1.העותר שירת בשירות קבע בצה"ל בתפקיד של מפעיל ציוד מכני הנדסי כבד (צמ"ה) והשתחרר משירות ביום 1.10.2008 (בעתירה לא צויין באיזו שנה התגייס העותר וכמה שנים שירת בשירות קבע). לטענת העותר, לא שולמה לו תוספת לחימה למרות שבתפקידו שימש כלוחם וסיכן את חייו, בעוד שחיילים סדירים בתפקיד דומה הוכרו לפני כעשור כלוחמים ומאז נהנים מתוספת לחימה. דרישת העותר היא כי תשולם לו רטרואקטיבית תוספת כאמור לכל חודש, החל מהמועד בו הכירו בחיילי הצמ"ה כלוחמים, ועד ליום שחרורו.

העותר פנה בשנת 2009 לנציב קבילות החיילים בעניין זה והופנה לגורמים הרלוונטיים, שלטענתו השיבו פניו ריקם, ומכאן עתירתו זו.

2.דין העתירה להימחק על הסף.

חוק שירות הקבע בצבא ההגנה לישראל (הליכים לעניין החלטות הנוגעות לחיילים בשירות קבע), התש"ע-2010 (להלן: החוק) נועד להסדיר את עניינם של אנשי קבע, לרבות מי שהיה איש קבע והשתחרר מהצבא (ראו בסעיף ההגדות לחוק). סעיף 4 לחוק מגדיר את סמכויות וועדת הערר על החלטות של הגורמים המוסמכים, ובין היתר בעניינים הנוגעים לשכר ולתשלומים כלהלן:

"(א) חייל בשירות קבע הרואה את עצמו נפגע מהחלטה של גורם מוסמך בעניינים כמפורט להלן... רשאי לערור על ההחלטה לפני ועדת ערר:

(1) ענייני שכר וזכויות נלוות לשכר, ובכלל זה זכאות לרכיבי שכר, חופשה, פדיון ימי מחלה, מענק שחרורין, ניכויים מהשכר, מימוש תכנית שירות שאינו כרוך בתפקיד או בקידום בדרגה, וכיוצא באלה [...]"

4.מכאן, שלעותר עומד סעד חלופי של פנייה לועדת הערר (ראו, בדומה לענייננו בג"ץ 5741/10 איסמאעיל עבד אלחיק נ' ראש המטה הכללי (לא פורסם, 18.8.2010), וככלל, אין בית משפט זה דן בעתירה כל עוד לא מיצה העותר סעד חלופי שעומד לו על פי דין (ראו בג"ץ 7190/05 לובל נ' מדינת ישראל (לא פורסם, 18.1.2006), פסקאות 12-11).

אשר על כן, העתירה נמחקת, ולפנים משורת הדין, ללא צו להוצאות.
