המשנה לנשיאה א' ריבלין:

העותרת, אלמגור – ארגון נפגעי הטרור, מבקשת כי המשיבים, ממשלת ישראל והיועץ המשפטי לממשלה, ינקטו בפעולות שימנעו את ביצועו של גזר-דין מוות שניתן, על-פי טענתה, בבית-דין של הרשות הפלשתינאית בחברון, כנגד מי שהוגדר, על-פי הנטען בעתירה, כמשתף פעולה עם מדינת ישראל. העותר הנוסף, מר יוסף מהדי, נמחק לבקשתו מן העתירה.

המשיבים מציינים כי לעתירה אין כל בסיס בדין הישראלי, וכי הסעד המבוקש בה נעדר כל בסיס משפטי בשל שהמ דובר בבקשה לנקיטת פעולות המצויות כולן בתחום שיקולי המדיניות. יחד עם זאת, מדגישים המשיבים את עמדתה הבסיסית של מדינת ישראל המתנגדת להוצאות להורג על-רקע שיתוף פעולה עם ישראל – וזאת בלא כל קשר לשאלה אם יש ממש בחשד האמור.

המשיבים מבקשים לציין כי עמדתה זו של מדינת ישראל ידועה היטב לרשות הפלשתינאית והיא הובעה בפניה לא אחת. וחשוב מכל, המשיבים הודיעונו כי על-פי בירורים שנעשו בעניין מול הצד הפלשתיני, גזר-הדין נשוא העתירה אינו עומד להתבצע. כיוון שכך, נחה דעתנו כי המשיבים אכן פועלים בדרך הראויה.

העתירה נדחית, ללא צו להוצאות.
