1.בעתירה שלפנינו, מבקש העותר כי ינתן צו על תנאי נגד המשיבה 1 "המורה לה לנמק, אם תרצה בכך, מדוע אינה מסכימה להקטנת תשלומיו החודשיים של העותר, על חשבון פיצוי שנגזר עליו לטובת המשיבים 4-2 ל-3,000 ש"ח, בהתאם ליכולתו הכלכלית המירבית, חלף הסכום החודשי, בסך של 9,387 ש"ח, האמור להיות משולם ע"י העותר, החל מיום 25.6.2013".

רקע עובדתי

2.העותר השתחרר לאחרונה ממאסר בן שמונה שנים. לטענתו, מאז שחרורו מנסה הוא לנהל אורח חיים נורמטיבי, ובכלל זה לפרנס את משפחתו. עוד הוא מציין כי אשתו אינה עובדת, ומקבלת קיצבת הבטחת הכנסה מהמוסד לביטוח לאומי.

3.לעותר חוב בגין פיצויים בסך של כ-105,000 ש"ח לשלושה נפגעי עבירה במסגרת גזר דין שניתן נגדו. במסגרת זאת, הוא מציין כי בגין חובות אלו ואחרים שילם סכום בסך של 66,000 ש"ח, וכי סך חובו עומד על סכום של 99,489 ש"ח. כמו כן, הוא טוען כי המשיב 1 החליט ביום 13.2.2013 כי החוב הנותר ישולם בשלושה תשלומים שווים על סך של 5,000 ש"ח כל אחד, ותשעה תשלומים על סך של 9,387 ש"ח כל אחד. לטענתו, "תוך חריקת שיניים נטילת הלוואות", עמד בתשלום שלושת התשלומים על סך 15,000 ש"ח, אולם אין ביכולתו לעמוד בתשלום החודשי הגבוה בסך של 9,387 ש"ח. לטענתו, הסכום נקבע על אף שהמציא מסמכים המעידים על יכולת כלכלית דלה. כמו כן, הוא טוען כי המשיבה 2 (אחת מהמתלוננות לה נפסקו פיצויים) הסכימה לבקשתו לפריסת התשלומים לסכום של 1,500 ש"ח בחודש, וביכולתו לשלם כל חודש עוד 1,500 ש"ח בגין הקנסות והחובות הנוספים (סכום כולל של 3,000 ש"ח מדי חודש). לטענתו, אין ביכולתו לעמוד בתשלומים שקבע המשיב 1, ואי קבלת העתירה תביא להפעלת תנאי הנקבע בגזר הדין ושליחתו למאסר בפועל של 18 חודשים.

4.המשיב 1 טוען כי דין העתירה להידחות על הסף נוכח אי מיצוי הליכים. לטענתו, העותר הגיש בקשה לפריסת הפיצויים שנגזרו עליו למתלוננים במסגרת ההליך הפלילי שהתנהל נגדו, ואושר לו כאמור בעתירה תשלום הפיצויים ב-12 תשלומים. לטענתו, "ההסדר האמור לפריסת חובותיו של העותר בתיק הפיצויים נקבע תוך התחשבות, בין היתר, בנסיבותיו האישיות של העותר ובבקשותיו של העותר, כפי שעלו בשיחות למול באי-כוחו דאז" (סעיף 8 לתגובה). כמו כן, מצוין כי העתירה הוגשה ימים ספורים טרם המועד שנקבע לתשלום הראשון על סך 9,387 ש"ח (קרי – התשלום הרביעי לאחר שלושה תשלומים על סך 5,000 ש"ח), "זאת, מבלי שהקדים ופנה למרכז לגביית קנסות בבקשה לפריסה שונה של התשלומים בתיק הפיצויים כמבוקש בעתירה דנן" (סעיף 9 לתגובה). עוד מציין המשיב כי לאחר שנדחתה בקשתו במסגרת העתירה לצו ביניים (החלטה מיום 20.6.2013) ולעיון חוזר בהחלטה זו (החלטה מיום 28.7.2013), שילם העותר את התשלום הראשון על סך 9,387 ש"ח, אך מאז לא עמד ביתר התשלומים.

דיון והכרעה

5.דין העתירה להידחות על הסף, נוכח העדר מיצוי הליכים. העותר פנה תחילה אל המשיב 1 בבקשה לפריסת חוב הפיצויים שנגזר עליו, ואושר לו לשלמו ב-12 תשלומים, כמפורט לעיל. אולם, נוכח אי יכולתו, לטענתו, לעמוד בתשלומים אלה, פנה בעתירה לבית משפט זה, מבלי לפנות למשיב 1. יודגש, חובת מיצוי הליכים אינה דרישה טכנית בלבד אלא מהותית, אשר מצדיקה בנסיבות דנן את דחיית העתירה על הסף. זאת, נוכח העובדה הפשוטה כי קיים סיכוי רב כי פנייה מוקדמת למשיב 1 הייתה מייתרת הגשת עתירה זו. ויוזכר - פנייתו הראשונה בעניין זה ממש נענתה בחיוב (ראו: בג"ץ 10312/05 כהן נ' בן שלמה (6.11.2005); בג"ץ 6731/12 שמיר נ' היועץ המשפטי לממשלה (18.6.2013)).

6.עוד נציין כי העותר לא צירף לעתירתו שניים מתוך שלושת המתלוננים שלזכותם נפסק הפיצוי בגין העבירה בה הורשע, ויש בטעם זה בלבד כדי להביא לדחיית העתירה על הסף (ראו: בג"ץ 4376/12 שיבלי נ' המרכז לגביית קנסות (24.6.2013)). אמנם, עיון בעתירה מראה כי באחד מגלגוליה כללה היא עוד שני משיבים, אולם לבסוף בחר העותר להשחירם ולא לצרפם כמשיבים לעתירה, מסיבות השמורות עימו.

7.סוף דבר - העתירה נדחית על הסף. בנסיבות העניין, אין צו להוצאות.
