי הסוהר, פ"ד נה(4) 817, 836 (2001)).

4.העותר העלה בקשות נוספות, כגון "לבדוק מה היה מצב היסוד הנפשי של מציעי החוק, עד להעברתו לועדת חוקה ומשפט, וכן מה התרחש במסדרונות בהעברתו בקריאה שניה ושלישית, האם בכלל החוקים עברו הליך חוקי, ואיך חוק רגיל יכול לגבור על חוק יסוד" וכן "האם החוקים הנ"ל, הם חוקיים, או שהרעיון שחבר כנסת, הלהיב את שאר חברי הכנסת, ומבלי לבדוק את החוק, ומבלי לבדוק את ההשלכות שפוגעות בבעלי הקנין". ברי כי לבקשות מעין אלו, לא יעתר בית המשפט.

אשר על כן, העתירה נדחית על הסף.
