בעקבות המלצתנו הגיעו הצדדים להסכמה לפיה יינתן רישיון לאסיפה שתיערך על ידי העותרים כ- 50 מטר צפונית לנקודה הקיצונית אליה הגיעה התהלוכה שנערכה ביום 24.3.09, בתחומה של אום-אל-פחם. עוד הוסכם כי האסיפה תיערך זמן קצר לאחר חגי תשרי, כמובן לאחר תאום מראש של המועד. כמו כן הוסכם כי כל צד שומר על טענותיו.

רשמנו לפנינו את הסכמתם של בעלי הדין ומשכך נתייתרה העתירה ואנו מחליטים למוחקה.
