לפנינו עתירה המכוונת כנגד החלטת פרקליטות מחוז דרום שלא להציג לבית המשפט במסגרת הליך פלילי המתנהל נגד העותר ואחרים הסדר טיעון שהתגבש בינה לבין העותר ולבקש מבית המשפט לאמצו, זאת כל עוד לא יסכימו האחרים אף הם להסדר הטיעון.

1.כנטען בכתב העתירה, נגד העותר ושניים נוספים הוגש כתב אישום מתוקן. כעולה מכתב האישום המתוקן משרד הבינוי והשיכון התקשר עם חברת ע.ס.מ. – עפר סלילה ומאגרי מים בע"מ (להלן: החברה) בחוזה לביצוע עבודות עפר ומילוי בבאר-שבע לשם הכנת קרקע לבניית שכונה חדשה בעיר. התמורה החוזית הוגדלה במהלך ביצוע העבודות לכ-31 מיליון ש"ח. על פי החוזה היה צורך ביצירת שכבות קרקע הומוגניות בגובה של כ- 20 ס"מ, כאשר עובי האבנים בתוך השכבות אינו עולה על 10 ס"מ, תוך כדי ביצוע הידוק מבוקר הכולל הרטבת הקרקע לשם הגעה לצפיפות הנדרשת. לצורך ביצוע העבודות ובכדי להבטיח עמידה בתנאי ההסכם והמפרט הוסכם כי החברה תתקשר בחוזים עם חברת מדידות קרקע ומעבדת בדיקות קרקע. לצורך כך חתמה החברה, בין היתר, על חוזה עם חברת המדידות מילומר בע"מ (להלן: מילומר).

בחלק ניכר משטחי המילוי שפכו עובדי החברה את הקרקע לבורות ללא עיבוד נוסף. בקרקע נמצאו אבנים רבות אשר עוביין עלה על 10 ס"מ. האבנים הגיעו לעובי של עשרות סנטימטרים וחלקן אף היו עבות ממטר אחד. כמות גושי האבנים בקרקע חרגה במקרים רבים מהשיעור המקסימאלי שנקבע. גובה השכבות באזורי המילוי חרג במקרים רבים באופן ניכר מהגובה הנדרש. הקרקע לא הייתה רטובה דיה במרבית השכבות. צפיפות הקרקע במרבית השכבות הייתה נמוכה באופן ניכר מהנדרש כאשר אזורים שלמים התאפיינו בחללים גדולים ללא כל הידוק או הידוק שטחי. כתוצאה מכך נגרמו באתר נזקים שעלות תיקונם מוערכת בסכום העולה על 100 מיליון ש"ח.

במסגרת האישום השלישי, נטען כי העותר היה מודד גובה שכבות הקרקע הקבוע מטעם מילומר. בתיאום עם אנשי החברה, חנן גולן, ראובן גרינפלד ואלכס בלונוב חתם העותר ביודעין על דיווחים כוזבים באשר לגובה השכבות שמולאו ביומן הפיקוח ובכך יצר מצג שווא על פיו גובה השכבות נעשה על פי ההסכם והמפרט. במהלך שנת 1996 רשם העותר דיווחים כוזבים באשר לגובה השכבות בקלסר הבדיקות של החברה אותו ניהל מהנדס החברה אלכס בלונוב.

במעשיו גרם העותר לכך שהחברה תקבל סכומי כסף רבים במרמה בנסיבות מחמירות בשל מצגי השווא, כאשר הנסיבות המחמירות הן היקף המרמה כנגד המדינה ונזקיה. לפיכך, הואשם העותר בקבלת דבר במרמה בנסיבות מחמירות, לפי סעיף 415 סיפא לחוק העונשין, התשל"ז-1977 (להלן: החוק) וברישום כוזב במסמכי תאגיד לפי סעיף 423 לחוק. כתב האישום המתוקן הוגש נגד העותר ונגד שני נאשמים נוספים שעבדו כמודדים בחברה נוספת שהועסקה אף היא בפרויקט לצורך עמידה בתנאיו ובמפרט. כנטען, לאחר שהודו שני האחרים במיוחס להם נגזר דינם. עוד נטען כי הוגש כתב אישום נפרד כנגד החברה, חנן גולן, ראובן גרינפלד, אלכס בולונוב ואדם נוסף. הדיון בעניינם אוחד בהמשך עם עניינו של העותר.

2.עוד נטען בעתירה כי במהלך גישור שהתנהל לפני נשיא בית המשפט המחוזי בבאר-שבע ניהלו הצדדים מגעים לסיום עניינו של העותר בהסדר טיעון. נטען כי הצדדים סיכמו את פרטי ההסדר ואת האופן בו יתוקן כתב האישום שהוגש נגד העותר. עוד ציין העותר כי במהלך ניסוח טיוטת ההסדר הבהיר בא כוח המאשימה כי הצגת הסדר הטיעון לבית המשפט תעשה רק אם יסכימו האחרים להסדר. בהמשך התברר כי האחרים אינם מסכימים להסדר ומשכך המאשימה לא הסכימה להציג לבית המשפט את הסדר הטיעון שגובש עם העותר. יחד עם זאת, ציין העותר כי המאשימה השיבה לפנייתו שהיא אינה מתנגדת לערוך עמו הסדר טיעון בתנאים אחרים. העותר טוען כי התניית התקשרות עמו בהסדר טיעון בהסכמת כל האחרים אינה סבירה בנסיבות העניין ויש להורות למאשימה להציג את הסדר הטיעון כפי שגובש, ולבקש מבית המשפט לאמצו.

3.לאחר שעיינתי בעתירה על נספחיה הגעתי לכלל מסקנה כי דינה להידחות על הסף.

ראשית, שיקול דעתה של המאשימה באשר להתקשרות בהסדר טיעון עם נאשם הוא שיקול דעת רחב שבית משפט זה אינו נוטה להתערב בו אלא במקרים קיצוניים וחריגים [ראו למשל: בג"ץ 492/11 טורק נ' פרקליט המדינה (לא פורסם, 27.3.2011) (להלן: עניין טורק)] שכן "התביעה הכללית חופשית להחליט את מי להעמיד לדין ועם מי לערוך עיסקה" [ראו: בג"ץ 6350/06 אבו צעלוק נ' פרקליטות מחוז מרכז (לא פורסם, 17.8.2006)]. סבירותה של ההחלטה נבחנה בשים לב למתחם שיקול הדעת המקצועי הרחב הנתון לגורמי האכיפה [ראו והשוו: בג"ץ 1560/12 דיקן נ' פרקליטות המדינה (לא פורסם, 29.5.2012)]. לא הונחה לפני תשתית עובדתית ממנה ניתן ללמוד כי מקרה זה נמנה על אותם מקרים חריגים, כגון הנסיבות שביססו את התערבותו של בית משפט זה בעניין טורק, המצדיקים התערבות של בית המשפט בשיקול דעתה המקצועי של המאשימה, אשר רשאית להתנות את ההתקשרות בהסדר טיעון בתנאים שונים כחלק משיקול דעתה הכולל אם להתקשר בהסדר טיעון. לא זאת אף זאת, בטרם גובשה טיוטת הסדר הטיעון הבהיר בא כוח המאשימה לעותר כי הצגת טיוטת הסדר הטיעון לבית המשפט תהיה מותנית בהסכמתם של האחרים להסדר הטיעון.

שנית, העותר עצמו מודה בסעיף 28 לכתב העתירה כי בתשובה שקיבל הוא נענה כי המאשימה נכונה להתקשר עמו בהסדר טיעון, אמנם בתנאים שונים. היות שטרם נשללה האפשרות כי המאשימה תתקשר עם המערער בהסדר טיעון מדובר בעתירה מוקדמת וגם בשל כך דין העתירה להידחות. העובדה כי העותר מבקש כי ההסדר עמו יערך בהתאם לתנאי הטיוטה שגובשה זה מכבר אינה מצדיקה התערבותו של בית משפט זה שכן אין זה מתפקידו של בית המשפט להתערב בתוכנו של הסדר טיעון.

4.אשר על כן, העתירה נדחית על הסף. משלא התבקשה תגובה אינני עושה צו להוצאות.
