בעתירה שלפנינו מבקשות העותרות, בין היתר, להימנע מקיזוז חובותיהן כלפי המשיבה 3 (להלן: חברת החשמל) מתוך הכספים המועברים לרשות הפלסטינאית (להלן: הרש"פ), ולהורות לחברת החשמל להשיב סכומים שכבר נגבו על ידה בדרך של קיזוז כאמור.

1.בסעיף 16(ב) לחוק ליישום ההסכם בדבר רצועת עזה ואזור יריחו (הסדרים כלכליים והוראות שונות) (תיקוני חקיקה), תשנ"ה-1994 (להלן: החוק), נקבע כי שר האוצר רשאי להורות על קיזוז של חיובים כספיים שחבה הרש"פ למדינת ישראל או לתאגידים שבשליטתה מהכספים המועברים לה. וזו לשון הסעיף (הדגשה הוספה – י.ע.):

ב) שר האוצר רשאי להורות על קיזוז מן הסכומים המועברים של חיובים כספיים נוספים, שהרשות הפלסטינית או תאגידים שבשליטתה או שבניהולה חבים

(1) לישראל או לתאגידים שבשליטתה או שבניהולה;

(2) לאדם אחר בישראל, אם התקיימו תנאים שקבע שר האוצר ובהתאם להסדרים שקבע.

מכוח סעיף 16(ב)(1) לחוק, ועל פי הסכם בין הרש"פ למדינה, מקוזזים מהכספים המועברים לרש"פ חובות לחברת החשמל בגין אספקת חשמל לשטחי הרשות.

2.העותרות הן מועצות מקומיות בשטחי הרש"פ, אשר בינן לבין חברת החשמל נתגלע סכסוך לגבי גובה החשבון עבור צריכת החשמל. זאת, לאור טענת חברת החשמל כי מוני החשמל של העותרות חובלו במזיד וצריכת החשמל בפועל היתה גבוהה מזו שנרשמה במונה. העותרות מכחישות את החוב הנטען, ועתרו במסגרת עתירה זו למנוע את קיזוז החוב השנוי במחלוקת, על מנת שלא תחויבנה על ידי הרש"פ בסכום שקוזז. לטענת העותרות, הסמכות לקזז מהכספים המגיעים לרש"פ מוגבלת אך ורק לחוב סופי שאינו שנוי במחלוקת, אך כאשר החוב שנוי במחלוקת, על הטוען הנטל להוכיחו בבית המשפט. עוד טענו העותרות כי חברת החשמל נוקטת בסעד עצמי; כי יש לקבוע קריטריונים לקיזוז חובות; וכי הקיזוז פוגע בזכות הקניין של העותרות ותושביהן ובזכות השימוע שלהן.

3.דין העתירה להידחות על הסף ממספר טעמים.

ראשית, הקיזוז מתבצע בין המדינה לרש"פ ואין יריבות ישירה בין העותרות לבין המשיבים.

שנית, חלק מהעותרות לא פנו כלל למדינה ולחברת החשמל טרם הגשת העתירה, כך שדין העתירה להידחות בשל אי מיצוי הליכים. כך, העותרת 2 פנתה לחברת החשמל ובעקבות בדיקה שנערכה, נמצא כי אכן נפלה טעות בדרישת התשלום והחשבון תוקן, ובעקבות זאת מחקה את עתירתה.

שלישית, ועיקרו של דבר, אם נפשיט את העתירה ממחלצותיה הרי שמדובר בסכסוך כספי הנוגע לגובה החוב של העותרות בגין צריכת חשמל שלא כדין ו בית משפט זה אינו הפורום המתאים לבירור טענות הצדדים (לסכסוך דומה שנדון בערכאות אזרחיות ראו רע"א 1794/11 חברת החשמל מחוז חברון נ' חברת החשמל לישראל בע"מ (לא פורסם, 5.6.2011)). לעותרות עומד סעד חלופי של הגשת תביעה כספית כנגד חברת החשמל, להשבת הכספים שנגבו מהן באמצעות הקיזוז ואין בית משפט זה נדרש לעתירה כל עוד לא מיצה העותר סעד חלופי העומד לו על פי דין (ראו, לדוגמה, בג"ץ 7190/05 אריה לובל נ' מדינת ישראל (לא פורסם, 18.1.2006), פסקאות 12-11). כאמור, חברת החשמל סברה כי קיימות די ראיות לכך שהעותרות צרכו חשמל שלא כדין, וככל שהעותרות חולקות על כך, פתוחה להן הדרך להגיש תובענה ב בית המשפט המוסמך.

4.אשר על כן דין העתירה להידחות על הסף. בנסיבות העניין אין צו להוצאות.
