פסק-דין

השופטת א' פרוקצ'יה:

1.עתירה כנגד פסק דין של בית הדין הארצי לעבודה, שדחה את ערעור העותר שתכליתו להוסיף תוספות שכר מסוימות ל"משכורת הקובעת" לצורך חישוב הפנסיה המגיעה לו.

2.העותר עבר בעיריית רמלה בין השנים 2000-1981 כנהג, ולאחר מכן כמנהל עבודה באגף התברואה של העירייה. הוא הגיש תביעה לפסק דין הצהרתי בבית הדין האזורי לעבודה, אשר יקבע כי התוספות "פריון עבודה", "תוספת רחיצה" ו"גילום הוצאות רכב" אשר שולמו לו לאורך כל שנות עבודתו הינן חלק ממשכורתו הקובעת לצורך חישוב הפנסיה לה הוא זכאי. כמו כן, נתבקשה הכרה דומה ב-50% מהתשלום בגין שעות נוספות שבוצעו בפועל על ידי העותר.

3.העותר הועסק על ידי עיריית רמלה מפברואר 1981 ועד 9.11.00, עת פרש לפנסיה מוקדמת בעקבות פסק בורר. לאחר פרישתו, התברר לו כי התוספות האמורות אינן נכללות בחישובי הפנסיה, אף ששולמו לו במהלך כל תקופת עבודתו.

4.בית הדין האיזורי לעבודה, פסק כי העותר לא הרים את נטל ההוכחה להוכיח מבחינה עובדתית כי התוספות אותן הוא מבקש להוסיף כרכיב לצורך פנסיה, שולמו לו ללא תנאי. על פי פסק הדין, הכלל הוא כי רק תוספות קבועות שהוגדרו כחלק מהמשכורת הקובעת, ייכללו בחישובי הפנסיה של עובדי מדינה מכח חוק שירות המדינה (גמלאות) (נוסח משולב), תש"ל-1970. במקרה זה שוכנע בית הדין האיזורי כי התשלומים שולמו לתובע כתשלום מותנה בתנאים. בהסכם משנת 1982 בין עיריית רמלה לעובדים סוכם במפורש כי תוספות אלה לא יהיו חלק מהשכר הקובע, אלא ישולמו רק בגין עבודה בפועל, והדבר קיבל אישור בהסכם עבודה נוסף משנת 90. התשלומים לעותר שולמו כולם בכפוף לתנאים מסוימים, ולכן הם אינם חלק מהמשכורת הקובעת לצורך חישוב הפנסיה. לאור קביעות אלה, בית הדין דחה את התביעה.

5.בית הדין הארצי לעבודה דחה את ערעורו של העותר. הוא התייחס להסכמים בין העירייה לעובדים ואימץ את קביעת בית הדין האזורי לפיה העותר לא הוכיח שהתוספות שולמו לו ללא תנאי, ולפיכך קבע כי הן בגדר תוספות שאינן נכללות במשכורת הקובעת לצורך חישוב הפנסיה. לאור הקביעה העובדתית בדבר מהותן של התוספות, ולמקרא שני ההסכמים המסדירים הענקת תוספות שכר שאינן חלק מהמשכורת הקובעת לצורך חישוב הפנסיה, החליט בית הדין הארצי לדחות את הערעור.

6.על פסק דין זה הגיש העותר את עתירתו בפנינו, בה הוא טוען כי בית הדין הארצי טעה טעות משפטית מהותית בהחלטתו, באופן שנגרם לו עוול המצדיק התערבות בית משפט זה. כן הוא טוען כי מ דובר בשאלה בעלת אופי עקרוני כללי המשפיעה על ציבור גדול של עובדים בישראל, ויש מקום לבחון אותה בבית משפט זה.

7.עיקר טענתו של העותר בעתירתו היא כי בפסק דין זה סטה בית הדין הארצי מפסיקה קודמת שלו עצמו בע"ע 300312/97 נחמני נ' עיריית באר-שבע. באותו ענין נקבע, על פי הנטען, כי המבחן הקובע לצורך השאלה האם תוספות שכר נכללות בחישוב הפנסיה הוא האם התוספת ניתנה במסגרת העבודה הרגילה והיומיומית של העובד, וזאת גם אם בהסכמי העבודה הוסכם שתוספות אלו לא ייחשבו כחלק מן השכר הקובע.

8.המשיבה 2 טוענת כי בית הדין הארצי לעבודה לא חידש הלכה או סטה מהלכה קיימת בפסק הדין נשוא העתירה אלא קבע על פי הממצאים העובדתיים שהיו בידיו כי התוספות אותן מבקש העותר לכלול בחישוב הפנסיה הן תוספות המותנות בתנאי ולכן הן אינן נכללות בחישוב כאמור. כן מוסיפה המשיבה וטוענת כי הסטייה מפסק הדין נחמני ארעה כבר בעבר, ומכל מקום, בית הדין הסביר את הסיבות לסטייה במקרה זה. המשיבה מוסיפה כי גדר ההתערבות של בית המשפט בפסקי דין של בית הדין הארצי מצומצם ביותר, ובמיוחד בהחלטות העומדות בלב יחסי העבודה, עליהן נמנה מקרה זה.

9.דין העתירה להידחות על הסף.

שופטי בית הדין הארצי לעבודה היו מאוחדים בדעה כי מקום שהוכחה הסכמת צדדים להסכם עבודה כי תוספות מסוימות בשכר לא תיכללנה ב"משכורת הקובעת" לחישוב הפנסיה, יש לתת לכך נפקות מלאה. לעמדה זו היה שותף גם כב' השופט רבינוביץ, אשר על פסק דינו בעניין ע"ע 300312/97 נחמני נ' עריית באר-שבע (פד"ע לו, 251) הסתמך העותר בעתירתו.

במישור העובדתי, בית הדין האזורי קבע כי אכן ההסכמים מ-83 ו-90 התכוונו שלא לכלול את תוספות השכר הנדונות במסגרת חישוב הפנסיה. בית הדין הארצי אימץ קביעה זו, וכן קבע, כבית הדין האזורי, כי מ דובר בתוספות מותנות שעל פי טיבן אינן נלקחות בחשבון בחישוב הפנסיה.

קביעת בתי הדין לעבודה עולה בקנה אחד עם ההלכה הפסוקה המקובלת ואינה סותרת אותה, ובאשר לקביעות העובדתיות שבהחלטותיהם – גם בהן אין עילה להתערב.

בנסיבות אלה, לא קמה כל עילה להתערבות בפסיקת בית הדין לעבודה, ודין העתירה להידחות על הסף (בג"צ 525/84 חטיב נ' בית הדין הארצי לעבודה, פ"ד מ(1) 673; בג"צ 7029/95 ההסתדרות הכללית החדשה נ' בית הדין הארצי לעבודה, פ"ד נא(2) 63, 88; בג"צ 3400/98 אילנה בן עזרא נ' בית הדין הארצי לעבודה).

העתירה נדחית על הסף, איפוא.
