1.העותר, חשמלאי במקצועו תושב האזור, מבקש היתר להנפקת כרטיס מגנטי לצורך כניסה לשטח המדינה ועבודה בתחומה אצל מעסיק מסוים. בקשתו סורבה מטעמים ביטחוניים שלא נמסרו לו, מן הנימוק שמ דובר במידע חסוי. ומכאן העתירה.

2.לטענת העותר, החלטת המשיבים נגועה בחוסר סבירות ושרירות, ולפיכך היא מהווה החלטה מנהלית פגומה. מנגד, טוענים המשיבים כי דין העתירה להידחות על הסף בהעדר עילה, שכן לא מוקנית לעותר זכות שבדין לעבוד בישראל. כמו כן, מוסיפים המשיבים לגופה של עתירה כי ההחלטה בעניינו של העותר התקבלה בצורה תקינה, במסגרת כללי המינהל, וכי גורמי הביטחון סבורים שכניסת העותר לישראל עלולה לסכן את שלום הציבור. כן נטען כי גם לולא המניעה הביטחונית, לא היה זוכה העותר בכרטיס מגנטי, כיוון שאינו עומד באמות המידה המקובלות לקבלת היתר כניסה לישראל. מוסיפים המשיבים וטוענים כי שיקול הדעת המוקנה לרשויות בעניין זה הוא רחב, ואין עילה להתערב בו בענין זה.

3.דין העתירה להידחות על-הסף. הלכה היא שאין לתושב האזור זכות שבדין להיכנס לישראל, ולא כל שכן לעבוד בתחומה [בג"ץ 739/06 תעאמרה נ' מפקד כוחות צה"ל בגדה המערבית, תק-על 2006(3) 790; בג"ץ 7475/05 כעאבנה נ' מפקד כוחות צה"ל בגדה המערבית, תק-על 2005(3) 2662; בג"ץ 2875 /06 כואזבה נ' שר הביטחון תק-על 2006(2) 4729]. מטעם זה אין לעותר גם עילה לדרוש כי בית המשפט זה יבחן את צדקת החלטת המשיבים שלא להעניק לו היתר כניסה לישראל, כאשר על פני הדברים, לא עולה חשש לשימוש פסול בשיקול הדעת המינהלי [בג"ץ 6662/00 חדאד נ' שר הביטחון, תק-על 2001(2) 3]. יתר על כן, לגופם של דברים ולאור שיקול דעת הרחב הנתון לגורם המוסמך, לא מצאנו כי העתירה מגלה עילה להתערבות שיפוטית בהחלטת המשיבים [בג"ץ 4283/06 אוסטה נ' מדינת ישראל-משרד הביטחון תק-על 2006(2) 4247].

אשר על כן, אנו דוחים את העתירה על-הסף.
