ככל שניתן להבין מן העתירה שבפנינו, העותר המייצג את עצמו, עותר כנגד החלטת המשנה לפרקליט המדינה אשר דחתה ערר שהגיש על החלטת המחלקה לחקירת שוטרים לסגור תיק תלונה שהגיש העורר בגין אלימות שהופעלה כנגדו, לטענתו, על ידי לוכדי עריקים ביום 15.1.2001.

ממכתבו של המשיב 2 מיום 22.5.2011 אשר צורף לעתירה, עולה כי המדובר באירוע שהתרחש לפני למעלה מ-10 שנים, וכי פנייתו הראשונה של העותר בנושא הייתה אך בחלוף 9 שנים. עוד נמצאנו למדים מהמכתב, כי בדומה לעתירה הסתומה שבפנינו, גם פנייתו של העורר למחלקה לחקירת שוטרים הייתה כללית ולא מפורטת ולא גובתה בתיעוד רפואי כלשהו.

בנסיבות אלה, כאשר כתב העתירה סתום ואינו מובן, ובשים לב לשיהוי הניכר מאז האירוע הנטען (בהנחה שהמדובר באירוע מושא המכתב שצורף לעתירה), אנו מורים על מחיקת העתירה על הסף.
