השופטת א' פרוקצ'יה:

1.עניינה של עתירה זו בהחלטת בית המשפט המחוזי בתל אביב-יפו (כב' השופט כבוב חאלד) לדחות טענות מקדמיות שהעלה העותר במסגרת הליך פלילי המתנהל נגדו.

2.בבית המשפט המחוזי בתל אביב – יפו מתנהל הליך פלילי כנגד העותר (ת.פ 40036/06). בכתב האישום שהוגש במסגרת אותו הליך מואשם העותר, יחד עם נאשמים נוספים, בשורת עבירות שעניינן מעשים בלתי חוקיים אשר בוצעו תוך כדי פעילותה העסקית של חברה אשר הקימו העותר ואשתו בשנת 1999. על פי כתב האישום, במהלך התקופה שבין חודש ינואר 2000 לבין חודש דצמבר 2003 הבריח העותר מיליוני סיגריות אל תחומי האיחוד האירופי, מבלי לדווח על כך לרשויות ומבלי לשלם על כך מיסים והיטלים כדין. על פי כתב האישום, השתמש העותר בפעילות היצוא והיבוא של החברה שהקים על מנת להעביר לישראל, במסווה של פעילות לגיטימית, כספים אותם קיבל כתוצאה מהברחת הסיגריות. בשל מעשים אלה מואשם העותר בעבירות של זיוף, זיוף בנסיבות מחמירות, שימוש במסמך מזויף, רישום כוזב במסמכי תאגיד, הלבנת הון, עשיית פעולה ברכוש אסור, הפרת חובת דיווח ואי הגשת דין וחשבון במועד.

3.במסגרת ההליך בבית המשפט המחוזי העלו הנאשמים, והעותר בתוכם, מספר טענות מקדמיות. הטענה המקדמית העיקרית שלה טען העותר, יחד עם נאשם נוסף, הינה טענת סיכון כפול שעניינה "כבר הורשעתי", אותה ביסס על פסק דין אשר ניתן נגדו בבית משפט בבלגיה, ושעליו הגיש ערעור לערכאה גבוהה יותר שם. בהחלטה מיום 23.4.07 דחה בית המשפט המחוזי טענה מקדמית זו, ועל כך מוגשת העתירה שלפנינו.

החלטת בית המשפט המחוזי

2.בית המשפט המחוזי פירט שני תנאים הנדרשים לשם החלת טענת "כבר הורשעתי" (או "כבר זוכיתי") שמקורה בסעיף 5 ובסעיף 149(5) לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב - 1982. התנאי הראשון הינו קיומו של פסק דין, שבהעדרו אין כל בסיס לטענה. התנאי השני הוא, כי פסק הדין יתייחס ל"אותו מעשה". במסגרת בחינת התקיימותו של התנאי השני, ציין בית המשפט המחוזי כי יש לבחון תחילה את זהות המעשה הפיזי ורק כאשר קיימת זהות במעשה הפיזי, תיבחן גם זהות היסוד הנפשי, בהתאם להגדרת העבירות בחוק (עמוד 4 להחלטת בית המשפט המחוזי).

בית המשפט המחוזי קבע כי בענין שלפניו לא מ דובר ב"אותו מעשה" שכן האישומים שהנאשמים ניצבים בפניהם בהליך הפלילי בישראל שונים מן האישומים בפניהם ניצבו בהליך בבלגיה. כמפורט בהחלטת בית המשפט המחוזי, האישומים העיקריים בהם הואשמו הנאשמים בהליך בבלגיה הינם חברות בארגון פשע, הלבנת הון והפרת זכויות יוצרים. בית המשפט המחוזי קובע כי האישום היחידי שהוא זהה להליך בבלגיה ולהליך המתנהל בישראל הינו האישום בדבר הלבנת הון, אלא שעבירת הלבנת ההון שיוחסה לנאשמים בבלגיה מתייחסת להלבנת ההון שבוצעה שם, בעוד שבישראל הואשמו הנאשמים בעבירות הלבנת הון אשר בוצעו בישראל ולכן מ דובר במעשים שונים (עמוד 8 להחלטת בית המשפט המחוזי).

3.כן קבע בית המשפט המחוזי כי יש לפרש את סעיף 2 לחוק איסור הלבנת הון, התש"ס- 2000 (להלן: חוק איסור הלבנת הון) באופן המאפשר העמדה לדין בבית משפט בישראל בגין עבירות הלבנת הון שבוצעו בשטח ישראל, אשר עבירות המקור להן בוצעו מחוצה לה, גם אם הוגש כתב אישום בגין עבירות מקור אלה במדינה שבה הן התבצעו.

4.לבסוף, קבע בית המשפט המחוזי כי בכל מקרה, בהתאם להוראות החוק והפסיקה בדבר עבירה שבוצעה כולה או מקצתה בישראל, לא תעמוד לנאשם טענת "כבר הורשעתי" כאשר מעשה השיפוט הראשון נעשה במדינה אחרת, ולא בישראל.

לאור נימוקים אלה, קבע בית המשפט המחוזי כי אין לקבל את הטענה המקדמית שהעלה העותר, ולכן אין מניעה מלהעמידו לדין בישראל. כן דחה טענות נוספות אשר העלה העותר בפניו.

טענות העותר

5.לטענת העותר, שגה בית המשפט המחוזי כאשר קבע כי פסק הדין שניתן בבלגיה וכתב האישום שהוגש בישראל, אינם עוסקים ב"אותו מעשה". לטענתו, קביעה זו נתקבלה מבלי שבית המשפט בחן באופן מעמיק את הבסיס העובדתי של כתב האישום בבלגיה ומבלי שנעשתה התייחסות להגדרות הספציפיות והמיוחדות הקיימות בחוק איסור הלבנת הון. לטענתו, בית המשפט הסתמך, בין היתר, על מידע חלקי ולא ממצה, הכולל הצהרות לא מדויקות אשר הוצג לו על ידי נציגי הפרקליטות.

העותר טוען כי נדרשת התערבותו של בית משפט זה מאחר ומ דובר בטעות משפטית

מהותית, בנושא עקרוני ובעל השלכות רחבות. לטענתו, מ דובר במקרה שנסיבותיו קיצוניות, שכן אין לעותר אפשרות להשיג על דחיית טענתו המקדמית, אלא בתום ההליך. אם ייאלץ להמתין עד לתום ההליך על מנת להשיג על החלטה זו, ייגרם לו עינוי דין חריג ומשמעותי, שכן מ דובר במקרה בעל היקף נרחב אשר שמיעתו עשויה להימשך זמן רב.

במסגרת עתירה זו מבקש העותר כי בית משפט זה יבטל את החלטת בית המשפט המחוזי ויחייב את המדינה להבהיר מהי עבירת המקור שבגינה הוא מועמד לדין, והאם קיימת חפיפה בין המעשה המהווה בסיס להעמדה לדין בישראל, לבין המעשה שבגינו הועמד לדין בבלגיה. כן מבקש העותר כי נורה לבית המשפט המחוזי להמציא את מלוא התיעוד והחומר אשר הומצא על ידי משרד המשפטים, במסגרת ההליך בבלגיה. לבסוף, מבקש העותר כי נורה לבית המשפט המחוזי, במסגרת צו ביניים, שלא לקדם את ההליכים בעניינו עד לתום בירור טענותיו.

הכרעה

6.דין העתירה להידחות על הסף. החלטת בית המשפט המחוזי, לפיה נדחתה הטענה המקדמית אשר העלה העותר, מהווה החלטת ביניים במסגרת ההליך הפלילי המתנהל נגדו. ככלל, אין עומדת לבעל דין האפשרות לערער, לא בזכות ולא ברשות, על החלטות ביניים אשר ניתנו במסגרת הליך פלילי. טענה כנגד החלטת ביניים אשר ניתנה בהליך פלילי מקומה להתברר, דרך כלל, רק לאחר שנסתיים אותו הליך ובמסגרת ערעור, אם מוגש כזה, על פסק הדין אשר ניתן בו. אין לאפשר עקיפת כלל זה בדרך של פנייה לבית המשפט הגבוה לצדק. מכאן ההלכה הידועה לפיה, בית המשפט הגבוה לצדק לא יתערב בהחלטות ביניים שניתנו במסגרת הליך פלילי, למעט במקרים יוצאי דופן ובהם – כאשר עולה טענה של העדר סמכות, או אם מתגלה תופעה קיצונית של שרירות בתחום שהוא מינהלי טהור, ואפשר אף במקרים חריגים וקיצוניים אחרים (בג"ץ 1348/07 שלם נ' מדינת ישראל (טרם פורסם, ניתן ביום 1.4.07); בג"ץ 2360/05 פלד נ' פרקליטות מחוז תל-אביב - פלילי, תק-על 2005(1), 3624; בג"ץ 9663/02 עכאווי נ' פרקליטות מחוז חיפה, תק-על 2002(4), 162; בג"ץ 583/87 הלפרין נ' כב' סגן נשיא בית המשפט, פ"ד מא(4), 683).

מקרה זה אינו נמנה על המקרים החריגים ויוצאי הדופן המצדיקים התערבות של בית

המשפט הגבוה לצדק בהחלטת ביניים שניתנה במסגרת הליך פלילי. טענות העותר הועלו בפני בית המשפט המחוזי, אשר בחן אותן והכריע בהן לגופן, בהחלטה מפורטת ומנומקת. נכון הוא כי דחיית הטענה המקדמית שהעלה העותר, משמעותה היא כי יתקיים הליך פלילי בעניינו, ורק לאחר מכן יוכל הוא, אם יינתן פסק דין נגדו, לערער על החלטה זו. יחד עם זאת, אין בעובדה זו, כשלעצמה, כדי להוות נסיבה חריגה המצדיקה התערבות בהחלטת בית המשפט המחוזי. לא מצאנו כי מתקיימות נסיבות חריגות אחרות המצדיקות התערבותנו בהחלטה שניתנה בבית המשפט המחוזי.

לאור האמור, העתירה נדחית על הסף, ועמה גם הבקשה למתן צו ביניים.
