עתירה כנגד פסק דינו של בית הדין הארצי לעבודה בע"ר 1173-04-11, בגדרו נדחה ערעורו של העותר על החלטת רשם בית הדין הארצי לעבודה לפיה נדחתה בחלקה בקשתו למחיקה על הסף של ערעור שכנגד.

1.העותר הגיש בבית הדין האיזורי לעבודה תביעה כנגד מעסיקתו לתשלום גמול בגין שעות נוספות ועבודה בימי שבת וחג, לתשלום הפרשי הוצאות נסיעה, ולפיצוי בגין פיטורים שלא כדין. התביעה נתקבלה בחלקה לגבי גמול עבור שעות נוספות ועבודה בימי שבת וחג, כן נפסק לעותר פיצוי בגין פיטורים בהיעדר הליך שימוע ונדחתה תביעתו לתשלום החזר הוצאות נסיעה.

העותר הגיש ערעור לבית הדין הארצי לעבודה כנגד דחיית חלק מהתביעה לתשלום בגין שעות נוספות ובגין עבודה בימי שבת וחג. המשיבה 2 הגישה ערעור שכנגד לגבי חלק התביעה שנתקבל.

העותר הגיש בקשה למחיקה על הסף של הערעור שכנגד והרשם נעתר לחלק מהבקשה על פי הלכת הזיקה העניינית בין הערעור והערעור שכנגד.

על החלטת הרשם הגיש העותר ערעור לבית הדין הארצי לעבודה, אשר דחה את הערעור וקבע בפסק דינו כי הרשם צדק בהחלטתו משקבע כי קיימת זיקה עניינית בין הערעור שכנגד לערעור העיקרי.

2.על פסק דין זה נסבה העתירה שבפנינו המשתרעת על 17 עמודים, ובה נטען כי פסק דינו של בית הדין הארצי לעבודה מהווה פריצה של גבולות הזכות להגשת ערעור שכנגד.

3.דין העתירה להידחות על הסף. מן המפורסמות הוא, ש בית משפט זה אינו משמש כערכאת ערעור על החלטותיו של בית הדין הארצי לעבודה. הסוגיות בעתירה אינן מעוררות שאלות בעלות חשיבות ציבורית כללית החורגות מעניינו הפרטי של העותר ולא נפלה טעות משפטית מהותית שהצדק דורש את תיקונה. פסק דינו של בית הדין הארצי לעבודה נסב על עניינו הפרטני של העותר ונסב על שאלה פרוצדוראלית מובהקת, הנדונה מעשה של יום ביומו על ידי רשמים של ערכאות ערעור.

4.אשר על כן דין העתירה להידחות על הסף. לפנים משורת הדין אמנע זו הפעם מלהטיל הוצאות לטובת אוצר המדינה, באשר ענייננו בעתירת סרק על פניה.
