השופטת מ' נאור:

1.עתירה זו מכוונת נגד מיקומה הנבחר של תחנת הכוח המתוכננת לקום על פי תוכנית תשתיות לאומיות 29א' אשר אושרה על ידי ממשלת ישראל ביום 21.7.2011. תחנת הכוח עתידה לקום בשפלת יהודה כ- 7.5 ק"מ דרומית מזרחית לצומת ראם, כ- 1,500 מטר דרומית לקיבוץ כפר מנחם. המקום הוא בצמידות לתחנת כוח קיימת של חברת החשמל. העותרת היא עמותה רשומה של "תושבים למען איכות החיים ביואב".

2.אף שניתן להבין לליבם של התושבים, המבקשים שלא להתגורר בקרבת תחנת כוח, לא מצאנו עילה משפטית להתערבות בהחלטת המשיבים בעניין מיקומה של התחנה.

3.המדינה תיארה בתגובתה הליך מובנה בו נבחנו חלופות שונות, ובהן גם חלופות שהיו עדיפות בעיני היזם. לאחר הליך של שקילה, נקבע המיקום הנוכחי, וזאת לאחר מתן משקל שונה לקריטריונים שנבחנו.

4.לא ראינו עילה משפטית להתערב בבחירת החלופה. יש הגיון בהקמת תחנת כוח בצמידות לתחנת כוח קיימת. מדובר בשאלה תכנונית. השאלה מהו המקום הסביר ביותר, ומה משקלם של השיקולים השונים, הוא עניין לרשויות התכנון. העותרים לא הצביעו על פגם של מתן העדפה פסולה לאינטרס של היזמים או שיקולים זרים. לאחר עיון בחומר הרב שהוצג לנו, לא נוכל לומר כי המיקום הוא בלתי סביר. היקף התערבותו של בית המשפט בכגון דא הוא צר ולא נמצאה לנו עילת התערבות.

5.העתירה נדחית.
