פסק-דין

הנשיא א' גרוניס:

1.עניינה של העתירה בהחלטות המשיבים – היועץ המשפטי לממשלה, מפקד פיקוד העורף, שר הפנים ומפקד אזור יהודה והשומרון – להאריך בשנה, מחודש מאי 2013, צווים המוטלים על העותר, מרדכי ואנונו (להלן – העותר). הצו הראשון, צו הצמצום וההשגחה, שהוצא לפי תקנות 108, 109 ו-110 לתקנות ההגנה (שעת חירום), 1945 (להלן – צו הצמצום וההשגחה) מטיל על העותר שורה של הגבלות ובהן, לא להחליף מקום מגורים אלא אם יודיע על כך 48 שעות מראש; לא להימצא בטווח של 500 מטר ממקומות מוגדרים, דרכם ניתן להגיע אל מחוץ לישראל; לא להיכנס לאחת הנציגויות הדיפלומטיות הזרות בישראל; לא לקיים קשר כלשהו עם אזרחים או תושבים זרים או להשתתף בצ' טים באינטרנט, ללא קבלת אישור בכתב מראש; ולא למסור מידע מסווג שהגיע לידיעתו מתוקף עבודתו בקריה למחקר גרעיני, גם אם מסר בעבר מידע כזה. הצו השני הוצא מכוח תקנה 6 לתקנות שעת חירום (יציאה לחוץ לארץ), התש"ח-1948, והוא אוסר על העותר לצאת מן הארץ. הצו השלישי הוצא מכוח הצו בדבר שטחים סגורים (יהודה ושומרון) (מס' 34), התשכ"ז-1967 והיתר כניסה כללי (מס' 5) (תושבים ישראלים ותושבי חוץ) (יהודה ושומרון), התש"ל-1970. צו זה אוסר על העותר להיכנס לאזור יהודה ושומרון, אלא בהיתר פרטני. הצווים הוצאו לראשונה עם שחרורו של העותר ממאסר בשנת 2004, ומאז מוארכים מדי שנה. בשנת 2007 הורשע העותר בגין הפרות של הצווים ובניסיון להפר אותם.

2.זו הפעם השביעית שבית משפט זה נדרש לסוגיית הארכת הצווים המגבילים המוטלים על העותר (לעתירות קודמות ראו: בג"ץ 5211/04, בג"ץ 6358/05, בג"ץ 4624/06, בג"ץ 6565/08, בג"ץ 6767/10, בג"ץ 5296/11). הרקע להטלת הצווים הוא הרשעתו של העותר בעבירות נגד ביטחון המדינה, שעיקרן מסירת מידע סודי על פעילות הקריה למחקר גרעיני (קמ"ג) לגורמים שלא היו מוסמכים לקבלו. העותר נדון ל-18 שנות מאסר. לקראת מועד שחרורו, התעורר החשש שמא יפגע בביטחון המדינה, ועל כן, הוטלו עליו הגבלות שונות במסגרת צווים דומים לאלה הנדונים בעתירה. העותר טוען לפנינו, בדומה לטענות שהועלו בעתירות קודמות בעבר, כי הממד המהותי של חלוף הזמן, מאז בוצעו העבירות בגינן הורשע, לא נשקל על ידי המשיבים. לפי הטענה, לחלוף הזמן יש השלכה משמעותית על שאלת מסוכנותו של העותר, המוכחשת על ידו. זאת במיוחד בהתחשב בעובדה שמאז שחרורו של העותר פורסם מידע עדכני ביחס ליכולותיה הגרעיניות של ישראל, אשר "עולה לאין ערוך" על כל מה שיוכל העותר להוסיף כיום. לטענת העותר, הגם שבעבר הורשע בגין הפרת הצווים הנדונים בעתירה, חל שינוי מהותי בנסיבות חייו והוא אינו מפר עוד את המגבלות שהוטלו עליו, אינו מנהל קשרים עם התקשורת ואינו פועל בשרות גופים בעלי אג' נדה פוליטית או אחרת. העותר טען בנוסף כי הצווים המגבילים פוגעים בשורה של זכויות יסוד, ובהן זכותו לחירות ולפרטיות, זכותו לחופש ביטוי, לחופש תנועה ולחופש דת. לפי הנטען, הפגיעה בזכויות היסוד אינה עומדת בתנאי פיסקת ההגבלה, ובפרט, אינה מידתית. בפועל, טען העותר כי הצווים מהווים אמצעי ענישה נוסף על כליאתו בעבר.

3.בתגובה ארוכה ומפורטת תיארו המשיבים את השתלשלות האירועים מאז שחרורו של העותר ממאסר, ובכלל זה את החומר העובדתי שעמד ביסוד כל אחת מן ההחלטות להאריך את תוקף הצווים המגבילים בשנים האחרונות. לטענתם, השתלשלות אירועים זו מבססת את החשש – הקיים גם כיום – כי העותר עודנו מחזיק במידע מסווג שטרם פורסם וכי בכוונתו לפעול לפרסום מידע זה. בתגובתם ציינו המשיבים כי בתחילת שנת 2013 נפגש היועץ המשפטי לממשלה עם באי-כוחו של העותר, שביקשו לשכנעו כי אין עוד מקום להארכה של הצו האוסר על יציאה מן הארץ. היועץ המשפטי לממשלה שקל את הבקשה אך לא מצא לנכון להיעתר לה. זאת, נוכח המידע שהוצג לו על ידי גורמי הביטחון, ובהתחשב בכך שהעותר ממשיך להפר בשיטתיות את צו הצמצום וההשגחה.

4.בתגובה בכתב ובדיון בעל פה סקרו המשיבים את חומר הראיות הגלוי, המבסס את הטענה לפיה יש בידי העותר מידע חסוי שטרם פורסם ויש לו כוונה לפעול לפרסום מידע זה. בין היתר פירטו המשיבים אודות מכתבים ששלח העותר לאישים שונים וכן מחברות שכתב בתקופת מאסרו. מידע זה הוצג בפני בית המשפט גם בעתירות הקודמות. כמו כן התייחסו המשיבים להפרות צווים מן השנה האחרונה. במהלך הדיון לפנינו הציגו המשיבים גם חומר חסוי במעמד צד אחד. החומר החסוי, שמטבע הדברים לא ניתן לפרטו, התייחס אף הוא למידע שבידי העותר ולאפשרות שיפעל להפצת מידע זה וכן להפרות חוזרות ונשנות של צו הצמצום וההשגחה.

5.לאחר שבחנו את החומר הרב שהוגש לבית המשפט, שוכנענו כי לא קיימת עילה להתערב בהחלטות המשיבים להאריך את תוקפם של הצווים בשנה נוספת. אין מחלוקת על כך שהצווים פוגעים בזכויותיו של העותר ומטילים מגבלות משמעותיות על חיי היומיום שלו. אין גם מחלוקת על כך שחלף פרק זמן ממושך מאז שהעותר סיים לרצות את עונש המאסר שנגזר עליו, ועדיין נדרש הוא לנהל את חייו בהתאם להגבלות שבצווים. אולם, אין לומר כי הצווים מהווים אמצעי ענישתי, כפי שטען העותר. הצווים נועדו להבטיח מניעה עתידית של הפצת מידע מסווג. בשנים האחרונות בחן בית המשפט מספר פעמים את נחיצותם של הצווים, ושוכנע, פעם אחר פעם, שהם דרושים להגנה על ביטחון המדינה. חומר הראיות הגלוי והחסוי שהוצג לבית המשפט בעתירה שלפנינו, כמו גם בעתירות הקודמות, מצביע על כך שהעותר עודנו אוצֵר מידע חסוי והוא לא נסוג מכוונתו להפיץ את המידע. בנסיבות אלה, יש ממש בטענה לפיה אין מקום לצמצם את הצווים או למנוע את הארכתם בשנה נוספת. לזאת יש להוסיף כי בסוף שנת 2010 בוטלו שתי מגבלות שהושתו על העותר מיום שחרורו, והן החובה להודיע מראש למפקד תחנת משטרה לפני שהוא יוצא מאזור מגוריו וכן לפני שילון מחוץ לביתו. יש להניח כי הייתה בכך ולוּ הקלה מסוימת. עוד נוסיף כי ניכר מחומר הראיות שחלק הארי של הפרות הצווים על ידי העותר מתייחס למפגשיו עם זרים. כפי שצוין בתגובת המשיבים, צווי ההגבלה אינם אוסרים על העותר להיפגש עם אזרחים ותושבים זרים, אלא מחייבים אותו לקבל אישור לכך מראש. במשך תשע שנים ביקש העותר אישור כאמור בשני מקרים בלבד, ושניהם אושרו. טוב יעשה העותר אם יפעל בדרך שהותוותה בצו טרם קיום מפגשים עם זרים. בכך יוכל להרחיב את מעגל האנשים עימם עומד הוא בקשר, ואף למנוע הפרות חוזרות ונשנות של הצווים, הפוגעות ביכולתם של המשיבים לתת אמון בעותר ובכוונותיו. נשוב בהקשר זה על דברי בית המשפט בעתירת העותר בבג"ץ 6767/10 כי "מי שמפר צווים – אינו זכאי לסעד מבית המשפט הזה" (השופטת מ' נאור).

מקובלת עלינו עמדת באי-כוח העותר לפיה יש צורך לבחון כל פעם מחדש את נחיצות הצווים, וכי בחינה כאמור חייבת להתחשב במימד של חלוף הזמן. חזקה על המשיבים כי עשו כן בכל אחת מהארכות הצווים בשנים האחרונות. בחינה זו הכרחית כדי להבטיח שהפגיעה בזכויותיו של העותר היא מידתית ואינה עולה על הנדרש בהתחשב בידע שבידיו ובמוטיבציה שלו להפיץ מידע זה. חומר הראיות שהוצג בפנינו מצביע שכך נעשה גם במקרה הנוכחי. בנסיבות אלה, לא ראינו מקום להיעתר לעתירה והיא נדחית.
